Migration (Specification of Language Tests, Test Scores and Passports) Instrument 2025

The instrument operationalises four proficiency tiers that exist in the Migration Regulations. Vocational English (regulation 1.15B) is the lowest tier, generally required for certain temporary skilled visas and some trade occupations. The instrument sets relatively low component scores: for example, IELTS Academic and General Training both require 5 in each component; PTE Academic requires 36 in each component; OET requires B in each component. C1 Advanced is excluded entirely from this level, meaning an applicant cannot use a Cambridge test to claim vocational English. Competent English (regulation 1.15C) is the most commonly required level, used for many skilled migration visas, student visas and temporary graduate visas. The required scores are higher: IELTS 6 in each component, PTE Academic 50 in each component, OET B in each component, and for C1 Advanced a score between 163 and 179 depending on the component. Proficient English (regulation 1.15D) is required for additional points in the points-tested skilled migration system and for some employer-sponsored visas. Scores rise accordingly: IELTS 7 in each component, PTE Academic 65 in each component, OET B in each component, with higher Cambridge scores. Superior English (regulation 1.15EA) is the highest tier, used primarily for maximum points in the skilled migration points test. Scores are: IELTS 8 in each component, PTE Academic 79 in each component, OET A in each component. MET is excluded from this level entirely. The instrument specifies nine different tests across its schedules, though not all tests are available at every level. The tests are: C1 Advanced (the Cambridge Advanced Test), CELPIP General, IELTS Academic, IELTS General Training, LANGUAGECERT Academic, MET (Michigan English Test), OET (Occupational English Test), PTE Academic, and TOEFL iBT. For each test, the instrument sets separate minimum scores for listening, reading, writing and speaking. An applicant must meet all four component minimums in a single test sitting; there is no provision for combining scores across multiple sittings. The passport exemption concept is straightforward: a citizen of Canada, New Zealand, Ireland, the United Kingdom or the United States who holds a valid passport from that country is taken to satisfy the English language requirement at all four levels without needing to sit a test. The instrument does not define what constitutes a valid passport or what happens if a passport expires after lodgement but before decision. These concepts are structurally simple, but the proliferation of tests and the non-uniformity of score scales create significant complexity for applicants. For example, the OET requires a B at vocational, competent and proficient levels, but an A at the superior level, while the other tests require incrementally higher numeric scores at each level. The instrument does not provide a conversion table or guidance on which test is easiest for a given applicant, leaving that to the market. The exclusions of C1 Advanced for vocational and MET for superior are noted but unexplained in the instrument itself.

The instrument directly affects every person who must demonstrate English language proficiency as part of a visa application under the Migration Act on or after 7 August 2025. This includes primary applicants for skilled migration visas (subclasses 189, 190, 489, 491, 494), temporary skilled shortage visas (subclass 482), temporary graduate visas (subclass 485), student visas (subclass 500, where English requirements apply directly or through the assessment level framework), and certain business innovation and investment visas. It also affects secondary applicants who must meet English requirements for certain visa subclasses, such as dependent family members applying for permanent residency. The instrument affects migration agents and lawyers, who must update their practice materials and client advice to reflect the new test menus and score thresholds. It affects employers who sponsor workers under the Temporary Skill Shortage visa, where competent English is generally required unless a specified occupation attracts a lower requirement. It affects educational institutions that offer pathway programs or rely on English test results for admissions decisions that also satisfy visa requirements. It affects the nine test providers whose tests are specified, and their local testing networks. The inclusion of CELPIP General, LANGUAGECERT Academic and MET expands the market for these providers and potentially opens new competition with the incumbent providers (IELTS, PTE Academic, TOEFL iBT). However, it also shifts demand: applicants who previously could use C1 Advanced for vocational English can no longer do so, and those who preferred MET for superior English must choose another test. The passport exemption affects citizens of the five listed countries, who are relieved of the cost, time and uncertainty of sitting a test. But it also creates an implicit discrimination: a citizen of South Africa, India or the Philippines, for example, cannot rely on their passport even if their country uses English as an official or primary language. This is a policy choice embedded in the Regulations rather than the instrument, but the instrument gives it effect by listing only those five countries. The Department of Home Affairs is affected through its processing systems: case officers must verify test results against the new score tables, which differ from the 2015 instrument. Testing organisations must ensure their score reporting aligns with the instrument; any subsequent change to their scoring scales may require a further instrument to maintain recognition. Finally, the instrument affects any person whose visa application was lodged before 7 August 2025 but not yet decided: because section 11 applies the instrument only to applications made on or after commencement, those pending applications remain subject to the 2015 instrument unless they are withdrawn and re-lodged. This creates a bifurcation in processing that may cause confusion for applicants and their representatives.

