Metropolitan Water Authority Act 1982

Arterial Drainage Scheme (Scheme): The Scheme is the statutory planning instrument that records, organises and governs metropolitan arterial drainage. The Minister is charged with compiling and periodically reviewing plans that together illustrate the Scheme (s 98(1)-(2)). The Scheme is explicitly planning and coordination focussed. It must show drainage catchments, natural drainage features, existing and proposed development, existing and proposed drainage infrastructure differentiated by kinds of drainage and the persons or bodies liable for provision and maintenance (s 98(2)(a)-(e)). The Scheme may additionally provide for water conservation and aquifer recharge uses (s 98(3), third paragraph).

Arterial drain: An arterial drain is a drainage asset classified as such in the Arterial Drainage Scheme (s 4(1) definition). The Minister determines which drainage assets are arterial drains and delineates their course on specified plans, indicating nature and size and providing notice to relevant licensees and local governments (s 99(4)(a)-(d)). While the Minister administers the arterial drainage system, the Act does not itself vest control, management or care of an arterial drain in the Minister (s 99(1), (3)).

Drainage course: A drainage course is an area declared under s 106 to be sufficient to contain a drainage asset (s 4(1) definition; s 106(1)). The statutory procedure for declaration requires a delineation on a specified plan, notices to licensees, local governments and, so far as practicable, owners and occupiers; a public advertisement; a one month period for objections and submissions; negotiation and modification as practicable; and publication in the Government Gazette giving effect to the declaration (s 106(2)-(3)). Declarations may be varied or cancelled by subsequent Gazette notice (s 106(4)-(5)). The declaration is expressly “notice of the intention of the Minister that the land is liable to be utilised for arterial drainage” but the Act denies any right to compensation from the Crown arising from the declaration (s 106(6)(a)-(b)).

Consultation and allocation of responsibilities: The Act repeatedly requires consultation, collaboration and negotiation. The Scheme must be prepared in consultation with “all relevant licensees” (s 98(1)), and the Minister must consult and collaborate with licensees and affected local governments and, where practicable, authorities for health, planning, roads, railways, conservation and waterways (s 98(4)). The Scheme, in preparation, must take into account environmental and financial consequences and “ultimately make provision for the division of responsibilities, by agreement, as between the Minister, relevant licensees, local governments and other persons” (s 98(5)). For arterial drain designation the Minister must invite submissions from licensees and local governments and may review designations (s 99(4)(d)-(f)).

Interaction with planning and Water Services law: The Act cross‑refers to the Water Services Act 2012 for meanings of drainage assets and licensee (s 4(1)), and for the meanings of development and subdivision used in s 107 (s 107(4)). The Act requires the Minister to inform planning authorities of drainage courses (s 107(2)) and obliges planning authorities to “have regard” to drainage courses when considering conditions on development or subdivision (s 107(3)). The Scheme may also be shaped by regulations made under the Water Agencies (Powers) Act 1984 (s 98(2)(g)).

Limitations and protections: The Act does not itself create a right to compensation where land is declared a drainage course (s 106(6)(b)). It protects certain past office‑holders from personal civil liability for acts done in good faith under this Act or the Metropolitan Water Supply, Sewerage, and Drainage Act 1909 (s 19). The Act also preserves reading together with the older Metropolitan Water Supply, Sewerage, and Drainage Act 1909 (s 5(1)), and provides for interpretation of references to predecessor bodies as references to successor bodies where appropriate (s 5(2)).

Statutory deletions and transition: Many sections and entire Parts are marked as deleted or repealed in the text, and the compilation table records a sequence of amending Acts that have reshaped the Act. The current operative provisions are concentrated in Part IX (ss 98-107) together with s 19 and the preliminary definitions. Several provisions dealing with administration and enforcement were removed by later amending legislation; the Act as reprinted at 17 January 2014 is therefore a compact instrument focused on scheme planning, designation, course declaration and planning interactions.

