What it does
This instrument, the Military Rehabilitation and Compensation (Coordinated Veterans’ Care Mental Health Pilot) Determination 2018 (Instrument 2018 No. MRCC 41), identifies a specific class of former Defence personnel who are eligible, subject to further selection, to receive services under the Commonwealth program called the Coordinated Veterans’ Care Mental Health Pilot. The instrument is made by the Military Rehabilitation and Compensation Commission under subsection 287A(2) of the Military Rehabilitation and Compensation Act 2004 (the Act) (s3). It comes into effect immediately after the commencement of Schedule 3 to the Veterans’ Affairs Legislation Amendment (Veteran-centric Reforms No. 1) Bill 2018 (s2), with an explanatory note in the instrument referencing when Schedule 3 to a related 2017 Act was to commence (Note to s2). The written purpose is to determine the class of persons who will be entitled, subject to the Commission’s further selection, to services under the Coordinated Veterans’ Care Mental Health Pilot (s4).
Mechanically, the instrument does not itself create the pilot program, fund it or describe the services. Instead it defines the eligible class (s6) and relies on the Commission’s power under paragraph 287A(1)(b) of the Act (explained in Note 1 to s4) to select persons from that class to receive services. The instrument sets eligibility conditions: former member status combined with Reserve membership after separation (s6(a)); Australian residency (s6(b)); particular clinical thresholds for mental health (mild to moderate anxiety disorder or depressive disorder) and a co‑existing chronic physical condition accompanied by pain (s6(c)(i)-(ii)); a general practitioner’s opinion that the person is likely to benefit from participation (s6(d)); and possession of a Repatriation Health Card - For Specific Conditions (White Card) (s6(e) and s5 definition of White Card). Definitions in the instrument tie the diagnostic thresholds to particular Statements of Principles and to later versions “in force from time to time” (s5). The instrument also includes an external link for program details (Note 2 to s4), but the instrument itself does not specify the procedural mechanism for selection, the services to be provided, funding, or enforcement measures.
