What it does
The instrument designates classes of persons who can be considered for early access to rehabilitation services under the Military Rehabilitation and Compensation Act 2004 (the Act) while their claim for liability is pending. It is the Military Rehabilitation and Compensation (Accelerated Access to Rehabilitation) Determination 2017, made under subsection 43(4) of the Act (s 1; s 3). The instrument does not itself deliver rehabilitation services. Rather, it determines classes of persons for the purposes of paragraph 43(3)(c) of the Act, enabling the Military Rehabilitation and Compensation Commission (the Commission) to exercise its power under paragraph 43(3)(d) to determine in writing that Part 2 of Chapter 3 of the Act (rehabilitation programs) applies to selected persons from those classes (s 4, Notes 1 and 2).
Mechanically, the instrument does three things. First, it defines key terms used for the exercise of that selection power: for example, early access to rehabilitation program is defined as an early intervention program funded by the Department to provide rehabilitation services to selected eligible claimants (s 5). Rehabilitation services are defined to include an initial or further request for assessment under section 44 of the Act and a rehabilitation program under section 51 of the Act (s 5). Second, it sets out an exhaustive list of “specified rehabilitation conditions” by reference to provisions of the Statement of Principles made by the Repatriation Medical Authority; each condition in column 1 of the table in s 6 is given the meaning in the identified provision of the Statement of Principles “as in force from time to time” (s 6(1)-(2)). Third, it determines two classes of persons from whom the Commission may select individuals to receive early access to rehabilitation services: the core class (claims involving a specified rehabilitation condition, Commission opinion of likely benefit, and consent to participate) in s 7; and a class consisting of claimants who are receiving a veteran payment made under an instrument under section 45SB of the Veterans’ Entitlements Act 1986 (VEA) in s 8.
