178Invalidated licence or lease

### 178 Invalidated licence or lease > > (1)  A licensee or lessee whose licence or lease is invalidated because of native title being determined in respect of the licence area or lease area has exclusive right to apply for a new licence or lease in respect of that area. > > > (2)  [*\[Section 178 Subsection (2) amended by No. 74 of 2001, s. 31, Applied:30 Oct 2001\]*](/view/html/inforce/2001-10-30/act-2001-074#GS31@EN) An exclusive right to apply for a new licence or lease under [subsection (1)](#GS178@Gs1@EN) is in force for a period of 12 months from the date on which the former licence or lease is invalidated or until an application has been made under this section, whichever is the earlier.
