What it does
This Determination prescribes how interest is to be calculated and applied where payment of military superannuation benefits is delayed and the Military Superannuation and Benefits Board of Trustees No. 1 (the Board) approves an increase in the benefit by an amount of interest. It replaces the 2004 Determination and any amending determinations (cl 3). The Determination commences the day after it is registered on the Federal Register of Legislative Instruments (cl 2).
Mechanically, the Determination:
- Defines key terms by reference to the Military Superannuation and Benefits Act 1991 (the Act) and the Rules (cl 4(2)), and specifically identifies the Board (cl 4(1)).
- Sets the formula and process for calculating interest on delayed lump-sum benefits (cl 5).
- Sets the process and formulae for calculating interest when the Board approves an increase in the rate of a pension or associate pension (cl 6).
- Fixes how the applicable rate of interest for each calendar year is determined: the 10 year Treasury Bond yield last published by the Reserve Bank of Australia in the previous December of the calendar year in which arrears accrued (cl 7).
The Determination operates as a subordinate instrument implementing rule 69 of the Rules: it addresses two distinct outcomes under rule 69 , lump-sum increases (rule 69(1)) and increases to pension rates (rule 69(2)) , by prescribing arithmetic methods to convert an annual benchmark yield into daily or fortnightly interest accruals and to compound those accruals across relevant periods (cls 5-7). The Board retains the administrative decision to determine the period of delay under rule 69, and to approve the increase in an amount of interest , the Determination supplies only the calculation method once those administrative decisions are taken (see cl 4(1) defining period of delay and the cross-reference to rule 69).
