### 116 Fossicking areas

> > (1) The Minister, by order, may declare any area to be a fossicking area if the Minister is satisfied that –
> >
> > > > (a) no mineral tenement exists in respect of that area; or
> > >
> > > > (b) if a mineral tenement exists in respect of that area, fossicking in that area is not likely to interfere to any substantial degree with anything done, or likely to be done, under that mineral tenement.

> > (2) The Minister may, in an order under [subsection (1)](#GS116@Gs1@EN) declaring an area to be a fossicking area, specify the conditions subject to which a person may fossick in the area.
>
> > (3) Any person may fossick in an area that is declared by an order under [subsection (1)](#GS116@Gs1@EN) to be a fossicking area.
>
> > (4) A person fossicking in an area declared by an order under [subsection (1)](#GS116@Gs1@EN) to be a fossicking area must not, while in that area, contravene the conditions specified in the order.

> > Penalty: 100 penalty units.
