Migration (Specification under clause 485.231 – Educational Institutions) Instrument (LIN 23/021) 2023

This instrument, titled Migration (Specification under clause 485.231 - Educational Institutions) Instrument (LIN 23/021) 2023, is a delegated legislative act made under subclause 485.231(2) of Schedule 2 to the Migration Regulations 1994. The operative legal change is narrow and technical: it specifies which Australian education providers count as an “educational institution” for the purpose of subclause 485.231(2) of Schedule 2 to the Migration Regulations. The instrument does this by setting two conjunctive criteria. An Australian university or non‑university education provider is specified as an educational institution for subclause 485.231(2) if:

• it is registered on the Commonwealth Register of Institutions and Courses for Overseas Students established by section 14A of the Education Services for Overseas Students Act 2000; and
• it offers courses at the bachelor’s degree level or above.

Those two requirements appear in the instrument as paragraphs (a)(i) and (a)(ii). The instrument was made by the Minister for Immigration, Citizenship and Multicultural Affairs (Andrew Giles) and is expressed as a specification under the delegated power in subclause 485.231(2). The compilation notes record that the instrument was first registered on 24 March 2023 and commenced on 25 March 2023, and that a later instrument (Migration Legislation Amendment (Graduate Visas No. 2) Instrument (LIN 24/086) 2024) made an amendment to paragraph (a)(ii) (recorded in the endnotes and shown as amending paragraph (a)(ii)). The text included in this compilation is current to the compilation date of 14 December 2024 and includes that amendment.

Mechanically, this instrument does not itself amend the Migration Regulations; it operates as the Minister’s specification under the delegated provision. Its legal effect is to create a clear, statutory gate by reference to an external register (the Commonwealth Register of Institutions and Courses for Overseas Students, commonly known as CRICOS) and by reference to course level (bachelor’s degree level or above). The instrument therefore converts two external facts , CRICOS registration under s 14A of the ESOS Act and the offering of bachelor‑level or higher courses , into the qualification criteria for the status “educational institution” under subclause 485.231(2). Apart from setting those criteria, the instrument contains no operative penalties, procedural steps, or rights; it simply specifies the class of institutions that satisfy that defined term for the referenced subclause.

The instrument uses a small number of tightly framed legal concepts and links those concepts to two external legal references. The core concepts are:

• “Australian university or non‑university education provider”: The instrument addresses these categories as the class of organisations that may be specified as an “educational institution” for the referenced migration subclause. The instrument does not itself define “Australian university” or “non‑university education provider”; the term is used descriptively and the specification operates only if the entity meets the two stated tests. Any statutory definition that applies to those phrases must be sought elsewhere in the Migration Regulations, the Education Services for Overseas Students Act 2000, or other legislation; this instrument does not expand on those definitions.

• Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS): The instrument ties the specification to registration on that register “established by section 14A of the Education Services for Overseas Students Act 2000.” By doing so the instrument imports the administrative gatekeeping role of the ESOS Act/CRICOS regime into the migration context. The CRICOS‑registration criterion is an objective, verifiable fact: an entity is either registered on the Commonwealth Register or it is not. The instrument does not describe or alter how CRICOS operates; it simply makes CRICOS registration a necessary element of the specification.

• “Offers courses at the bachelor’s degree level or above”: The instrument requires course provision at or above bachelor level. The instrument uses the phrase “offers courses at the bachelor’s degree level or above” without elaboration. The phrase is conjunctive with CRICOS registration: both criteria must be met for the entity to be specified as an educational institution for subclause 485.231(2).

• “Specified for subclause 485.231(2)”: The legal status created by the instrument is a specification under a delegated power. The instrument is expressly made under subclause 485.231(2) and thus has its direct legal consequence only in the context of that migration subclause. The instrument does not purport to specify institutions for other parts of the Migration Regulations, nor does it itself alter the text of the Regulations. Its effect is to fix the identity of “educational institution” for that single, referenced subclause.

