What it does
This instrument, titled Migration (IMMI 17/030: Subclass 602 (Medical Treatment) Visa - Approved Form) Instrument 2017 (IMMI 17/030), prescribes a single, specific documentary requirement for the Subclass 602 (Medical Treatment) Visa application process. Clauses 1-4 establish the instrument’s identity, commencement date and authority. Clause 1 gives the instrument its name and citation (IMMI 17/030). Clause 2 sets commencement as 1 July 2017. Clause 3 records the statutory authority for making the instrument as subclause 1214A(3A) of Schedule 1 to the Regulations (the Migration Regulations 1994), and clause 4 defines the shorthand Regulations to mean the Migration Regulations 1994.
The operative provision is clause 5 in Part 2. It declares that, for the purposes of paragraph 1214A(3)(e) of Schedule 1 to the Regulations, the specified documentation that must accompany an application is Form 1507 , Evidence of Intended Medical Treatment (includes consultation) which has been completed and signed by a registered medical practitioner. The instrument therefore performs a narrow, mechanical function: it identifies one approved form (Form 1507) and specifies the condition that the form must be both completed and signed by a registered medical practitioner.
The instrument does not itself set visa grant criteria, specify how a completed form must be presented to the Department of Immigration and Border Protection, nor define “registered medical practitioner”. Its text confines the change to the substitution or prescription of the form and the requirement that the form be completed and signed, and it records the Minister (Peter Dutton) as the maker and the date of signing (29 June 2017). The instrument’s legal effect is to supply the content required by paragraph 1214A(3)(e) of Schedule 1 to the Regulations by reference to a particular, named form (Form 1507) and to require a practising clinician’s signature on that form, as the specified documentation.
