Migration (Subclass 403 (MATES Stream) Visa Pre-application Process) Determination (LIN 24/069) 2024

The instrument organises a few tightly-defined legal concepts and operational requirements. These are defined in the instrument itself (s 4) or are operationalised across Part 2.

• MATES stream visa and MATES stream visa pre-application process: The instrument defines the MATES stream visa as a Subclass 403 visa in the named Mobility Arrangement stream and the pre-application process as the process specified under s 6 (s 4; s 6). Section 6 states the instrument applies to a process conducted under subsection 46C(1) of the Act in relation to a MATES stream visa.
• Registered participant: A person becomes a registered participant only when they register through the online computer program, include a declaration that they meet the eligibility requirements set out in s 9, are not already registered, and register within the registration open period (s 8). The instrument notes that the visa pre-application process charge, if payable, must be paid at the time of registration under the Act (s 8 note referencing subsection 46C(22)).
• Eligibility requirements: The instrument limits entry to registrants who hold a valid passport issued by the Republic of India and whose age at the beginning of the registration open period is at least 18 and no more than 30 (s 9). The age test is expressly tied to the start of the registration open period rather than the date of registration.
• Registration and selection open periods: Both are required to be finite periods. The Minister must cause the registration open period and selection open period, and any extensions of those periods, to be published on the Department’s website (s 10(1)-(2); s 14(1)-(2)). The instrument does not prescribe the duration of the periods or any cap on participant numbers.
• Withdrawal and lapsing: Registered participants may withdraw via the online computer program (s 11). Registration lapses at the earliest of the end of the selection open period, selection, withdrawal being lodged, or death prior to selection (s 12).
• Selection method and notice: Selection of participants is by random selection through a computer program (s 13). The Minister must give written notice as soon as practicable after selection, specifying a date by which the successful person must make a valid visa application; that date must be at least 28 days after the notice is given (s 15(1)-(3)).
• Use of computer programs and ministerial control: Multiple provisions require use of an internet-based computer program (registration, withdrawal, and selection) and the instrument’s notes cross-reference subsection 46C(11) of the Act regarding a computer program under the Minister’s control (ss 8, 11, 13 notes).

Operationally, the instrument sets out a pipeline: publish registration open period (Minister), prospective participants register online within that finite window and declare eligibility and pay any charge, the Minister publishes selection open period, selection occurs by random computer process, the Minister issues written notice with a minimum 28-day period to lodge a visa application, and registrations lapse according to the enumerated triggers (ss 10-15, 8, 12). The instrument does not set quotas, selection weights, audit requirements for the randomisation mechanism, or detailed procedural fairness safeguards; its main controls are timing, online process, the binary eligibility tests (passport and age), and the written notice with a minimum 28-day window.

The instrument affects distinct groups in clearly delineated ways: prospective applicants, the Department/Minister, and the digital systems used to administer the process.

• Prospective registrants: Only persons who hold a valid passport issued by the Republic of India and who meet the age threshold at the start of the registration open period (18-30 years inclusive) may register (s 9). The requirement to register via the specified internet-based computer program makes digital access and the ability to use the program a practical precondition (s 8). Prospective participants must also make the explicit declaration that they meet the eligibility requirements at registration (s 8(b)), and any visa pre-application process charge must be paid at registration (note to s 8 referencing subsection 46C(22)). The instrument prohibits duplicate registration for the same process (s 8(c)). Registrants can withdraw via the online tool (s 11).
• Selected participants: Persons randomly selected by the computer program become selected participants (s 13). The Minister must then provide written notice and a deadline for lodging a valid MATES stream visa application at least 28 days after the notice (s 15). A selected participant’s earlier registration lapses on selection (s 12(b)). The instrument does not alter the substantive visa-granting tests for a Subclass 403 visa; it only confers the right to apply within the stated timeframe.
• The Minister and the Department: The Minister is responsible for setting and publishing both registration and selection open periods and any extensions on the Department’s website (ss 10(2), 14(2)). The Minister must ensure availability of and control the computer programs used for registration, withdrawal, and random selection (ss 8, 11, 13; notes referencing subsection 46C(11)). The Minister must give written notice to selected participants as soon as practicable and specify the application deadline (s 15). Administratively, the Department will operate the website and computer systems, manage public communications about open periods, handle payments at registration (the charge), and manage the selection notices.
• Entities seeking to recruit or sponsor applicants: The instrument does not create any role for employers, sponsors or third parties in the pre-application process; it operates as a direct-to-individual mechanism. Because selection is random and eligibility criteria are narrow and objective (passport and age), employers cannot directly influence selection under the rules in the instrument itself. The instrument does not prohibit third-party assistance in registration, but all registration actions and withdrawals must occur via the specified internet-based computer program (s 8; s 11).
• Persons outside the instrument’s scope: Non-Indian passport holders, persons aged under 18 or over 30 at the start of the registration open period, and persons seeking other visa streams are excluded by the instrument’s eligibility and subject-matter limits (ss 6-9).

