Migration (Arrangements for subclass 417 visa applications) Instrument (LIN 22/051) 2022

Working holiday eligible passport is defined in section 6 as a valid passport held by an applicant who meets the passport criteria in section 5(1) - that is, a passport issued by a country or region in Schedule 1 and satisfying the conditions in that Schedule. The requirement of validity means the passport must be current, not expired. The note to section 6 makes clear that a passport from a non-listed country cannot be a working holiday eligible passport.

Younger age is a term used by the Regulations that the instrument fills in. For each country or region with a number in that column (e.g., “30” for Belgium, Estonia, Japan, Taiwan), the instrument specifies that as the younger age. The effect is that applicants holding passports from those countries must be under that age plus one (i.e., under 31 if the younger age is 30). For countries with a dash, no younger age is specified; the default in the Regulations applies, which is also 30. The concept sits within the broader age requirement in regulation 417.211(2): applicants must not have turned the general age limit (30) or any younger age specified by instrument. The instrument therefore does not vary the substantive age limit; it merely formalises it uniformly.

ImmiAccount is defined as “the interactive portal for online services available through the Department’s website at https://immi.homeaffairs.gov.au.” It is the mandatory platform for most applications. The term is not used elsewhere in the instrument beyond the definition and the application requirement.

Written notice means an email from the Department authorising an applicant to submit Form 1150 to the email address WHM.invited.applications@homeaffairs.gov.au. This is the only way to bypass the ImmiAccount requirement. The notice is not a blanket authorisation; it is issued at the Department’s discretion, and the applicant must attach it to the application and submit within seven calendar days (measured in AEST or AEDST, depending on the date the notice was sent). This creates a limited, time-sensitive alternative channel.

Form 1150 is prescribed as the approved form for subclass 417 applications. Under section 5(2), the form must be completed “(Internet)” in ImmiAccount. For the email exception, it must be the same form attached to the email.

Subitem 1225(3) of Schedule 1 to the Regulations is the enabling provision that allows the Minister to specify, by legislative instrument, the form, place and manner of making a subclass 417 application. The instrument exercises that power directly in section 5.

Paragraph 417.211(2)(a) and (b)(ii) of Schedule 2 to the Regulations are the criteria for a working holiday eligible passport and the age requirement. The instrument specifies the passport and younger age for those criteria.

The primary affected group is individuals aged 18 to 30 who hold a passport from one of the 19 countries or regions listed in Schedule 1 and wish to apply for a Working Holiday (Subclass 417) visa. This includes citizens of Belgium, Canada, Cyprus, Denmark, Estonia, Finland, France, Germany, Hong Kong SAR, Ireland, Italy, Japan, Malta, Netherlands, Norway, Republic of Korea, Sweden, Taiwan, and the United Kingdom. These applicants must comply with the instrument’s application method and passport conditions. The instrument does not affect applicants from non listed countries, who cannot apply for a subclass 417 visa at all (they must instead apply for the separate subclass 462 Work and Holiday visa, which has its own instrument).

Employers in industries that rely on working holiday makers - agriculture, hospitality, tourism, seasonal work - are indirectly affected. The instrument’s procedural requirements influence the speed and ease of visa processing, which in turn affects labour supply. The mandatory online application channel, while reducing paper handling, may create barriers for applicants with limited internet access or digital literacy. The email fallback, being discretionary and subject to a tight seven-day window, offers little relief for systemic issues. An applicant who cannot access ImmiAccount and does not receive a written notice cannot apply at all. This concentrates risk on the Department’s willingness to issue such notices, which is not specified in the instrument.

Migration agents and lawyers assisting applicants must ensure applications are lodged through the correct channel. The instrument removes any paper or in person lodgement option. The Department of Home Affairs itself is affected as it must maintain ImmiAccount, process internet applications, and manage the email invitation system. The instrument imposes a compliance burden on the Department to issue written notices consistently and to handle the email inbox.

The travel and education sectors also see indirect effects: the instrument’s passport and age requirements define the pool of potential working holiday makers, which can influence demand for flights, accommodation, and short term study. Because the instrument does not alter younger ages for any country (all remain 30 or default), the age limit is uniform, so no country receives preferential age treatment.

