55  Persons to whom Part applies  (1) This Part applies to a person if:  (a) the person has an impairment as a result of a service injury or disease; and  (b) the Commission has accepted liability for the injury or disease; and  (c) the person:  (i) is undertaking, or has completed, an approved rehabilitation program in respect of the impairment; or  (ii) has been assessed under section 44 as not having the capacity for rehabilitation.  (2) To avoid doubt, this Part applies to a person who has an impairment as a result of an aggravated injury or disease even if the impairment resulted from the original injury or disease and not from the aggravation or material contribution.