Practical burdens fall mainly on applicants (digital access, declared eligibility, fee at registration, timeliness to lodge visa application after notice) and on the Department (publishing and operating the online system, administering selection and notices). The instrument centralises the ministerial role for timing and publication; the Minister and Department decide when windows open, how long they run and how long extensions last, subject only to the requirement that the periods be finite and that publication occurs (ss 10(1)-(2), 14(1)-(2)).

The instrument creates a compact set of duties (mostly for the Minister/Department and registrants) and limited procedural rights for participants.

Duties imposed on Minister/Department:

• Publish registration and selection open periods, and any extensions, on the Department’s website (s 10(2); s 14(2)). That duty fixes the public mechanism for communicating the timing of the process.
• Provide and control the computer programs used for registration, withdrawal and random selection (notes to ss 8, 11, 13; reference to subsection 46C(11) of the Act). The instrument requires use of those programs but delegates specification and control to the Minister under the Act.
• Give written notice as soon as practicable after selection and specify the date by which a selected person must make a valid MATES stream visa application; the specified date must be at least 28 days after the notice (s 15(1)-(3)).
• Ensure the registration and selection open periods are finite (s 10(1); s 14(1)). The instrument does not set upper or lower bounds on those periods, leaving those details to the Minister’s discretion, but requires finitude and publication.

Duties imposed on registrants and applicants:

• Register as a participant using an internet-based computer program (s 8(a)).
• Provide a declaration that they meet the eligibility requirements in s 9 as part of registration (s 8(b)). The instrument requires the declaration but does not specify consequences for a false declaration in these provisions.
• Pay any visa pre-application process charge at registration where one is payable, as noted in the instrument (s 8 note referencing subsection 46C(22) of the Act).
• Ensure registration occurs within the registration open period and that they are not already registered (s 8(c)-(d)).
• If selected, act on the written notice and lodge a valid MATES stream visa application by the date specified in the notice (s 15(2)-(3)). The instrument sets a minimum window of 28 days from notice for lodging the visa application (s 15(3)).

Rights and procedural consequences:

• Right to withdraw registration: A registrant may withdraw their registration using the internet-based computer program (s 11). Withdrawal causes lapse of registration when lodged (s 12(c)).
• Right to written notice and a minimum timeframe: Selected participants must receive written notice as soon as practicable and be provided at least 28 days to lodge a visa application (s 15(1)-(3)).
• Right to participation in the selection: Provided registration requirements are met, selection is random by computer program; the instrument does not provide for merit-based preferential selection or review of selection outcomes (s 13). The random selection mechanism is the sole selection method specified.

Other procedural rules with legal effect:

• Registration lapses on the earliest of a finite list of events: end of selection open period, selection, withdrawal or death (s 12). Lapse on selection occurs when the person is selected (s 12(b)), meaning that selection removes the registrant’s status as a registrant and converts it into selected participant status.
• Age is fixed by reference to the beginning of the registration open period (s 9(b)). That choice of timing is legally significant for eligibility assessments and planning.

The instrument’s duties are largely administrative and procedural; it sets obligations about publication, online programme control and notice timing, and places specified obligations on registrants regarding how they register, what they must declare, and payment at registration. It leaves substantive visa-grant tests and post-selection application processing to the existing visa framework under the Migration Act and associated instruments.