Minister: The Minister is the statutory decision maker charged with ensuring compilation, review and implementation of the Arterial Drainage Scheme (s 98(1)). The Minister determines classification of arterial drains, delineates their course and size, assigns names, serves notice to affected licensees and local governments and invites submissions (s 99(4)(a)-(f)). The Minister also has the power to declare, vary or cancel drainage courses by Gazette notice following prescribed procedural steps (s 106(1)-(5)). The Minister must inform planning authorities of the existence of drainage courses (s 107(2)).

Licensees: The Act repeatedly requires consultation and notice to “relevant licensees” who are parties to the Scheme process (see s 98(1), s 98(4), s 99(4)(d), s 106(2)(a)). “Licensee” is defined by cross reference to s 3(1) of the Water Services Act 2012 (s 4(1)). Licensees include entities authorised under the Water Services Act to provide water services; the Scheme requires that planning, financing and assignment of maintenance liability be done “in consultation with all relevant licensees” (s 98(1)-(2)(e)).

Local governments: The Minister must consult with the local governments of districts affected by arterial drains and drainage courses (s 98(4), s 99(4)(d), s 106(2)(a)). Local governments receive notice of designations and course proposals and may make submissions or objections which the Minister is to negotiate with, so far as practicable (s 99(4)(d),(e); s 106(2)(a),(c)). The Scheme contemplates allocation of responsibilities by agreement with local governments for provision and maintenance (s 98(5)).

Owners and occupiers of land: Landowners and occupiers within proposed drainage courses are to be served notice “so far as is practicable” and may make objections or submissions within one month of service (s 106(2)(a)). After declaration, land within a drainage course is taken to be “liable to be utilised for arterial drainage” (s 106(6)(a)), but the Act expressly denies a right to compensation from the Crown for the declaration (s 106(6)(b)).

Planning authorities and developers: The Minister must inform planning authorities of drainage courses (s 107(2)). Planning authorities must have regard to drainage courses when considering conditions on development or subdivision applications (s 107(3)). “Development” and “subdivision” adopt the meanings in Part 5 Division 3 of the Water Services Act 2012 (s 107(4)). Developers should therefore expect planning authorities to consider drainage course designations when imposing conditions on approvals.

Other statutory bodies: The Act requires the Minister, in so far as practicable, to consult authorities responsible for health, planning, roads, railways, conservation and environmental protection, and waterways during Scheme preparation and implementation (s 98(4)). Bodies with statutory duties in those fields are therefore relevant consultees and may be affected by designation and allocation decisions under the Scheme.

Legal practitioners and purchasers: The Act affects due diligence practice for property transactions in the metropolitan Area. The statutory record of arterial drains and drainage courses is constituted by specified plans and Government Gazette notices (s 99(4)(b), s 106(3)(c)), so purchasers, lenders and advisers should inspect those instruments and any local government planning conditions. The Act denies compensation for declarations (s 106(6)(b)), which is a material legal risk for affected landowners.

Persons previously involved with predecessor bodies: Section 19 exempts from personal civil liability persons who were members, acting members or delegates of predecessor water authorities in respect of acts or omissions done in good faith under this Act or the Metropolitan Water Supply, Sewerage, and Drainage Act 1909. This affects former officeholders and may limit personal claims against them (s 19).

Regulators and statute‑making authorities: The Scheme and its operation are subject to regulations under the Water Agencies (Powers) Act 1984, which may prescribe additional matters to be included in the Scheme (s 98(2)(g)). The Act also requires reading together with the Metropolitan Water Supply, Sewerage, and Drainage Act 1909 (s 5(1)) and draws definitions from the Water Services Act 2012 (s 4(1)), so multiple statutory instruments and regulators intersect.

Minister’s duties: The central statutory duty is to ensure compilation of the Arterial Drainage Scheme and to prepare, periodically review and amend the plans that illustrate it (s 98(1)-(2)). The Minister must consult with relevant licensees and affected local governments and, insofar as practicable, with specified authorities for health, planning, roads, railways, conservation and waterways (s 98(1), (4)). The Minister must take into account environmental, conservation and management considerations and financial implications for provision and maintenance of drainage assets, and the Scheme is to provide for division of responsibilities by agreement among stakeholders (s 98(5)). For arterial drains, the Minister must determine classifications, delineate commencement, route and termination on specified plans, indicate nature and size, notify relevant licensees and local governments in writing with a copy plan, invite submissions within a reasonable time and review designations as necessary (s 99(4)(a)-(f)).

