### 53 Granting application for retention licence
> > (1) After considering an application for a licence and any recommendation of the Director and subject to any decision of the Mining Tribunal, the Minister may –
> >
> > > > (a) grant the application; or
> > >
> > > > (b) refuse to grant the application.
>
> > (2) The Minister may only grant an application for a licence if satisfied that –
> >
> > > > (a) [*\[Section 53 Subsection (2) amended by No. 24 of 2013, s. 59, Applied:28 Jun 2013\]*](/view/html/inforce/2013-06-28/act-2013-024#GS59@Hpa@EN) the land comprised in the licence is likely to be able to be effectively and efficiently mined for the minerals, or the category of minerals, to which the licence is to relate; and
> > >
> > > > (b) there is a sufficient quantity of minerals to justify mining; and
> > >
> > > > (c) the applicant is justified for economic or other reasons not to proceed to mine; and
> > >
> > > > (ca) [*\[Section 53 Subsection (2) amended by No. 44 of 2017, s. 20, Applied:21 Nov 2017\]*](/view/html/inforce/2017-11-21/act-2017-044#GS20@EN) the applicant has provided a copy of the applicant's current public liability insurance policy; and
> > >
> > > > (d) the applicant has provided a security deposit.

> > (3) If the Minister intends to grant an application for a licence contrary to the recommendation of the Director –
> >
> > > > (a) the Director is to notify that intention in accordance with [section 50](#GS50@EN) [(2)](#GS50@Gs2@EN) and [(3)](#GS50@Gs3@EN) ; and
> > >

> > (4) The Minister, by notice in writing, must notify the applicant of –

> > > > (b) the refusal to grant the application and the reasons for the refusal.
