### 78 Granting application for mining lease > > (1)  After considering an application for a lease and any recommendation of the Director and subject to any decision of the Mining Tribunal, the Minister may – > > > > > > (a) grant the application; or > > > > > > > (b) refuse to grant the application. > > > (2)  If the Minister intends to grant a lease contrary to the recommendation of the Director – > > > > > > (a) the Director is to notify that intention in accordance with [section 75](#GS75@EN) [(2)](#GS75@Gs2@EN) ; and > > > > > > > (b) [*\[Section 78 Subsection (2) amended by No. 24 of 2013, s. 82, Applied:28 Jun 2013\]*](/view/html/inforce/2013-06-28/act-2013-024#GS82@EN) a person with an interest or estate in the land in respect of which the lease is sought is entitled to object in accordance with [section 76](#GS76@EN) . > > > (3)  The Minister, by notice in writing, must notify an applicant of – > > > > > > (a) the grant of the application; or > > > > > > > (b) the refusal to grant the application and the reasons for the refusal.