Procedural duties for drainage courses: When proposing a drainage course the Minister must delineate the lands in sufficient detail on a specified plan and serve written notice to relevant licensees, local governments and, so far as practicable, owners and occupiers informing them of objections and submissions rights within one month (s 106(2)(a)). The Minister must also publish an advertisement in a local newspaper indicating where particulars may be obtained and must negotiate with licensees, affected local governments and objectors, modifying the proposal so far as practicable (s 106(2)(b)-(c)). Upon declaration, the Minister must publish a Government Gazette notice describing boundaries, naming the course and stating where the plan may be inspected (s 106(3)(a)-(c)). The Minister can vary or cancel declarations by subsequent Gazette notice (s 106(4)-(5)).

Notices, plans and inspection rights: The Act establishes a record‑based process. Plans specified under the Scheme must be made and copies provided to licensees and local governments on designation (s 99(4)(b), s 106(2)(a)). The Gazette notice for a drainage course must describe boundaries sufficiently or refer to descriptions where they can be ascertained and must state where the relevant plan may be inspected (s 106(3)(b)-(c)). Affected persons have the right to be served notice and to request particulars under the advertisement procedure (s 106(2)(b)) and to make objections or submissions within the statutory one month window (s 106(2)(a)).

Planning authority obligations: The Minister must inform planning authorities of the existence of drainage courses (s 107(2)). Planning authorities must “have regard” to the existence of a drainage course when deciding whether to impose conditions on development or subdivision (s 107(3)). That statutory phrase creates a procedural consideration rather than an absolute bar; planning authorities exercise discretion after taking the drainage course into account.

Rights (and limits) of landowners and occupiers: Owners and occupiers in the proposed course area are to be served with notice so far as practicable and can object or submit within one month (s 106(2)(a)). The declaration of a drainage course is “notice” that land is liable to be used for arterial drainage (s 106(6)(a)). However, the Act explicitly states that the declaration does not entitle any person to compensation from the Crown (s 106(6)(b)). That is a statutory limit on monetary compensation rights arising from the declaration itself.

Liability protection for certain officers: Section 19 provides a statutory exemption from personal civil liability for persons who have been officeholders in predecessor water authorities in connection with acts or omissions done in good faith under this Act or the Metropolitan Water Supply, Sewerage, and Drainage Act 1909. The exemption applies in civil proceedings and covers acts done or omitted in good faith in, or in connection with, exercise or purported exercise of powers or duties under those Acts (s 19).

Discretionary language and standards: The Act uses a mixture of mandatory language such as “shall” for many Ministerial duties (s 98(2), s 99(4), s 106(2)-(3)) and permissive language such as “may” for declaring a drainage course (s 106(1)) and for varying or cancelling a declaration (s 106(4)-(5)). Consultation obligations are framed in both firm and qualified terms, for example the Minister “shall consult and collaborate” (s 98(4)) but negotiations with objectors are required “so far as is practicable” (s 106(2)(c)). The Scheme must “make provision” for classification and drainage courses (s 98(3)) and for division of responsibilities “by agreement” (s 98(5)), signalling a mix of statutory direction and negotiated allocation.

Statutory cross‑references and external regulation: Several rights and duties are expressed by cross‑reference to other statutes. The definitions of “drainage assets” and “licensee” are taken from the Water Services Act 2012 (s 4(1)). The specific meaning of “development” and “subdivision” for s 107 is provided by Part 5 Division 3 of the Water Services Act 2012 (s 107(4)). The Scheme’s content may be augmented by regulations made under the Water Agencies (Powers) Act 1984 (s 98(2)(g)). Therefore, operational rights and obligations in practice depend on those other instruments as well as on the Act itself.