The instrument imposes a primary duty on applicants: they must produce evidence of English language proficiency in one of two forms, either test results meeting the specified scores or a qualifying passport. The duty is not simply to produce a test result; it is to produce a result from a test approved for the particular level, with scores meeting or exceeding the component minimums set out in Schedule 2. An applicant who achieves a superior English score on IELTS but sits the General Training test cannot use that score for vocational English under the transitional provisions if the test was taken before commencement, because section 10(2) lists only IELTS as a test for vocational English without distinguishing Academic from General Training, while the main body of the instrument specifies IELTS Academic and IELTS General Training as separate tests with the same scores at each level. This creates a potential interpretive issue about whether General Training is recognised under the transitional provisions. The applicant also has the right to choose which approved test to sit, subject to the exclusions. There is no hierarchy among the tests; a score on PTE Academic is as valid as a score on IELTS if it meets the component minimums. However, the instrument does not guarantee that a test score will remain valid for the duration of visa processing; the 36-month validity period is a matter of regulation policy rather than this instrument. The applicant has the right to rely on a test taken before commencement under section 10, provided it was taken within 36 months before the visa application and before 7 August 2025, and the score meets the applicable thresholds. The instrument also creates a right for citizens of Schedule 3 countries to claim the passport exemption. This right is not qualified by residency or citizenship history; it is triggered solely by holding a valid passport from a listed country. An applicant who holds dual citizenship with a listed and a non-listed country may choose which passport to use. For test providers, the instrument confers a benefit: their tests are officially recognised for Australian migration purposes, which likely increases test-taking demand. But it also imposes an expectation that they maintain the integrity and security of their testing processes, because the Department may withdraw recognition at any time through a future instrument. The instrument does not confer a right on test providers to be consulted about score changes or test modifications. The Department retains full discretion to add, remove or modify test recognition through the same legislative instrument process. For employers and educational institutions, the instrument indirectly imposes a duty to verify that a prospective employee or student has met the correct English level for their visa, though enforcement falls to the Department through visa refusal or cancellation rather than direct action against the employer. The instrument does not create any private right of action; an applicant whose visa is refused due to English requirements cannot sue under this instrument. Their remedy is through merits review at the Administrative Review Tribunal.

This instrument itself does not create or impose penalties. It is a specification instrument made under the Migration Regulations, and as such it defines facts that must exist for a visa criterion to be satisfied. The penalty for failing to meet those facts is visa refusal, not a fine or imprisonment. However, non-compliance with the English proficiency requirement leads to enforcement consequences through the Migration Act 1958. If an applicant provides a test result that is fraudulent, or claims a passport exemption with a forged or stolen passport, they may be refused under section 103 of the Act (providing a bogus document) or section 101 (non-compliance with application requirements), and may face a three-year bar on applying for other visas under section 48 of the Act. Criminal penalties under section 234 of the Act (false statements) also apply: a person who makes a false statement in connection with a visa application is liable to imprisonment for up to 12 months. The burden of demonstrating compliance rests with the applicant; the Department does not have a duty to verify test results proactively, though it may check test results against provider databases. The instrument does not specify any audit or compliance role for the test providers, nor does it require providers to report irregularities to the Department. In practice, the Department relies on the market integrity of the testing organisations. A test that is found to have systemic security problems may lose its recognition through a future legislative instrument, but the current instrument contains no early warning or suspension mechanism. Enforcement against migration agents who advise clients incorrectly about which test to use, or who fail to update their knowledge of the new scores, is governed by the Migration Agents Registration Application Scheme under the Migration Act, not this instrument. The practical sting of this instrument is that a visa application that would have been valid under the 2015 instrument may now be invalid, leading to refusal and loss of application fees. An applicant who sits C1 Advanced for vocational English after 7 August 2025 and submits that result will be refused, because C1 Advanced is excluded from that level. An applicant who sits MET for superior English after commencement will also be refused. The instrument does not provide waivers, discretion to accept equivalent scores, or a mechanism for the Minister to overlook non-compliance. Enforcement is rule-based and categorical. The only margin lies in the transitional provisions, which preserve certain pre-commencement test results for applicants who apply on or after 7 August 2025. Even there, enforcement is strict: the test must have been taken within 36 months before the application, and the score must meet the specified thresholds in section 10. Scores that exceed the old thresholds but fall below the new ones (for tests taken before commencement) are protected only if they meet the old thresholds, because section 10 cross-references the old test and score specifications, not the new ones in Schedule 2.

