Plain English Summary

1/10 complexity

This proclamation brings Schedule 1 of the Migration Legislation Amendment (Judicial Review) Act 2001 into force on 2 October 2001, implementing amendments that narrow courts’ ability to review immigration and ministerial decisions.

It directly affects asylum seekers, visa challengers, their lawyers, and federal/high court judges by limiting judicial oversight of migration decisions—a significant shift reducing the judiciary’s role as a check on executive power in immigration matters.