The Metropolitan Arterial Drainage Act 1982, as reprinted at 17 January 2014, contains limited express penalty or enforcement provisions within the text reproduced. The operative provisions in Part IX set out planning, designation and notice procedures but do not themselves create specific criminal offences, prescribed civil penalties or an administrative enforcement regime in the sections provided (see ss 98-99, 106-107). The Act’s enforcement architecture therefore operates mostly through administrative actions (designation, declaration, Gazette publication and planning‑authority processes) rather than through an explicit schedule of penalties in the reprinted provisions.

Administrative effect of declarations and designations: The primary enforcement‑type effect in the Act is the statutory effect of a declaration that a specified area is a drainage course. Once declared by Gazette notice, the land “shall be a drainage course” known by the assigned name and the boundaries are recorded with an indication where the plan may be inspected (s 106(3)(a)-(c)). The declaration also functions as statutory notice that the land is liable to be utilised for arterial drainage (s 106(6)(a)). The Minister may vary or cancel a declaration by subsequent Gazette notice (s 106(4)-(5)). These provisions create legal facts about land status that will feed into planning decisions, local government conditions and contractual dealings.

No statutory entitlement to compensation: The Act removes a monetary enforcement remedy that might otherwise flow from interference with property by making clear that the declaration of a drainage course does not create an entitlement to compensation from the Crown (s 106(6)(b)). That is an express statutory limitation on claims for compensation arising solely from declaration under this Act.

Civil liability protection: Section 19 is a pre‑emptive civil‑law protection with enforcement implications. It provides that certain past officeholders of predecessor bodies are not personally liable in civil proceedings for actions or omissions done in good faith in connection with exercising powers or duties under this Act or the Metropolitan Water Supply, Sewerage, and Drainage Act 1909 (s 19). That provision affects remedies available to claimants in civil proceedings against those individuals.

Enforcement via planning regimes: The Act requires the Minister to inform planning authorities of drainage courses and requires planning authorities to have regard to such courses when imposing conditions on development or subdivision (s 107(2)-(3)). Enforcement of drainage‑related outcomes will therefore commonly be channelled through planning approvals and conditions. Any breach of planning conditions would be enforced under the planning statute and local government powers rather than directly under this Act. The Act contains no express power in the reproduced text to impose or to prosecute breaches of planning conditions itself.

Dependence on other statutes and regulations: The Act expressly imports definitions and cross‑references to the Water Services Act 2012 and allows regulations under the Water Agencies (Powers) Act 1984 to prescribe matters for the Scheme (s 4(1), s 98(2)(g), s 107(4)). Any sanctions, licences, or enforcement mechanisms applicable to licensees, drainage asset management or development conditions are therefore likely to arise under those other statutes or under local government planning law rather than within this Act’s current text. The compilation table and notes also identify amendments and transitional provisions that may affect where enforcement functions now sit; practitioners must check the Water Services Act 2012 and relevant regulations for applicable enforcement mechanisms.

Absence of express offences in reprinted text: A practical consequence of the current wording is that the Act itself provides for statutory planning designations, consultation rights and procedural steps but does not establish a standalone offence regime or an express system of administrative fines or directions in the clauses reproduced. Parties seeking remedies, enforcement or penalties will therefore need to rely on overlapping statutes, planning frameworks or common law remedies, and on rights and duties generated by the Scheme as they interact with those other legal instruments.

Cross‑referencing and incorporation: Section 5 makes clear that the Metropolitan Arterial Drainage Act 1982 is incorporated with and may be read as one with the Metropolitan Water Supply, Sewerage, and Drainage Act 1909, and that references to “this Act” include that 1909 Act and any by‑laws made under it or under the Water Agencies (Powers) Act 1984 (s 5(1)). This means practitioners should read the statutory drainage provisions together with the older 1909 Act and its by‑laws to understand the full legal context in which drainage responsibilities and powers operate.

Definitions and operational cross‑links: The Act imports several key terms from the Water Services Act 2012. “Drainage assets” and “licensee” are defined by cross reference to s 108 and s 3(1) of the Water Services Act 2012 respectively (s 4(1)). The terms “development” and “subdivision” used in s 107 are defined by reference to Part 5 Division 3 of the Water Services Act 2012 (s 107(4)). This creates practical dependency: the identity of parties who must be consulted (licensees), the scope of what constitutes development or subdivision for planning considerations, and the definition of drainage assets all depend upon the Water Services Act 2012.