This instrument operates entirely under the Migration Act 1958 and the Migration Regulations 1994. It is a legislative instrument made under specific regulation-making powers: paragraphs 1.15B(1)(a) and (c), subregulation 1.15B(2), paragraphs 1.15C(1)(a) and (c), subregulation 1.15C(2), paragraphs 1.15D(a) and (c), and paragraphs 1.15EA(a) and (c). These are the provisions that define the four English proficiency levels and authorise the Minister to specify by legislative instrument what tests, scores and passports count. The instrument therefore holds the same legal status as the Regulations it supports. It does not purport to override the Act, nor can it extend beyond the scope of the enabling provisions. If a visa subclass requires English at a different standard not covered by the four levels, this instrument does not apply. For example, the English requirement for a student visa may be set by a separate legislative instrument under the Migration Regulations or by a direction from the Minister under section 496 of the Act; this instrument does not address student visa English requirements except to the extent that a student visa criterion incorporates one of the four defined levels. The instrument repeals the 2015 specification IMMI 15/005 in its entirety. This means any previous recognition of tests, scores or passports under that instrument ceases from 7 August 2025. However, the repeal does not retroactively invalidate visa applications made before commencement; those remain governed by the 2015 instrument through standard transitional interpretation rules. The instrument interacts with the Migration Regulations as a whole: any visa criterion that uses the terms vocational English, competent English, proficient English or superior English now points to this instrument's specifications. This includes criteria in regulations 1.15B, 1.15C, 1.15D, 1.15EA themselves, as well as criteria in individual visa subclasses that incorporate these terms by reference, such as subregulation 482.222 (English language requirement for Temporary Skill Shortage visa) and subregulation 485.212 (English requirement for Temporary Graduate visa). The instrument does not interact with the education standards set by the Australian Skills Quality Authority or Tertiary Education Quality and Standards Agency, though those agencies may have their own English requirements for enrolment that overlap with migration requirements. The instrument also does not interact with the Australian Citizenship Act 2007, which has its own English language requirements for citizenship that are separate from the migration framework. There is no cross-reference to the Privacy Act 1988 or the Freedom of Information Act 1982; test results are handled as part of the visa application process under standard Departmental data management practices. The instrument pre-empts any inconsistent state or territory laws regarding English testing for visa purposes, but only because migration is a Commonwealth head of power; the instrument itself contains no express inconsistency clause.

This instrument is new. It has no amendment history. It commences on 7 August 2025 and repeals the whole of the Migration Regulations 1994 - Specification of Language Tests, Score and Passports 2015 (IMMI 15/005). The 2015 instrument itself had been in force for approximately ten years and had not been publicly amended or replaced before now. The fact that the replacement was made by a new instrument rather than an amending instrument means the entire specification has been redrafted, not simply updated. This is significant because it signals a practical rather than a purely technical change. The new instrument expands the list of approved tests from the five or six that were recognised under the 2015 instrument to nine, with the addition of CELPIP General, LANGUAGECERT Academic and MET to the active list for at least some levels. It also specifies separate score tables for each level, which may differ from the scores that were implicitly required under the 2015 instrument (the former instrument is not provided in the source, so direct comparison is not possible here). The exclusion of C1 Advanced from vocational English and MET from superior English are new features that are not self-explanatory from the source; they likely reflect updated departmental analysis of test comparability or concerns about test security. The transitional provisions in section 10 are also new; the 2015 instrument may have had its own transitional arrangements that are now superseded. Because the instrument is a Commonwealth legislative instrument registered on the Federal Register of Legislation, any future amendment will be published as a separate amending instrument. The instrument does not contain a sunset clause, so it will remain in force until repealed or replaced. Given the rate of change in English language testing (new test versions, score scale revisions, provider changes), a ten-year lifecycle similar to the 2015 instrument is plausible, though the Department could amend sooner if a test becomes unavailable or security concerns arise. Users should monitor the Federal Register of Legislation for amending instruments that add extra tests, remove tests, or adjust scores. There is no requirement in the instrument for the Minister to publish reasons for any future changes.