• Delegated specification mechanism: The text demonstrates a standard delegated‑law mechanism: the Minister uses a power in the Migration Regulations to make a legislative instrument that specifies a class. This transfers the operational determination of the class from general regulation text to a ministerial instrument that can be amended by later instruments (which the endnotes show has already occurred).

This specification instrument affects three principal groups directly, and a cluster of secondary stakeholders indirectly, all as shown by the text.

Primary affected parties

• Australian universities and non‑university education providers: The instrument expressly names these organisations as the class that may be specified as an “educational institution” for subclause 485.231(2). To secure that status an institution must meet both criteria in the instrument: CRICOS registration under s 14A of the ESOS Act and offering courses at bachelor’s degree level or above. For any institution seeking to be treated as an “educational institution” for the operation of subclause 485.231(2), meeting and maintaining those two conditions is therefore determinative.

• The Commonwealth regulator and administrators who manage CRICOS and ESOS regime: Because the specification depends on registration on the Commonwealth Register of Institutions and Courses for Overseas Students, the administrative decisions made under the ESOS Act (registration, conditions attached to registration, cancellation, suspension) will directly affect whether an education provider is specified under subclause 485.231(2). The instrument therefore creates a legal dependency on the outcomes of the ESOS regulatory system; decisions taken there have migration consequences for the class of entities the instrument addresses.

• Persons and entities whose migration rights, obligations or entitlements depend on the definition of “educational institution” in subclause 485.231(2): The instrument operates to specify which institutions are legally recognised under that migration subclause. Any person, lawyer, agent, employer or administrative decision‑maker who relies on an institution’s specified status for the legal operation of subclause 485.231(2) will be affected by whether the institution meets the two criteria. The instrument does not describe those migration consequences; it simply establishes which providers qualify.

Secondary affected parties

• Course providers that are CRICOS registered but offer only sub‑bachelor courses: These providers will not be specified under this instrument because they do not meet the bachelor‑level requirement. They therefore may be excluded from whatever consequences attach to being an “educational institution” under subclause 485.231(2).

• Education providers offering bachelor‑level courses but not registered on CRICOS: These providers likewise will not be specified because CRICOS registration is a conjunctive requirement.

This instrument is principally a definitional specification rather than a duty‑imposing code. The text imposes no positive statutory obligations such as reporting duties, enforcement mechanisms, or direct rights (such as a right to a visa). Its legal operation is to identify which institutions qualify as an “educational institution” for the singular reference in subclause 485.231(2). From that basic operation some practical duties and rights arise indirectly; these are set out below with their textual bases.

What the instrument directly requires (criteria)

• Conjunctive criteria: An Australian university or non‑university education provider will be specified as an educational institution for subclause 485.231(2) only if it satisfies both prongs stated in the instrument: (a)(i) CRICOS registration (the Commonwealth Register under s 14A of the ESOS Act) and (a)(ii) offering courses at bachelor’s degree level or above. The instrument therefore creates a rule that the legal status depends on meeting these two facts. The text is explicit about the conjunctive nature: both (i) and (ii) are required.

Indirect duties and compliance consequences

• Duty to maintain external compliance regimes: Because specification is dependent on CRICOS registration, providers who wish to be specified must comply with the ESOS regime’s registration and ongoing conditions. Although this instrument contains no ESOS requirements itself, it imports the necessity of CRICOS registration by reference. That creates an indirect duty on institutions to maintain their CRICOS registration if they want the migration‑linked specification to continue to apply.

• Duty to provide and evidence course level: The instrument requires that the institution “offers courses at the bachelor’s degree level or above.” In practice this creates an evidential duty: institutions seeking to be treated as specified may need to demonstrate course level through approved accreditation, course descriptors, or entries on CRICOS. The instrument does not describe the form of evidence; it simply makes the factual predicate a legal test.

