193  Variations during the example period  (1) This section applies for the purposes of sections 98, 112, 147, 156 and 171 if a person’s civilian daily earnings or pre‑CFTS pay varies during the example period.  (2) If the variation occurs as a result of:  (a) the operation of a law of the Commonwealth, a State or a Territory; or  (b) the making, alteration or operation of a national minimum wage order (within the meaning given by the Fair Work Act 2009), or an award, order, determination or industrial agreement, or the doing of any other act or thing, under such a law; then the amount of the civilian daily earnings or pre‑CFTS pay for the person is instead the amount that would have been his or her civilian daily earnings or pre‑CFTS pay if the variation had taken effect at the beginning of the example period.
