52 Refunds

(1) A service agreement must include a refund policy in relation to fees and disbursements. (2) The refund policy must be fair and reasonable. (3) A responsible migration agent in relation to a service agreement must ensure that: (a) sufficient funds are available to cover any refunds that become payable under the agreement; and (b) any refunds payable under the agreement are paid: (i) in accordance with the agreement; and (ii) promptly and, in any case, no later than 14 days after they become payable.
