What it does
This instrument, Migration (IMMI 18/002: Eligible Passports) Instrument 2018, is an administrative determination by the Secretary of the Department of Home Affairs under section 175A of the Migration Act 1958 (the Act), dated 24 August 2018 (see s 1, s 3 and the instrument heading). Its operative effect is to set a universal starting rule and a closed list of exceptions for the meaning of the expression "eligible passport" as used in section 165 of the Act (see s 6). Mechanically, s 6 declares that "for the purposes of the definition of ‘eligible passport’ in section 165 of the Act, all valid passports are ‘eligible passports’ with the exception of the following specified travel documents" and then disqualifies two categories: (1) travel documents with certain characteristics set out in Schedule 1, and (2) travel documents specified individually in Schedule 2.
The instrument commences on the day after registration on the Federal Register of Legislation (s 2). It also includes an explicit repeal of the predecessor instrument IMMI 14/079 (Eligible Passports Instrument 2014) in Schedule 3, which repeals that instrument in full (Schedule 3, item 1). The preliminary provisions define the Act as the Migration Act 1958 (s 4), and provide that each instrument specified in a Schedule is amended or repealed as set out; other items in the Schedules have effect according to their terms (s 5).
In summary, the instrument delivers a bright-line administrative definition: every valid passport will be treated as an 'eligible passport' for s 165 unless it is captured by Schedule 1 (characteristics) or Schedule 2 (a specified list). The Secretary is the declarant under the statutory authority. The instrument contains no separate offence or penalty provisions; it is a determinative instrument designed to be applied when construing or operating section 165 of the Act (see s 6 read with s 3).