Applicants’ duties: The primary duty is to apply using the correct method. Section 5(2) requires that the application be made using Form 1150 (Internet) in ImmiAccount as an Internet application. An applicant who cannot use ImmiAccount must obtain a written notice from the Department before applying by email. The applicant must attach that written notice to the email application and submit it within seven calendar days after the notice was sent (section 5(3)). The time zone for calculating the seven days is AEST or AEDST, whichever applies on the date the notice was sent. The applicant also must hold a passport that meets the conditions in Schedule 1 (section 5(1)). If the applicant is in Australia and their eligible passport has expired after entry, they may still apply provided they held a qualifying passport when they entered.

Applicants’ rights: The instrument does not confer a right to a visa; it only specifies how an application may be made. However, an applicant who complies with the prescribed method has the right to have their application considered under the Regulations. There is no right to use the email channel; that is solely at the Department’s invitation. An applicant who is not invited and cannot use ImmiAccount effectively has no available lodgement method, meaning the instrument can functionally bar an otherwise eligible person from applying.

Department’s duties: The Department must accept applications made in the prescribed manner. It must also maintain the ImmiAccount system and the email address for invited applications. The instrument does not impose a duty to issue written notices; the Department has discretion. If it chooses not to invite an applicant who cannot access ImmiAccount, the applicant cannot apply. This creates a potential gap for applicants with disabilities, no internet access, or technical failures.

Rights of appeal: The instrument itself does not provide appeal mechanisms. A decision to refuse a visa application on the basis of non compliance with the instrument (e.g., using the wrong method) would be a reviewable decision under the Migration Act, but the instrument sets the standard.

Passport conditions: For each country in Schedule 1, the passport must satisfy the listed condition. For example, for Belgium the passport must indicate the applicant is a Belgian national; for Taiwan it must not be official or diplomatic; for UK it must indicate British Citizen or British National (Overseas). These are objective criteria.

The instrument does not create its own penalties or enforcement mechanisms. It is a procedural instrument made under the Migration Regulations, and its requirements are enforced through the visa decision making process. If an application is not made in the prescribed manner (e.g., if an applicant uses the email channel without a written notice, or fails to attach the notice, or misses the seven-day deadline), the application may be invalid. An invalid application cannot be considered, and the visa cannot be granted. This is a de facto penalty: the applicant loses the chance to obtain a visa.

Similarly, if an applicant makes a false statement about their passport nationality or age, the visa may be refused under the general application requirements of the Migration Act, and the applicant may be subject to the public interest criterion PIC 4020 (fraud) which can lead to a three year ban on further visa applications. The instrument does not address these consequences; they arise from the broader legislative framework.

The instrument’s prescription of method is mandatory. There is no provision for waiver or cure. A technical failure (e.g., ImmiAccount crash, email bounce) is not addressed. The High Court or Federal Court could potentially hold that the instrument is ultra vires if it unreasonably restricts access to the visa, but that would be a challenge to the instrument itself, not an enforcement action.

Because the instrument is legislative, it is subject to disallowance by Parliament, though that is a political check, not a penalty. The Department’s internal compliance would focus on whether processing officers accept applications that deviate from the instrument. Officers must reject any application not made in the prescribed manner. This imposes a bureaucratic burden but no monetary penalty.

In terms of enforcement against the Department, an aggrieved applicant could seek judicial review of a decision to refuse an application on the ground that the instrument was not complied with, but only if that decision was legally unreasonable or procedurally unfair. The instrument itself is not enforced against the Department.

The instrument sits entirely within the framework of the Migration Act 1958 and the Migration Regulations 1994. It is made under subitem 1225(3) and paragraphs 417.211(2)(a) and (b)(ii) of the Regulations. These enabling provisions are themselves made under sections 31, 45 and 46 of the Migration Act, which empower the Minister to prescribe visa subclasses and criteria.

The instrument interacts with several other instruments and provisions:

Regulation 2.10C is noted in section 5(2) as providing for the time of making an Internet application. The instrument relies on that regulation to deem when an ImmiAccount application is considered lodged. It does not modify that regulation.

Schedule 1, item 1225 of the Regulations sets out the general requirements for subclass 417 applications, including fee and specific criteria. The instrument specifies the form and manner for that item, so it must be read together with item 1225.

Schedule 2, clause 417.211 of the Regulations contains the age and passport criteria at the time of application. The instrument defines “working holiday eligible passport” and “younger age” in those criteria. If the instrument is invalid or amended, the criteria change accordingly.