This instrument contains no express criminal, civil or administrative penalty provisions. It is a procedural determination that sets out how a MATES stream visa pre-application process must be conducted; enforcement mechanisms are administrative rather than punitive within the instrument’s text.

Elements that operate as administrative enforcement or effectuate outcomes:

• Lapse of registration: The instrument prescribes events that cause a registration to lapse automatically (s 12). Lapsing is the primary internal enforcement mechanism: failure to remain registered (by end of selection open period), withdrawal, selection or death extinguish registered participant status (s 12(a)-(d)).
• Payment requirement at registration: The instrument notes that any visa pre-application process charge must be paid at the time of registration (s 8 note referencing subsection 46C(22) of the Migration Act). Non-payment would therefore be a practical bar to completion of registration under the Act’s mechanics, though this instrument does not itself set a specific penalty.
• Registration eligibility gates: The instrument enforces eligibility by requiring an explicit declaration at registration that the registrant meets the eligibility requirements set out in s 9 (s 8(b)). The instrument does not set out the specific consequences of an incorrect declaration; however, the declaration is a condition of being a registered participant (s 8).
• Administrative duties of the Minister/Department: Publication duties (s 10(2); s 14(2)) and notice obligations (s 15(1)-(3)) are mandatory and provide the procedural basis for enforcing time-limits and the right to apply. A failure by the Minister/Department to publish the open periods or to give the required notice could be amenable to administrative review in principle, but the instrument does not specify remedies or sanctions.

What the instrument does not do:

• It does not create express criminal offences, pecuniary penalties, civil fines, or explicit grounds for administrative sanction within the text provided.
• It does not describe processes for review or appeal of selection decisions, nor does it mandate auditing, independent verification, or external review of the random selection mechanism.
• It does not prescribe consequences for providing false information during registration, nor does it specify suspension, exclusion or other enforcement steps besides lapsing of registration on the enumerated events.

Enforcement in practice will therefore be effected through control of the online registration and selection mechanics, payment enforcement at the point of registration, and the administrative consequence of lapsed registration. Any further enforcement powers or sanctions (for example, for false statements) would depend on the Migration Act’s broader provisions, which the instrument references for authority (s 3) but does not reproduce.

The instrument is an instrument under the Migration Act 1958 and repeatedly cross-references that Act for authority and certain mechanics.

Statutory basis and cross-references:

• Authority: The instrument is made under subsection 46C(14) of the Migration Act 1958 (s 3). It expressly situates its rules as those required for the purposes of that subsection (s 5).
• Procedural hooks to the Act: The instrument applies to a visa pre-application process conducted under subsection 46C(1) of the Act in relation to a MATES stream visa (s 6). The notes to several provisions reference other subsections of s 46C: subsection 46C(22) regarding the visa pre-application process charge payable at registration, subsection 46C(11) regarding the use of a computer program under the Minister’s control, and subsection 46C(2) in the note to s 13 explaining that a selected person must be a registered participant (s 8 note; s 13 notes).
• Definitions drawn from the Act: Section 4 of the instrument notes that a number of expressions used in the instrument are defined in the Act, including visa pre-application process charge (s 4 note). The instrument therefore operates as a procedural adjunct to the Act rather than a standalone regulatory regime.

Operational interaction:

• The instrument does not set visa-granting criteria or substitute for the Migration Act’s visa application, assessment, character, health or other statutory requirements. Instead, it creates a pre-application layer: selected participants are required to make a valid visa application for the MATES stream visa by a date specified in the selection notice (s 15). The instrument therefore interacts with the substantive provisions of the Migration Act and other migration instruments that govern visa applications, assessments and decisions outside this determination.
• Payment and timing mechanics are linked to the Act via the visa pre-application process charge reference and the Minister’s power to use computer programs under the Act (s 8 note; s 11 & s 13 notes). The instrument does not specify amounts or collection procedures for the charge; these elements are governed by the Act and associated instruments.

