80 Conditions of mining lease
(1) The Minister may grant an application for a lease subject to any conditions the Minister considers appropriate.
(2) If a lease is held by 2 or more persons, those persons are jointly and severally liable for complying with the conditions of the lease.
(3) [Section 80 Subsection (3) substituted by No. 24 of 2013, s. 85, Applied:28 Jun 2013] The Minister may vary the conditions of the lease by rescinding, adding, substituting or amending a condition.
(3A) [Section 80 Subsection (3A) inserted by No. 44 of 2017, s. 33, Applied:21 Nov 2017] The Minister may vary the mineral category or categories to which the lease relates by rescinding, adding, substituting or amending a category or categories.
(4) [Section 80 Subsection (4) amended by No. 17 of 1996, Applied:10 Apr 2002] The department or authority responsible for the Water Management Act 1999 is to ensure, as far as practicable, that a lessee has sufficient access under that Act to water for the purposes of the lease.
