What it does
This instrument, titled the Military Rehabilitation and Compensation (Warlike Service) Determination 2019, designates specified Defence Force operations, geographic areas and time periods as "warlike service" for the purposes of the Military Rehabilitation and Compensation Act 2004 (the Act). The instrument states its legal basis at s 3: it is made under paragraph 6(1)(a) of the Act. The Definitions provision at s 5 clarifies that "Act" in the instrument means the Military Rehabilitation and Compensation Act 2004, that "ADF" means the Australian Defence Force (within the meaning of the Defence Act 1903), and that "NATO" means the North Atlantic Treaty Organization.
Mechanically, s 6 of the Determination performs a single legal function: it tells readers that Schedule 1 specifies service with the Defence Force that is warlike service for the purposes of the Act. Schedule 1 (para 1) then sets the controlling test: service with the Defence Force in an operation mentioned in an item of the schedule is warlike service if two conditions are met: (a) the service is in an area of operation mentioned in the item; and (b) it occurs during a period mentioned in the item. Put plainly, the instrument operates as a list, with each schedule item comprising an operation name, a high‑level description of the nature of the operation, a defined area of operation (sometimes expressed by named territory, sometimes by precise geographical coordinates, sometimes by "superjacent airspace"), and a time window (either a closed date range, or "on and after" a starting date).
The schedule lists discrete operations (Items 1-18), including but not limited to Enduring Freedom,Afghanistan (Item 1), several entries for Operation Slipper (Items 2, 2A, 2B, 2C), ISAF and related multinational missions (Items 3-8), operations in Iraq and Libya (Items 5, 11, 13, 14, 14A, 17), and subsequent named contributions such as Highroad, Augury, Orenda and Steadfast (Items 15-18). For many items the geographical scope is Afghanistan and its superjacent airspace; for others it is the land area and superjacent airspace of Iraq and/or Syria, or defined coordinate boxes across maritime/air regions. Periods range from discrete historical windows (for example, Item 1: 7 October 2001 - 31 December 2014) to open‑ended "on and after" commencements (for example, Item 16: on and after 28 April 2016), and in at least one instance extend as far as 31 December 2024 (Item 14A).
The immediate legal effect is narrow and mechanical: the Determination defines, for the purpose of the Act, which Defence Force service qualifies as "warlike service". Any entitlements, duties, assessments or obligations that flow from the classification of "warlike service" are determined by the provisions of the Act; the Determination does not itself set compensation levels, procedures or penalties. The instrument thus functions as a list that operationalises paragraph 6(1)(a) of the Act by listing eligible operations/areas/dates, with precision sufficient to map service records to the statutory category.
