What it does
This instrument, the Migration (LIN 19/214: Regional Certifying Bodies) Instrument 2019 (LIN 19/214), designates specific organisations as Regional Certifying Bodies for the purposes of paragraph 2.72C(19)(a) of the Migration Regulations 1994 (the Regulations) (see s 3 and s 4(1)). It lists, by state and territory, the named bodies that are specified as Regional Certifying Bodies (s 4(3)). The instrument also allocates each listed body responsibility for a part of Australia that is a designated regional area listed in an instrument in writing made under the Regulations (s 4(2)). The instrument is made by the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs and is dated 8 November 2019 (cover sheet and s 1). It commences at the same time as Schedule 2 to the Migration Amendment (New Skilled Regional Visas) Regulations 2019 (s 2).
The instrument operates only in relation to certain applications connected with the Subclass 494 (Skilled Employer Sponsored Regional (Provisional)) visa. Specifically, it applies to: (a) an application for approval of a nomination for a Subclass 494 visa made on or after 16 November 2019; and (b) an application for a Subclass 494 visa made on or after 16 November 2019 where the related application for approval of a nomination is made on or after that date (s 5(1)-(2)). Mechanically, the instrument does not create new standalone statutory powers or penalties; rather it amends who is specified as a Regional Certifying Body for the particular regulatory provision cited (s 3; s 4).
In short, LIN 19/214 is a specifying instrument that fixes the list of organisations that the Regulations will treat as Regional Certifying Bodies for the stated regulatory purpose, links each listed body to responsibility for a designated regional area as set out elsewhere under the Regulations, and limits its application to nomination and visa applications tied to the Subclass 494 pathway on or after the specified date.