This instrument commenced on 7 August 2025, and at the time of this deep dive there is no publicly available litigation history specific to it. However, the predecessor instrument IMMI 15/005 generated some case law in the migration jurisdiction, principally in the Federal Circuit and Family Court of Australia and the Administrative Appeals Tribunal (now the Administrative Review Tribunal). These cases typically involved disputes about whether an applicant met the English language requirement under the Regulations, and turned on the interpretation of the instrument in force at the date of application. Common issues included: whether a test taken before the instrument's commencement could be used for an application made after commencement (transitional issues), whether the applicant had achieved the required score in a single test sitting, whether the test provider's score report was admissible evidence, and whether a passport had ceased to be valid before the application was decided. For example, in certain Tribunal decisions under the 2015 instrument, applicants argued that a test score from a non-specified test should be treated as equivalent to a specified test score; the Tribunal consistently held that the instrument was exhaustive and no equivalence could be implied. The new instrument reinforces that approach by specifying tests and scores exclusively. The instrument's exclusion of C1 Advanced from vocational English and MET from superior English is likely to generate fresh litigation if applicants argue that these exclusions are beyond the scope of the enabling regulation powers, or that they amount to an unreasonable exercise of delegated legislation power. However, the courts have historically given the Minister broad discretion in specifying tests and scores, and successful challenges to such instruments are rare. Another likely litigation risk concerns the transitional provisions in section 10. The drafting in subsections (4) and (6) uses the phrase the person achieve one of the specified test scores, which appears to be a grammatical error (it should be achieved). While minor, such errors could be used in argument to create ambiguity about what the transitional provisions require. Applicants may also challenge refusals on the basis that a test taken before 7 August 2025 but within the previous 36 months should be recognised even if the test is not listed in section 10(2) or (4). The instrument's list of recognised transitional tests is narrower than Schedule 2 for current applications, omitting CELPIP General, LANGUAGECERT Academic and MET entirely from the transitional list. A holder of a pre-commencement CELPIP General test score may argue that it is not excluded from vocational English because the instrument says C1 Advanced is excluded but is silent on transitional exclusion of other tests. Litigation on points such as these is likely within the first 12 to 24 months of the instrument's operation. No High Court of Australia authority directly on this instrument exists. Existing High Court authority on the construction of legislative instruments under the Migration Act supports a strict textual approach, which favours the Department's interpretation where the text is clear.

Several traps exist in this instrument that may catch out unwary applicants and their representatives. First, the exclusion of C1 Advanced for vocational English is categorical and applies to all applications made on or after 7 August 2025. An applicant who previously used Cambridge for vocational English under the 2015 instrument cannot simply resit and use that test for a new application. They must switch to one of the other eight approved tests. Second, the exclusion of MET for superior English means that a person who prefers MET because they find it easier will hit a ceiling at the proficient level. If they need superior English for the maximum points test, they must sit a different test. Third, the transitional provisions in section 10 only recognise five test types (IELTS, OET, TOEFL iBT, PTE Academic, C1 Advanced) for tests taken before commencement. A person who sat CELPIP General or LANGUAGECERT Academic before 7 August 2025 and wants to rely on that result for a visa application lodged after commencement will find that result is not covered. The transitional list is narrower than the current list, and this discrepancy may not be obvious at first read. Fourth, the instrument requires component minimum scores but does not specify whether the scores must be achieved in a single test sitting or whether the Department will accept a test report that shows the required score in each component across two sittings. The ordinary reading, and the practice under the 2015 instrument, is that all four component scores must be from a single test. An applicant who achieves an IELTS listening score of 6 in one sitting and an IELTS reading score of 6 in a later sitting cannot combine them. Fifth, the scores in the Schedule 2 table are not directly comparable between tests. For example, the OET requires a B at three levels (vocational, competent, proficient) but an A at superior, while IELTS requires 5, 6, 7 and 8 respectively. An applicant who switches from OET to IELTS may need a qualitatively different preparation strategy, and the instrument provides no guidance on equivalence. Sixth, the passport exemption requires the applicant to hold a valid passport from one of the five listed countries. A passport that expires before the visa is granted is likely to cause the exemption to cease, because the instrument says the applicant is a citizen of and holds a valid passport issued by a specified country. Both conditions must be met at the time of decision, not just at lodgement. Seventh, the instrument does not address the situation where an applicant sits a test after commencement but the test provider later adjusts its score scale. If the scale changes, a score of 50 on PTE Academic may no longer correspond to the same proficiency level, but the instrument fixes the numeric score, not the common European framework or equivalent. A rigid numeric approach creates a risk of misalignment over time. Finally, the application provision in section 11 states that the instrument applies to a visa application made on or after commencement, but it does not address the situation where an applicant withdraws an application made before commencement and re-lodges after commencement. The re-lodgement will be caught by the new instrument, so the applicant must ensure their English evidence complies, even if they have a valid test result under the old instrument.

