### 105 Removal of building, machinery and property
> > (1) A former lessee or a person lawfully claiming under the lessee may enter land to remove any building, machinery or other property belonging to the former lessee from the land within 6 months after any interest of the former lessee in the lease is terminated.

> > (2) The Minister may require a former lessee to remove any building, machinery or other property at any time within the period referred to in [subsection (1)](#GS105@Gs1@EN) if satisfied that the presence of the building, machinery or other property is likely to interfere with the mining or rehabilitation of the land.
>
> > (3) A person must not remove any building, machinery or other property after the period referred to in [subsection (1)](#GS105@Gs1@EN) without the written approval of the Director.
> >
> > Penalty: Fine not exceeding 100 penalty units.
>
> > (4) Any building, machinery or other property on Crown land which has not been removed vests in the Crown.
>
> > (5) Any building, machinery or other property on private land which has not been removed vests in the owner of the land unless the former lessee and owner agree otherwise.