Regulations under Water Agencies (Powers) Act 1984: Section 98(2)(g) permits inclusion in the Scheme of any other matters prescribed by regulations made under the Water Agencies (Powers) Act 1984. Consequently, the content and operational detail of the Scheme can be modified or supplemented by subordinate legislation made under that Act. Practitioners should therefore consult relevant regulations and subordinate instruments made under the Water Agencies (Powers) Act for prescriptive requirements or standards that the Scheme must reflect.

Planning law interaction: Section 107 establishes a direct statutory link into planning processes by requiring the Minister to inform planning authorities of drainage courses (s 107(2)) and by requiring planning authorities to “have regard” to drainage courses when imposing conditions on development or subdivision (s 107(3)). The effect is that the statutory existence of a drainage course becomes a material consideration for planning decision‑makers. Enforcement of conditions arising from that process will be under planning legislation and local government enforcement powers rather than under this Act itself.

Transitional and repeals: The compilation table shows multiple amending Acts and reprints that have altered operational arrangements across the water sector, notably the Water Agencies Restructure (Transitional and Consequential Provisions) Act 1995, the Water Resources Legislation Amendment Act 2007 and the Water Services Legislation Amendment and Repeal Act 2012. The notes record that the Water Agencies (Powers) Act 1984 was previously known as the Water Authority Act 1984 and that references to predecessor bodies are to be read accordingly (notes 2-4). Practitioners must therefore track the historical and transitional provisions in those amending Acts and consult current statutes to identify which entity now performs duties previously assigned to bodies that have been abolished or reconstituted.

State Administrative Tribunal and jurisdictional conferral: The compilation notes mention the State Administrative Tribunal (conferral of jurisdiction) amendments and the State Administrative Tribunal Act 2004 in the compilation table notes. While the Act itself does not set out procedure for appeals or review in the parts reproduced, the broader statutory framework for administrative review and jurisdictional conferral (State Administrative Tribunal Act 2004) may be relevant to disputes over decisions made under this Act. The notes recommend consulting transitional provisions in the 2004 amendments for issues that may be relevant.

Interaction with property law: The declaration of a drainage course is recorded by Gazette notice and specific plans (s 106(3)(a)-(c)). That declaration is statutory notice that land is liable to be used for arterial drainage (s 106(6)(a)). While the Act removes compensation rights for declarations (s 106(6)(b)), the declaration will affect land use, title searches and the operation of covenants, easements and contractual terms. Conveyancers, lenders and surveyors must therefore review Gazette notices and specified plans when advising on property transactions.

Allocation of maintenance and financing responsibilities: The Scheme is to indicate proposed kinds of drainage and persons or bodies liable for provision and maintenance of that drainage (s 98(2)(d)-(e)). The Scheme is also to make provision “for the division of responsibilities, by agreement” among the Minister, licensees, local governments and others (s 98(5)). This points to a hybrid statutory‑contractual interaction where statutory designation and mapping interact with negotiated agreements under other statutory frameworks and private contractual arrangements.

The reprint and compilation table in the Act record a sequence of amendments and reprints that materially changed and condensed the Act over time. Key legislative steps recorded in the compilation table and section notes are:

