399 When Division applies This Division applies if: (a) compensation is payable under this Act in respect of: (b) the person or a dependant of the person recovers damages (including damages payable as a result of the settlement of a claim) in respect of the cause of action from a person other than the Commonwealth or a potentially liable member.
