What it does
This legislative instrument (LIN 22/022) specifies, by postcode, which parts of Australia count as particular regional categories for the limited purposes identified in the Migration Regulations 1994 and specified provisions of Schedule 2 to those Regulations. The instrument is made by the Minister for Immigration under identified provisions of the Regulations and takes effect on 5 March 2022 (sections headed “LIN 22/022”, “Dated 17 February 2022”, and 2). It operates by declaring that parts of Australia falling within listed postcodes are either (a) “a specified designated city or major regional centre” for the purposes of subregulation 1.15M(1) of the Regulations (section 3(1)); or (b) “a specified regional centre or other regional area” for the purposes of subregulation 1.15M(2) (section 3(2)). Section 3(3) then specifies that the postcode lists are to be treated as the designated parts for the definition of “regional Australia” in subregulation 5.19(16) and for two Schedule 2 provisions, subparagraph 888.226(2)(c)(i) and paragraph 892.213(3)(b).
Operationally, the instrument attaches postcode-based geographic definitions to discrete regulatory hooks: the subregulation 1.15M categories, the definition of regional Australia in subreg 5.19(16), and the cited Schedule 2 provisions. Section 4 makes clear the timing rule: the instrument applies to nominations, applications, assessments and grants that occur after the instrument’s commencement. The instrument expressly repeals the earlier Migration (Regional Areas) Instrument (LIN 20/292) 2020 (section 5), so the postcode definitions in LIN 20/292 are supplanted from the commencement date.
Mechanically, the instrument is concise and technical. Its operative content is the two postcode tables in section 3(1) and 3(2) which map discrete postcode ranges and individual postcodes by State or Territory into the two named categories. The instrument does not itself create visa entitlements, conditions, or duties beyond identifying which geographic units are to be treated as regional for the listed regulatory provisions. Those substantive effects flow from the Regulations and the Migration Act provisions to which the instrument refers. The instrument therefore functions as an administrative specification that changes which addresses (by postcode) will be treated as regional for the specified regulatory tests from 5 March 2022 onwards.
