What it does
This instrument, cited as IMMI 18/015, specifies the English-language testing requirements and classes of exemption for applicants for a Subclass 500 (Student) visa under the Migration Regulations 1994. It is made under the delegated authority of subclause 500.213(3) of Schedule 2 to the Regulations (s 3). Mechanically it does three things.
First, it prescribes the primary criteria that a non-exempt Subclass 500 applicant must satisfy in order to meet the English-language requirement in subclause 500.213(1) of Schedule 2 to the Regulations. Those criteria are: undertake one of the English language tests listed in Column 1 of Schedule 1; achieve the minimum test score specified in Column 3 for that test; and have completed the test within a specified two year period tied to either the application lodgement date (if test evidence is included with the application) or the decision date (if test evidence is provided later) (s 6(1)(a)-(c)).
Second, it enumerates classes of applicants to whom the subclause 500.213(1) requirement does not apply (that is, classes exempted for the purpose of subclause 500.213(2)). The exemptions are specified categories of passport holders (United Kingdom, United States of America, Canada, New Zealand, Republic of Ireland); applicants enrolled in certain courses (courses registered to be delivered in a language other than English, registered ELICOS courses, registered school courses, registered post‑graduate research courses); certain named student statuses (Foreign Affairs student, Defence student, Secondary exchange student); applicants who in the two years prior to application have successfully completed specified Australian studies undertaken in English (Senior Secondary Certificate of Education, or a substantial component of an AQF Certificate IV or higher while holding a student visa); and applicants who have completed a minimum of five years of study in English in a listed set of countries (Australia, Canada, New Zealand, South Africa, Republic of Ireland, United Kingdom, United States of America) (s 6(2)).