Rights created or recognised by the instrument

• Recognition right for specified institutions: Where an institution meets the instrument’s criteria it acquires the status of being a specified “educational institution” for the purposes of subclause 485.231(2). The instrument does not set out the legal consequences of that status; those consequences flow from the referenced subclause. The instrument, by specification, gives rise to a legal recognition right: the institution will be taken by operation of the instrument to fall within the class of educational institutions for that migration provision.

The instrument contains no penalty provisions, enforcement powers or specified compliance sanctions. It is a specification instrument that selects a class of entities for the purposes of subclause 485.231(2); it does not itself create an enforcement regime. That absence is explicit in the instrument text: the operative paragraphs quote factual criteria only and make no reference to contraventions, fines, suspensions, offences, or administrative sanctions.

Where enforcement and penalties will arise

• External regulatory regimes: Because the instrument conditions the specification on CRICOS registration (the Commonwealth Register established by s 14A of the Education Services for Overseas Students Act 2000), enforcement action that affects an institution’s CRICOS registration will have consequential effects on whether the institution is specified. Penalties, conditions, suspensions or cancellations imposed under the ESOS Act or its administrative machinery are therefore the proximate enforcement levers that can change an institution’s status under this instrument. The instrument itself does not create or operate those measures; it merely references the register as a gate.

• Migration administration: Any adverse effect on an institution’s status for the purposes of subclause 485.231(2) will be enforced in the migration context by the decision‑makers applying the Migration Regulations. Those decision‑makers will treat the instrument’s specification as determinative of whether a provider is an “educational institution” for the subclause. This is an indirect enforcement pathway: administrative findings under ESOS feed into migration assessments, and migration decision‑makers apply the specification.

Limitations on enforcement within the instrument

• No standalone compliance checklist enforced by immigration authorities: The instrument does not prescribe how migration decision‑makers should verify CRICOS registration or course level in practice, nor does it bind CRICOS administrators to notify immigration authorities. The practical verification process , for example, checking the Commonwealth Register or course documentation , is left to the administering agencies and decision‑makers.

• No penalty provisions for misstatement in the instrument: The instrument does not provide for penalties if an institution or third party misrepresents that an institution is specified. Any sanction for misrepresentation would flow from other legal regimes (consumer protection, migration law, ESOS obligations), not from the specification instrument itself.

The instrument is explicitly drafted to operate by reference to other statutes and instruments. Its legal force depends on those cross‑references and on the delegated legislative power under which it was made. The principal interactions recorded in the text and endnotes are as follows.

Direct statutory cross‑references

• Migration Regulations 1994, Schedule 2, subclause 485.231(2): The instrument is made under subclause 485.231(2). It therefore has legal effect only in relation to that specified migration subclause. The instrument does not amend the Migration Regulations; rather, it is a statutory “specification” that defines what the term “educational institution” means for that subclause. Any legal enquiry about how the specification translates into migration outcomes must therefore consult subclause 485.231(2) itself in addition to this instrument.

• Education Services for Overseas Students Act 2000, section 14A (the Commonwealth Register): The instrument anchors CRICOS registration to the ESOS Act by referencing the Commonwealth Register established under s 14A. That reference imports the existence, procedures and determinations of the ESOS regime as the factual and administrative source for one of the specification criteria. Changes to the ESOS Act, or to the operation of s 14A, will therefore have migration consequences by altering whether a provider appears on the Commonwealth Register.

Interplay with administrative registers and evidence

• Commonwealth Register (CRICOS) functions as an evidential and administrative pivot: Because being “registered on the Commonwealth Register” is an explicit requirement, migration decision‑makers and institutions will rely on CRICOS as the authoritative list. The instrument therefore delegates part of the fact‑finding to the administrative register maintained pursuant to the ESOS Act.

• Course level classification: The instrument requires that an institution “offers courses at the bachelor’s degree level or above”. Course level classification, accreditation and qualification recognition are typically governed by other legislative or regulatory frameworks (course accreditation authorities, tertiary qualification frameworks). The instrument does not itself define “bachelor’s degree level”; thus, the interaction requires cross‑reference to the systems that establish and certify course level. That interaction is implicit in the instrument and will be operationalised by migration decision‑makers and the education regulator(s).