Administrative and regulatory interface:

• Publication obligations (ss 10(2), 14(2)) require action on the Department’s website; those publication duties are internal administrative obligations but they also interact with general administrative law doctrines such as procedural fairness and legitimate expectations insofar as persons rely on the published information to act within the finite windows established.
• The instrument’s duties to use online computer programs (ss 8, 11, 13; notes referencing 46C(11)) mean that the Department’s IT systems and privacy/security obligations under other laws will be implicated. The instrument does not itself address privacy, data security, or records retention; those are matters that will be governed by other statutory frameworks and Departmental practice.

Commencement link:

• The instrument commences at the same time as the Migration Amendment (Mobility Arrangements for Talented Early-professionals Scheme) Regulations 2024 (s 2). This alignment suggests the instrument was intended to operate in concert with that regulatory amendment, though the clause does not itself reproduce the content of the Regulations.

Limitations and absence of interaction:

• The instrument does not repeal or vary existing migration law. It does not specify interaction with state or territory law, human rights instruments, or non-migration Commonwealth laws. Its scope is narrow and procedural within the migration statutory framework.

In short, the instrument functions as a set of rules within the Migration Act regime: it relies on and plugs into specific subsections of s 46C for authority and mechanics (registration charge, computer program use, pre-application process conduct) while leaving substantive visa decision-making and other regulatory matters to the Act and associated instruments.

The instrument contains limited amendment history information within its commencement table and a note about the table’s scope.

• Date and maker: The instrument is dated 28 October 2024 and is titled Migration (Subclass 403 (MATES Stream) Visa Pre-application Process) Determination (LIN 24/069) 2024. It is made by the Minister for Immigration and Multicultural Affairs (header).
• Commencement: Section 2 sets out the commencement arrangement. The whole instrument commences at the same time as the Migration Amendment (Mobility Arrangements for Talented Early-professionals Scheme) Regulations 2024 (s 2 and the commencement table). The instrument includes the standard note that the table relates only to the provisions as originally made and will not be amended to deal with later amendments of the instrument.
• No recorded amendments within the text: The instrument’s text as supplied contains no later amendment entries, amending items, or variation sections. The provided instrument therefore appears in its original made form as at the dated signature (28 October 2024). There is no notation in the body of the instrument indicating subsequent amendments, repeal, or expiry.
• Note on the commencement table: Section 2(2) contains the usual statutory formatting caveat that any information in column 3 of the commencement table is not part of the instrument and may be edited in published versions; this does not constitute an amendment but governs publication practice.
• Practical implication: As presented, the instrument should be treated as the original made determination with commencement tied to the referenced Migration Amendment Regulations. Any subsequent amendment to the instrument would need to be made under the Act and would be shown as a formal amending instrument; none is shown here.

If users need to know whether the instrument has been amended after the original making date, they should consult the Federal Register of Legislation or the Department’s consolidated instrument record for LIN 24/069 to confirm whether any amending determinations have been registered or published since the original 28 October 2024 date. The instrument itself provides no further amendment chronology.

The instrument as provided contains no litigation history, case citations, or references to judicial decisions. It does not name or rely on any judicial authority. The text does not record any challenged decisions, declaratory proceedings, or reported litigation about the instrument or the administrative arrangements it prescribes.

Practical points from the instrument relevant to possible future litigation or review:

• Administrative decision points susceptible to challenge: The Minister’s discretion to set and publish finite registration and selection open periods, and to control the computer programs used for registration, withdrawal and selection (ss 10(2), 14(2); notes to ss 8, 11, 13 referencing subsection 46C(11)), create administrative decision points where errors of law, procedural unfairness or failures to follow statutory process could in theory give rise to administrative review or judicial review. The instrument itself does not specify internal review mechanisms or merits review rights.
• Notice and timing obligations: The statutory requirement that selected participants be given written notice as soon as practicable and be afforded at least 28 days to lodge a valid visa application (s 15) is a procedural obligation that could be the subject of review where the Minister/Department fails to comply procedurally.
• Transparency and auditability: The instrument mandates random selection by a computer program but does not include audit, disclosure or independent verification requirements for the randomisation process (s 13). In a dispute about selection integrity, interested persons would likely seek administrative records or challenge procedural fairness; the instrument does not itself set disclosure obligations.
• Absent litigation history in instrument: Because there is no litigation record in the instrument text, any case law or litigation history would need to be located externally. This instrument does not cite cases and does not present prior judicial findings about these procedural rules.

