What it does
This instrument, titled the Migration (IMMI 17/053: Specification of Transit Passengers Having Prescribed Status - Special Purpose Visas) Instrument 2017, specifies which classes of transit passengers are to be treated as falling within paragraph 2.40(1)(n) of Part 2 of the Migration Regulations 1994 (the Regulations). The instrument was made by the Minister for Immigration and Border Protection, dated 23 August 2017 (header), and is expressly made under paragraph 2.40(1)(n) of Part 2 of the Regulations (s 3). It takes effect the day after it is registered on the Federal Register of Legislation (s 2).
Mechanically, the instrument does three things:
- It sets the instrument name and citation (s 1).
- It defines the legal authority and relevant definition of "Regulations" as meaning the Migration Regulations 1994 (ss 3-4).
- It specifies, in section 6, the classes of transit passengers who are to be captured for the purposes of paragraph 2.40(1)(n) of the Regulations. Those classes are (a) citizens of a listed set of foreign countries (a table of countries is contained in s 6); (b) residents of Hong Kong holding Hong Kong Special Administrative Region (HKSAR) passports or British National Overseas (BNO) passports; (c) residents of Taiwan holding a passport issued by Taiwan (with the explicit exclusion of passports purported to be official or diplomatic passports); (d) official passport holders from India; and (e) diplomatic passport holders generally, but with express exclusions for holders of Arab Non-National Passports and holders of diplomatic passports from a specified list of countries (s 6). The instrument also repeals a prior specification instrument, Specification of Transit Passengers Who are eligible for a Special Purpose Visa 2015 (IMMI 15/057), in its entirety (Schedule 1).