The compilation includes an endnotes section that documents the instrument’s legislative history and subsequent amendments. The entries in the endnotes are the authoritative record within the compiled text and must be read with the main instrument.

Key dates and instruments

• Original instrument: Migration (Specification under clause 485.231 - Educational Institutions) Instrument (LIN 23/021) 2023. Registered 24 March 2023, Number F2023L00340, and commenced 25 March 2023. This is recorded in Endnote 3 (Legislation history).

• Amending instrument: Migration Legislation Amendment (Graduate Visas No. 2) Instrument (LIN 24/086) 2024. Registered 13 December 2024, Number F2024L01677, and commenced 14 December 2024. The endnotes record that this instrument amended paragraph (a)(ii) (Endnote 4: “paragraph (a)(ii) am. F2024L01677”).

Endnote annotations and their effects

• Paragraph (a)(ii) amendment: The compiled law records that paragraph (a)(ii) was amended by F2024L01677 (LIN 24/086). The compiled text appearing in this compilation therefore reflects that amendment as at the compilation date of 14 December 2024. The endnote provides the cross‑reference but not the drafting history of the earlier wording; the compilation shows the present wording: “offers courses at the bachelor’s degree level or above”.

• Paragraph (b) repealed: Endnote 4 includes an entry “paragraph (b) rep. F2023L00340, Legislation Act 2003, s. 48C”. That entry indicates that a paragraph (b) existed in some historical drafting and was subsequently repealed. The compiled text contains only the current paragraph (a) with subparagraphs (i) and (ii); there is no paragraph (b) in the present compilation. The endnote therefore signals that the instrument’s structure has been altered since earlier versions or during legislative revision.

• Commencement references: Endnote 3 includes commencement dates for the original instrument and for the amending instrument. Endnote 4 also records that “commencement rep. Legislation Act 2003. s. 48D”, indicating a repealed reference or editorial change in the compilation process related to commencement wording. Those entries are technical and relate to the instrument’s place in the legislation register and to editorial corrections made under the Legislation Act 2003.

How to read the amendment trail

• The compiled text in this document is current to 14 December 2024 and therefore includes the amendment recorded in the endnotes. To understand changes over time, the endnotes identify which provisions were amended and by which instruments. The key operative amendment recorded is the change to paragraph (a)(ii) effected by LIN 24/086 (F2024L01677), which took effect 14 December 2024.

The compiled instrument and its endnotes do not record any litigation, judicial determinations, appeals, or tribunal decisions that interpret or challenge this specification instrument. The text of the instrument is a short ministerial specification and the endnotes list only registration and amendment information; there are no references to court proceedings, judgments, or merits review decisions within the document.

Implications of the absence of recorded litigation in the compilation

• No source‑named cases: Because the instrument and its endnotes do not name any cases, there are no precedential or interpretive judicial authorities embedded in this compilation that bear on questions such as the meaning of “offers courses”, the temporal reach of CRICOS registration, or the relationship between CRICOS registration and migration entitlements. Any such questions remain to be addressed by administrative practice or future litigation and are not settled within the text of the instrument.

• Practical consequence for advisers: In the absence of recorded litigation, practitioners must rely on the plain terms of the instrument and on the administrative practices of the ESOS and migration decision‑making regimes. Where interpretive questions remain (for example, the evidential standard for “offers courses at the bachelor’s degree level or above”), the compilation provides no judicial guidance and parties will need to seek administrative clarification or await judicial determination if disputes arise.

• Monitoring requirement: Because there is no litigation history in the compilation, stakeholders should monitor administrative decisions and agency statements for any operational guidance or evolving practice. If disputes about the instrument’s application materialise, they are likely to be resolved in administrative review processes or by court proceedings that are not referenced in this compiled instrument.