For practitioners assessing potential judicial or administrative review risks, the points above indicate the loci where a challenge might be directed (timing, publication duties, notice content and timing, use and control of computer programs, selection process). The instrument itself provides the procedural text but does not illuminate any prior litigation or dispute resolution history.

The instrument sets out simple rules, but there are a number of concrete practical pitfalls and points of legal particularity that practitioners and participants should note. Each item below is grounded in the instrument’s text.

• Age test fixed to the beginning of the registration open period (s 9(b)). This is not an age-on-application test. A person who is 17 at the start of the registration open period but turns 18 before registering will still fail the eligibility test because the instrument ties the age calculation to the beginning of the registration open period. Conversely, someone who is 30 at the start of the registration open period is eligible even if they will turn 31 later during the window.
• Passport requirement is specific and exclusive (s 9(a)). Eligibility requires holding a valid passport issued by the Republic of India. Dual nationals who do not hold an Indian passport at registration are excluded by the instrument’s terms. The instrument does not recognise alternative proofs of nationality; the passport is the stated test.
• Registration requires an explicit declaration of eligibility (s 8(b)). The instrument makes the declaration an integral part of registration. The instrument does not set out consequences for an incorrect declaration within these provisions; however, a false declaration may affect the registrant’s status under other provisions of the Migration Act or immigration law generally.
• Registration via an internet-based computer program is mandatory (s 8(a)). There is no non-digital backstop in the instrument. Applicants lacking reliable internet access or with accessibility needs must rely on Departmental accommodations outside this instrument, if available.
• Payment at registration (s 8 note). The instrument notes the visa pre-application process charge must be paid at the time of registration (subsection 46C(22) of the Act is referenced). The instrument itself does not set the amount, the refund rules, or how payment failure is treated; those details are governed by the Act and other instruments.
• Finite, Minister-set windows with publication duty (ss 10-10(2), 14-14(2)). The instrument requires windows be finite and published on the Department website, but it does not prescribe their length or the number of windows. The Minister thus controls timing and can extend windows, subject only to the publication requirement. Strategic timing by the Department could materially affect who can participate given time zone differences and outreach, but the instrument does not constrain those choices.
• Random selection, no stated auditing or weighting (s 13). Selection is by random selection via a computer program. The instrument does not specify the randomisation method, any audit or disclosure requirements, or whether selection will be stratified or weighted. Participating persons therefore have no statutory entitlement under this instrument to an explanation of selection methodology or results.
• Registration lapses on selection and other events (s 12). Selection terminates registered participant status at the moment of selection (s 12(b)). This means that a registrant cannot be simultaneously a registrant and a registrant-in-waiting for other cohorts under the same process; duplicate registration is expressly barred (s 8(c)).
• Minimum 28-day application window after notice (s 15(3)). The instrument mandates at least 28 days from notice for a selected participant to lodge a valid visa application. The instrument does not prescribe a maximum window, nor does it prescribe how notice must be served beyond being "in writing" (s 15(1)). The form of "writing" is therefore not defined here.
• No quotas or selection numbers in the instrument. The instrument imposes no limit on how many registered participants may be selected, nor does it specify selection frequency. Any numerical limits would need to come from other instruments or departmental practice.
• Death and withdrawal triggers (s 12(c)-(d)). If a registrant dies before selection, their registration lapses immediately (s 12(d)). Withdrawal must be lodged through the internet-based computer program (s 11); the instrument does not permit other withdrawal methods.
• Narrow subject-matter and geography (ss 6-7). The pre-application process applies only to the MATES stream of Subclass 403 visas and only in relation to the Republic of India (s 7). Persons outside that nationality or seeking different streams are not covered by this mechanism.

These are operationally consequential items because they affect eligibility, timing, and access. Where the instrument is silent (for example, on the consequences of false declarations, auditability of the randomisation, or the precise form of written notice), practitioners should anticipate looking to the Migration Act, related regulations, Departmental guidance or administrative policy for further detail.