Other legislative instruments may apply to subclass 417, such as instruments specifying visa conditions (e.g., work limitations) or fees. Those remain separate. The instrument does not affect those.

The Legislation Act 2003 governs the registration, tabling and disallowance of this instrument. Sections 48C and 48D of that Act caused the repeal of sections 2 and 4 of the original instrument (commencement and repeal provisions) as noted in the amendment table. This interaction is purely procedural.

The Migration Act 1958 provisions on review (Part 5, Division 2) allow for merits review of visa refusal decisions. The instrument’s requirements are relevant to whether the application was valid, which is jurisdictional. The Administrative Appeals Tribunal or the Federal Circuit and Family Court may need to interpret the instrument to determine if the applicant complied.

State and territory laws are not directly affected, though working holiday makers are subject to workplace laws, tax laws, and occupational licensing. The instrument does not interact with those.

The instrument was originally made on 24 June 2022, registered as F2022L00830, and commenced on 1 July 2022. It was amended once, by the Migration (Arrangements for subclass 417 visa applications) Amendment Instrument (LIN 23/047) 2023, registered on 29 June 2023 and commencing on 1 July 2023. The amendment table shows that only Schedule 1 was amended by that amending instrument. Section 2 (commencement) and section 4 (repeal of earlier instrument) were repealed by the Legislation Act 2003 automatically, not by the amendment itself.

The nature of the amendment to Schedule 1 is not detailed in the source text. Given the instrument’s content, the amendment likely updated the list of countries or regions, changed conditions (e.g., passport requirements), or adjusted younger ages. Without the amending instrument text, we can only infer that the amendment was minor enough to keep the same compilation number. The original Schedule 1 contained 19 entries; the amendment may have added or removed a country or altered the younger age for a particular country. Notably, the younger age column for Canada, Denmark, France, Ireland, Italy, and the UK shows a dash; this may have been changed by the amendment (e.g., adding a younger age for some countries) but the current version shows dash.

The compilation was prepared by the Department of Home Affairs on 1 July 2023. No further amendments are indicated. The instrument remains in force as at that date.

This amendment history is minimal, reflecting that the instrument is a routine procedural update. The lack of major revision suggests the Department is satisfied with the current arrangements.

The source text does not cite any cases. This is a delegated legislative instrument, not a decision, so it is not typically the direct subject of litigation. However, its requirements could be challenged indirectly in visa refusal cases. For example, an applicant refused a visa because they used the wrong application method could argue that the instrument is ultra vires or unreasonably restrictive. No such published case has been identified.

In general, challenges to instruments of this kind under the Migration Regulations are rare, partly because they are procedural and involve ministerial discretion. The Administrative Appeals Tribunal and courts have considered the validity of lodgement requirements, usually focusing on whether the applicant substantially complied. For instance, cases under the Migration Act about “valid application” often turn on whether the prescribed form was used. The instrument’s requirement that the application must be made in ImmiAccount unless invited by email would be relevant to such cases.

The instrument has not been the subject of any known judicial consideration on its own terms. Given its narrow scope and the existence of a separate subclass 462 for non listed countries, the incentive to challenge it is low. Most litigation in the working holiday space relates to criteria such as “specified work” for second or third years, conditions attached to the visa, or cancellations.

The instrument’s provisions on younger age are unlikely to be litigated because the age limit is uniform (30) and uncontroversial. The passport conditions (e.g., that a Taiwanese passport must not be official or diplomatic) could theoretically be challenged as discriminatory, but no such challenge is recorded.

Thus, litigation history is essentially nil. The instrument operates in the background of the visa system without generating dispute.

Several aspects of the instrument can catch applicants and advisers off guard:

Mandatory online method with narrow email exception. The default is ImmiAccount. The email route is not a second option; it is only available if the Department first sends a written notice. An applicant who simply sends an email without a notice will have an invalid application. The Department’s policy on when it issues such notices is not defined in the instrument, creating uncertainty. An applicant who cannot access ImmiAccount for technical reasons may have no remedy if the Department refuses to issue a notice.

Seven day deadline for email applications. If the Department sends a written notice, the applicant must submit the application within seven calendar days. The time zone is AEST or AEDST, which matters near daylight saving changes. If the notice is sent on 1 October at 10:00 AEST (which is AEDST from the first Sunday in October), the deadline will be seven days later at the same time in AEDST. Misreading the deadline could lead to a late application that is invalid.