In short, the compiled instrument contains no litigation history. The instrument’s short, factual operation and its reliance on external administrative registers may reduce immediate litigation pressure, but absence of judicial interpretation means that certain interpretive or evidentiary questions are unresolved in the source.

This instrument is concise, but several practical pitfalls and interpretive hazards arise from its structure and its reliance on external regulatory regimes. Below are concrete “gotchas” that flow from the instrument’s wording and endnotes, grounded in the text.

1. Conjunctive requirement is absolute in the text

• Gotcha: The instrument requires both CRICOS registration and offering bachelor‑level (or higher) courses. Some providers may assume that one of the two is enough (for example, being a recognised university without CRICOS registration), but the instrument’s text is conjunctive: both paragraphs (a)(i) and (a)(ii) must be satisfied. Practitioners should not treat CRICOS registration or course offering as interchangeable or as alternatives.

2. “Offers courses at the bachelor’s degree level or above” is undefined

• Gotcha: The instrument does not define “offers” or “bachelor’s degree level.” That raises questions about whether a single course at bachelor level is sufficient, whether courses delivered by partner institutions count, or how offshore delivery is treated. The instrument leaves those interpretive and evidential questions to the administering agencies and to the ESOS register. Expect disputes or requests for clarifying evidence in the absence of a statutory definition.

3. Reliance on CRICOS means administrative shifts outside migration control can change status

• Gotcha: The instrument imports the CRICOS register as the legal test for one limb of the specification. If the ESOS regulator imposes conditions, suspends or cancels registration, an institution’s status for subclause 485.231(2) will change without any separate migration instrument. Institutions must therefore monitor their ESOS compliance continuously; migration status can be lost through enforcement action in the education regulatory sphere.

4. Amendment volatility

• Gotcha: The endnotes show paragraph (a)(ii) was amended by a later instrument (LIN 24/086). Because specifications are made by ministerial instrument, the criteria can be changed relatively easily. Institutions and advisers must track the instrument itself and its amending instruments; relying on an earlier version can produce incorrect advice or decisions.

5. No procedural route in the instrument for contesting specification

Compliance under this specification instrument is principally about ensuring that the factual predicates in the instrument are satisfied and evidentially demonstrable. The instrument itself requires two facts; compliance steps therefore map to establishing and maintaining those facts and to monitoring changes in the instrument and the external registers it references.

1. Establish CRICOS registration and maintain it

• Action: Ensure the institution is registered on the Commonwealth Register of Institutions and Courses for Overseas Students established under s 14A of the Education Services for Overseas Students Act 2000. Maintain all obligations under the ESOS Act required to keep that registration current, including responding to regulatory conditions, notifications and audits.

• Evidence to retain: Certificate of CRICOS registration, registration entry screenshots or copies from the Commonwealth Register, correspondence with the ESOS regulator, and records of any conditions or notices affecting registration.

• Rationale from instrument: Paragraph (a)(i) requires registration on the Commonwealth Register as a necessary criterion.

2. Offer and document bachelor‑level or higher courses

• Action: Ensure the institution offers at least one course that is at the bachelor’s degree level or above. Confirm how course level is determined under relevant education frameworks and ensure the course is accredited and listed appropriately. Decide and document whether offshore or partner‑delivered courses count, based on regulatory interpretation and evidence.

• Evidence to retain: Course accreditation documents, course descriptors showing level, entries on CRICOS (course listings), marketing materials and internal course approval records, qualification frameworks mapping showing bachelor‑level classification.

• Rationale from instrument: Paragraph (a)(ii) requires that the institution “offers courses at the bachelor’s degree level or above”.

3. Monitor the instrument and its amendments

• Action: Track this specific specification instrument (LIN 23/021) and its amending instruments (for example LIN 24/086). Use the Federal Register of Legislation to watch for amendments, commencements and repeals. Adjust institutional practices if the criteria change.
