### 94 Recommendation of application for transfer > > (1) The Director is to consider an application for the transfer of a lease. > > > (2) [*\[Section 94 Subsection (2) amended by No. 24 of 2013, s. 94, Applied:28 Jun 2013\]*](/view/html/inforce/2013-06-28/act-2013-024#GS94@EN) The Director may only recommend that the Minister grant an application for the transfer of a lease if satisfied that the person to whom the applicant proposes to transfer the lease– > > > > > > (a) intends to mine; and > > > > > > > (b) intends to comply with this Act; and > > > > > > > (c) has an appropriate mining plan; and > > > > > > > (d) is likely to have sufficient financial and technical resources to carry out the mining plan; and > > > > > > > (e) has provided the Director with sufficient information relating to the likely impact on the environment; and > > > > > > > (f) has provided a security deposit.