Compliance with this instrument requires a structured approach that begins before the visa application is lodged. The first step is to identify which English proficiency level applies to the intended visa subclass. The four levels vocational, competent, proficient and superior are not interchangeable; each is tied to specific visa criteria. A skilled independent visa applicant who needs 20 points for superior English must meet the scores in item 4 of Schedule 2 or hold a qualifying passport, not merely the competent English scores. Check the relevant visa regulation: if it says the applicant has vocational English, use the scores in item 1 (and exclude C1 Advanced); if competent, use item 2; if proficient, use item 3; if superior, use item 4 (and exclude MET). Step two is to decide whether to sit a test or rely on a passport. If the applicant holds a valid passport from Canada, New Zealand, Ireland, the United Kingdom or the United States, no test is required. They must provide the passport with the application and ensure it remains valid until the visa is decided. If relying on a test, step three is to choose a test that is approved for the required level and that the applicant can realistically sit within the visa timeline. The instrument does not rank tests by difficulty, but the scores vary: for competent English, IELTS requires 6 in each component; OET requires B in each component; PTE Academic requires 50 in each component; C1 Advanced requires 163-179 depending on component. An applicant with strong reading and writing but weaker speaking might choose a test where speaking scores are historically easier. There is no prohibition on sitting multiple tests; an applicant could sit both IELTS and PTE Academic and submit the better result. Step four is to prepare and sit the test, ensuring the test result clearly shows the component scores. The result may be valid for up to 36 months, but the instrument requires the result to be achieved before the visa application is made. It does not allow a test result to be obtained from a test centre after the application is lodged. Step five is to include the test result or passport details with the visa application. The instrument does not mandate a specific form of evidence, but the Department generally requires a certified copy of the test report or the passport biodata page. Step six is to verify that the scores match the Schedule 2 table exactly. If the test report shows an overall band score but not the component scores, the application will be invalid. Some tests (e.g., OET) report a grade such as B or A rather than a numeric score; the instrument accepts these. Step seven is to be aware of the transitional provisions. If the test was taken before 7 August 2025, check that it is one of the tests listed in section 10 (IELTS, OET, TOEFL iBT, PTE Academic, C1 Advanced) and that it was taken within 36 months before the visa application. If it was taken after 7 August 2025, the full Schedule 2 applies. Step eight is to monitor for any amending instrument that adds, removes or modifies tests or scores after 7 August 2025. The Department does not typically notify applicants directly; checking the Federal Register of Legislation before lodgement is prudent. Finally, for migration agents and lawyers, compliance means updating client intake procedures, re-training staff on the new test menus and score thresholds, and reviewing any standard letters or checklists that reference the 2015 instrument. Non-compliance by an agent is not penalised under this instrument but may lead to professional sanctions or civil liability if a client is refused a visa as a result of relying on outdated advice. The practical economic cost of compliance includes test fees (typically $300 to $500 AUD per test), preparation costs, the opportunity cost of time spent studying and sitting the test, and the risk of failure and re-sitting. For an applicant with a strong English background, the passport exemption provides a zero-cost compliance pathway, but it is available only to citizens of five countries. For everyone else, the instrument imposes a direct private cost that must be factored into the migration budget.
