What it does
This instrument, Migration (Health Criteria,Specified Countries) (LIN 23/071) Specification 2023, performs three narrow mechanical actions as stated in its text. First, the Minister for Immigration, Citizenship and Multicultural Affairs, Andrew Giles, “specif[ies] the countries mentioned in Schedule 1 to this instrument for the purposes of paragraph 2.25A(1)(b) of the Migration Regulations” (opening recital). Second, the instrument repeals an earlier specification, identified as “Migration Regulations 1994 - Specification of Countries - IMMI 13/161” (opening recital, subparagraph (b)). Third, the instrument sets its commencement timing: “This instrument commences on the day after registration” (opening recital).
The operative content is therefore the schedule of place-names in Schedule 1 and the repeal of the prior specification. The schedule is an alphabetised list of named countries, territories and place-name entries (Schedule 1). The instrument contains no separate operative definitions, conditions, transitional provisions, fees, penalties or implementation schedule beyond those three statements. The instrument is dated 21 December 2023 and signed by the Minister, Andrew Giles (dated signature block). The only statutory hook the instrument invokes is paragraph 2.25A(1)(b) of the Migration Regulations 1994; the instrument does not reproduce or restate the text of that provision.
Practically, the instrument replaces the previous IMMI 13/161 specification with the Schedule 1 list and takes legal effect the day after it is registered. For any decision, assessment or administrative step that depends on the list of countries “for the purposes of paragraph 2.25A(1)(b) of the Migration Regulations”, this instrument supplies the authoritative list from the time of commencement. The instrument itself does not set out how a person’s connection to a listed country (for example, nationality, citizenship, place of birth, or residence) is to be determined; it only supplies the names that are “specified” for the purpose identified.