• Metropolitan Water Authority Act 1982 (36 of 1982), assented 27 May 1982, commenced 1 July 1982, which is the original statutory instrument later renamed (compilation table entry).
• Metropolitan Water Authority Amendment Act 1982 (101 of 1982), assented 24 November 1982, commenced 31 December 1982 (compilation table).
• Acts Amendment and Repeal (Water Authorities) Act 1985 (25 of 1985), assented 6 May 1985, commenced 1 July 1985. This amending Act effected deletions and reorganisation of Parts and references to predecessor bodies (multiple “deleted” notes throughout the text).
• Acts Amendment (Water Authorities) Act 1985 (110 of 1985), assented 17 December 1985, commenced 14 March 1986, further amending provisions and removing or altering Division headings (section note references).
• Acts Amendment (Water Authority Rates and Charges) Act 1987 (24 of 1987), assented 25 June 1987, commenced 14 July 1987, recorded in the compilation table.
• Water Agencies Restructure (Transitional and Consequential Provisions) Act 1995 (73 of 1995), assented 27 December 1995, commenced 1 January 1996. This Act changed statutory nomenclature, reallocated functions and amended definitions; notes record re‑naming of the Water Authority Act 1984 and related transitional provisions (compilation notes 2 and 3).
• Local Government (Consequential Amendments) Act 1996 (14 of 1996), assented 28 June 1996, commenced 1 July 1996 (compilation table).
• Economic Regulation Authority Act 2003 (67 of 2003), Sch. 2 Div. 9, assented 5 December 2003, commenced 1 January 2004 (compilation table).
• State Administrative Tribunal (Conferral of Jurisdiction) Amendment and Repeal Act 2004 (55 of 2004), Pt. 2 Div. 83, assented 24 November 2004, commenced 1 January 2005. The compilation notes refer to transitional issues relevant to this Act (compilation note 6).
• Water Resources Legislation Amendment Act 2007 (38 of 2007), Pt. 3 and Pt. 11 (transitional), assented 21 December 2007, commenced 1 February 2008, repealed the Water and Rivers Commission Act 1995 and effected consequential changes (compilation note 4, compilation table).
• Standardisation of Formatting Act 2010 (19 of 2010), s 51, assented 28 June 2010, commenced 11 September 2010, a technical reprint adjustment (compilation table).
• Water Services Legislation Amendment and Repeal Act 2012 (25 of 2012), Pt. 3, assented 3 September 2012, commenced 18 November 2013. This amending Act appears to have altered the Act’s short title and removed or replaced many provisions; the long title and several sections are recorded as inserted or amended by No. 25 of 2012 (compilation table).

The reprints recorded are:

• Reprint as the Metropolitan Water Authority Act 1982 as at 21 January 2000, which included prior amendments.
• Reprint 2 as the Metropolitan Water Authority Act 1982 as at 4 July 2008, which incorporated the 2003 and 2007 amendments.
• Reprint 3 as the Metropolitan Arterial Drainage Act 1982 as at 17 January 2014, which is the version reproduced.

Textual deletions and repeals in the reprint: Numerous sections and entire Parts are marked deleted or repealed by later Acts (see multiple “[deleted]” and “[repealed]” annotations throughout Parts I, II and earlier Parts III-VIII, X). The current operative statutory content is primarily focused in Part IX (Divisions 1, 2 and 5) and the liability exemption in s 19. The compilation table documents the legislative context for those deletions and the transfer of functions across the evolving water sector regulatory architecture.

Transitional notes and reinterpretation of references: The notes clarify that a number of earlier Acts have changed short titles and statutory arrangements. For example, note 2 records that before the 1995 Restructure Act, the Water Agencies (Powers) Act 1984 was known as the Water Authority Act 1984. Note 4 records that the Water and Rivers Commission Act 1995 was repealed by the 2007 amendments. Section 5(2) provides that references to the former Board or former Metropolitan Authority in pre‑amendment instruments are to be read as references to successor entities where context allows (s 5(2)). Practitioners must therefore follow the amending Acts and transitional provisions to identify which modern body corresponds to historical references.

Implications for current practice: The amendment history shows progressive narrowing and reallocation of responsibilities within the water sector and the pruning of administrative detail from this Act into other, later instruments such as the Water Services Act 2012 and the Water Agencies (Powers) Act. The reprint date of 17 January 2014 means the Act should be read with those later statutes for the full operational picture. The compilation table entries are the authoritative guide to commencement dates for each amendment and should be consulted where historical operation or timing of obligations matters.

The reprinted text of the Metropolitan Arterial Drainage Act 1982 contains no case law citations and does not record any judicial decisions or litigation proceedings. The Act’s compilation notes do not identify any specific cases decided under the Act nor do they list appeals or tribunal decisions referring to its provisions.

