Plain English Summary

2/10 complexity

This instrument specifies which international agreements do not count as 'relevant agreements' for the Government Agreement Visa (Subclass 406).

What it does: The Government Agreement Visa is designed for specific government-to-government arrangements. This document carves out exceptions, ensuring that common bilateral agreements are excluded from this visa category, even though they involve government arrangements.

Specifically excluded are agreements for:

Working Holiday visas (Subclass 417) and Work and Holiday visas (Subclass 462)
Seasonal Labour Mobility Scheme (Pacific seasonal worker programs)
Full-time study arrangements
New Zealand citizen entry facilitation
Bilateral adoption arrangements (as defined in the Regulations)

Why it matters: This prevents confusion between visa streams. It ensures that someone coming to Australia under a working holiday treaty or to study uses the appropriate specific visa, rather than accidentally qualifying for the Government Agreement Visa, which is intended for different types of official exchanges.