This section provides concrete, text-grounded steps for both prospective participants and for the Minister/Department to ensure compliance with the instrument as written.

For prospective participants (applicants from India):

1. Monitor the Department’s website for publication of the registration open period and any extensions (s 10(2)). The Minister must cause those periods to be published.
2. Confirm eligibility at the relevant benchmark date: ensure you hold a valid passport issued by the Republic of India and that you are aged at least 18 and no more than 30 at the beginning of the registration open period for the process you intend to enter (s 9).
3. Register during the finite registration open period using the internet-based computer program made available for that purpose (s 8(a); s 10(1)). Registration outside that finite period will not create registered participant status.
4. During registration, include the required declaration that you meet the eligibility requirements specified in s 9 (s 8(b)). Ensure the declaration is accurate and complete, as the instrument makes that declaration part of the registration.
5. Pay any visa pre-application process charge at the time of registration where one is payable (note to s 8 referencing subsection 46C(22)). Prepare to make payment through the online registration system at the time of registration.
6. Do not register more than once for the same MATES stream visa pre-application process (s 8(c)). The instrument expressly bars duplicate registration.
7. If you change your mind before selection, withdraw your registration via the internet-based computer program (s 11). Withdrawal takes effect when lodged and causes registration to lapse (s 12(c)).
8. If selected, expect a written notice from the Minister as soon as practicable (s 15(1)). The notice will include the date by which you must lodge a valid MATES stream visa application (s 15(2)).
9. Lodge your valid MATES stream visa application by the stated date. The instrument requires the date in the notice to be at least 28 days after the day on which the notice is given (s 15(3)). Prepare supporting documents and the visa application so you can lodge within the window.
10. Keep records of registration confirmation, payment receipt for any charge, and the written notice of selection. The instrument does not specify retention periods; maintaining your own records will assist with any administrative queries.

For the Minister / Department (administrators and policy operative points):

1. Establish and publish a finite registration open period on the Department’s website, and publish any extension to it (s 10(1)-(2)). Ensure the website publication is clear about start and end dates and any extension mechanics.
2. Provide and maintain the internet-based computer program for registration, withdrawal and random selection, consistent with the instrument’s required use of such programs (notes to ss 8, 11, 13 referencing subsection 46C(11)). Ensure the program is accessible, secure, and capable of receiving the required declarations and payments.
3. Implement payment mechanics for the visa pre-application process charge at registration where the Act provides for a charge (s 8 note referencing subsection 46C(22)). Design the payment flow to prevent completion of registration without payment where a charge applies.
4. Ensure eligibility verification processes are in place to confirm registrants hold a valid passport issued by the Republic of India and meet the age test at the beginning of the registration open period (s 9). Where eligibility checks are automated or manual, document the verification standard and evidence required.
5. Prevent duplicate registrations for the same process in the computer program (s 8(c)). Build deduplication checks at the point of registration to implement the “not already registered” requirement.
6. Design and document the random selection algorithm and the selection process to ensure it is a bona fide random selection by computer program (s 13). Although the instrument does not impose specific audit procedures, recordkeeping and internal auditing will reduce legal and reputational risk.
7. Publish selection open periods and any extensions on the Department’s website (s 14(2)). Selection windows must be finite (s 14(1)).
8. Give written notice to selected participants as soon as practicable after selection, specifying the deadline for lodging a valid MATES stream visa application, and ensure that deadline is at least 28 days after the notice (s 15(1)-(3)). Define the method for written notice and maintain proof of delivery and content.
9. Implement data and records management policies for registrations, selections, withdrawals and notices. The instrument presumes use of Departmental systems and makes reference to computer programs under Ministerial control (notes to ss 8, 11, 13). Ensure privacy, security and retention policies align with other Commonwealth requirements.
10. Prepare contingency and accessibility plans for registrants who need assistance or face technical barriers, acknowledging that the instrument requires online registration and withdrawal (ss 8, 11) and that the Department’s published windows will be finite (ss 10(1), 14(1)).

Following these steps will align practical behaviour with the instrument’s mandatory procedural prescriptions. The instrument’s text constrains only the described procedures; other elements of the visa application and decision process remain governed by the Migration Act framework and associated instruments.
