What it does
This instrument, the Military Rehabilitation and Compensation (Members - War Artists and Entertainers - Service End Date) Amendment Determination 2015 (Instrument 2015 No. MRCC 71), amends two existing determinations that specify classes of persons who are “members” for the purposes of the Military Rehabilitation and Compensation Act 2004. It is made by the Minister for Veterans’ Affairs under section 8 of the Military Rehabilitation and Compensation Act 2004 (opening paragraph). The Determination:
- establishes that its commencement is tied to the commencement of a separate instrument, the Safety, Rehabilitation and Compensation (Definition of Employee - War Artists and Entertainers) Notice 2015 (s 2);
- provides a saving and application provision preserving existing membership status for persons who were members immediately before this Determination commences, and continues them as members under the same determinations as amended by this instrument (s 3);
- amends two existing Member Determinations, namely the Military Rehabilitation and Compensation (Members) Determination 2006 (No.2) and the Military Rehabilitation and Compensation (Members) Determination 2007, by inserting a new definition and substituting a new Schedule 1 in each (s 4; Schedule Parts A and B).
Mechanically, the amendments add a definition in each amended determination for "SRCA Notice 2015" which refers to the Safety, Rehabilitation and Compensation (Definition of Employee - War Artists and Entertainers) Notice 2015 (Schedule Part A, item 1; Part B, item 1). The Schedule substitutions replace Schedule 1 in both determinations with two discrete items describing classes of persons and the acts that qualify them as members:
- For the 2006 (No.2) Determination (Part A, Schedule 1, Item 1): persons contracted by the Department of Defence to provide or support musical performances and entertainment (including management and technical support), where the acts were performed under the auspices of the Forces Advisory Committee on Entertainment or the Department of Defence, during the period 1 July 2004 to the day immediately before the SRCA Notice 2015 commenced (the text includes an Acts Interpretation Act 1901 s 36(1) note about periods expressed to continue until a specified day).