Passport validity for applicants already in Australia. Section 5(1)(b) allows an applicant in Australia whose passport has expired after entry to apply, provided the passport was eligible when they entered. But the passport must have expired after entry. If it expired before entry, the applicant does not qualify. Also, the passport must be from a listed country. Applicants who changed nationality after entry cannot rely on their original passport.

Taiwan passport condition. The passport must not “purport to be an official or diplomatic passport.” This excludes Taiwanese holders of diplomatic or official passports, even if they are otherwise eligible. The condition does not apply to other countries. An applicant with a Taiwanese diplomatic passport cannot apply, even if they are not a diplomat.

United Kingdom passport condition. The passport must indicate “British Citizen” or “British National (Overseas).” Holders of other types of British nationality (British Overseas Territories citizen, British Overseas citizen, British subject, etc.) are not eligible. This is a narrow group.

Passport from Hong Kong SAR. No “conditions” column for Hong Kong, so the passport must be issued by Hong Kong SAR and presumably indicate that the applicant is a national of China (Hong Kong SAR). No younger age is specified? Actually, the younger age for Hong Kong is 30, so age limit applies.

Younger age dash means default age 30. Some may think a dash means no age limit, but it means standard age 30 applies. So all listed countries have the same age limit. No country gets an extended age.

No provision for lost or stolen passports. If an applicant’s passport is lost and they are in Australia, they may not meet the “holds a passport” requirement unless they obtain a replacement passport that also meets the conditions. The instrument does not address this.

Compliance with the instrument is straightforward but rigid. An applicant for a subclass 417 visa must follow these steps:

Step 1: Confirm passport eligibility. Check that the applicant holds a valid passport from a country or region listed in Schedule 1. For most countries, the passport must indicate that the applicant is a national of that country. For Taiwan, the passport must not be official or diplomatic. For the United Kingdom, the passport must indicate British Citizen or British National (Overseas). If the applicant is in Australia and their passport expired after entry, they may still apply if they entered with an eligible passport.

Step 2: Check age eligibility. The applicant must not have turned the younger age specified for their passport country, plus one year. For example, if the younger age is 30, the applicant must be under 31 at the time of application. For countries with a dash (Canada, Denmark, France, Ireland, Italy, United Kingdom), the default age limit of 30 applies (must be under 31). Age is not specified in the instrument but is a criterion in the Regulations; the instrument merely defines the younger age.

Step 3: Apply via ImmiAccount. The applicant must log into ImmiAccount on the Department’s website and complete Form 1150 (Internet). The application must be submitted online. This is the primary method. The applicant should ensure they have a valid ImmiAccount, can upload documents, and pay the fee.

Step 4: Only use email if invited. If the applicant cannot apply through ImmiAccount, they must not simply email the form. They must first obtain a written notice (an email from the Department) authorising them to apply by email. The applicant must attach that email to the application and send it to WHM.invited.applications@homeaffairs.gov.au within seven calendar days of the notice being sent. The time zone for calculating the deadline is AEST or AEDST based on the date the notice was sent.

Step 5: Comply with the seven day window strictly. If the written notice is sent on a given date, the applicant must count seven calendar days forward and ensure the email is sent before the end of that day in the relevant time zone. There is no extension for weekends or public holidays.

Step 6: Keep records. The applicant should keep a copy of the ImmiAccount lodgement receipt or the sent email (with evidence of the notice attachment). These may be needed for review or to prove valid application.

Step 7: Advisers should verify the instrument’s current version. Because the instrument is subject to amendment (Schedule 1 has already been amended once), advisers should check the Federal Register of Legislation for the latest compilation, especially the Schedule. The younger age or passport conditions may change.

Commercial implications: Compliance is low cost if the applicant has internet access. The requirement to use ImmiAccount imposes a minor digital burden but no direct monetary cost beyond the visa application fee. The email exception creates a potential bottleneck: the Department may not issue notices promptly, delaying applications. For time sensitive applicants (e.g., intending to start a job), this could be problematic.

Risk of non compliance: Using the wrong method invalidates the application. There is no opportunity to cure. If an applicant uses the email channel without a notice, the application is not valid and cannot be processed. The applicant would need to reapply via ImmiAccount (or obtain a notice) and pay the fee again. Therefore, strict adherence is essential.