Relevant tribunal and judicial pathways: The compilation notes reference the State Administrative Tribunal (conferral of jurisdiction) amendments and the State Administrative Tribunal Act 2004 as dealing with transitional issues that may be relevant for this Act (compilation note 6). That suggests that any administrative decisions under this Act that are subject to merits review or jurisdictional transfer may be dealt with under the State Administrative Tribunal Act 2004 or under the jurisdictional framework provided by it and any conferral regulations. Practitioners should therefore search external databases for SAT or superior court decisions that involve arterial drain designations, drainage course declarations or planning decisions that took a drainage course into account.

Absence of reported litigation in the text: Because the printed Act does not list or cite cases, and the instructions require grounding any claims in the provided source, this section must limit itself to the observation that there are no cases named or cited in the reprinted text. Users seeking litigation history must perform a jurisdictional case law search (State Administrative Tribunal, Supreme Court of Western Australia, Court of Appeal) for disputes involving arterial drains, drainage course declarations or Scheme implementation, and should review decisions dealing with the planning consequences of s 107(3)’s “have regard” requirement.

Potential dispute vectors indicated by the Act: Although the Act itself contains no litigation history, the statutory processes in ss 99 and 106 set up potential dispute triggers: designation of arterial drains, the Minister’s notice and invitation for submissions, the one month objection period for drainage course proposals, and the effect of a declaration on land use. Disputes could therefore reasonably arise in practice over adequacy of consultation, the delineation of boundaries on specified plans, the Minister’s reasons for classification or declaration, and planning authorities’ treatment of drainage courses. Resolution of such disputes would involve the planning law and administrative law frameworks referenced elsewhere.

Recommendation for practitioners: Given the Act’s silence about case law, assessors and advisers should conduct targeted searches of administrative and planning decisions in the State Administrative Tribunal and superior courts for decisions that interpret the procedural adequacy of s 106 notices, the legal effect of s 106 declarations on property rights, and the weight to be given to s 107(3) in planning determinations. They should also verify whether any jurisdictional conferral or transitional provision affects appeal or review rights relevant to specific decisions.

No compensation for drainage‑course declaration: The Act expressly states that the declaration that land is a drainage course “shall be taken to be notice of the intention of the Minister that the land is liable to be utilised for arterial drainage; but does not thereby entitle any person to compensation from the Crown” (s 106(6)(a)-(b)). This is a statutory trap for owners who assume that formal designation necessarily triggers compensation rights. For clients, confirm that no other statutory regime, private contract or planning condition creates a separate compensation right.

Minister’s administrative role but no statutory vesting of control: The Act charges the Minister with overall administration of the arterial drainage system (s 99(1)), yet it expressly states that the Act does not vest in the Minister the control, management or care of an arterial drain or proposed arterial drain (s 99(3)). Practically, this means that the Minister’s powers are largely coordinative, planning and declaratory, and operational control may lie with other entities such as licensees or local government. Advise clients to identify which body has actual operational responsibility for a particular drain, not to assume Ministerial control based solely on designations in the Scheme.

“Have regard” is a limited planning constraint: Section 107(3) requires planning authorities to have regard to the existence of a drainage course when considering whether conditions should be imposed on development or subdivision. “Have regard” is a statutory requirement to consider, not a duty to prevent development. Parties should not assume that a drainage course will automatically stop a proposed development; rather it becomes a material consideration in the planning decision. The practical outcome will depend on the planning authority’s exercise of discretion, applicable planning instruments and any conditions it chooses to impose.

“So far as is practicable” and reasonable time: Notice and negotiation obligations use qualified language. The Minister must serve notice on owners and occupiers “so far as is practicable” and must invite submissions from licensees and local governments within “such reasonable time as is specified in the notice of designation” (s 99(4)(d)-(e); s 106(2)(a)). Those qualifiers create uncertainty about what constitutes adequate notice or a reasonable time. Parties seeking to challenge adequacy of consultation will need to focus on the facts and reasonableness standard, not on absolute procedural form.

Allocation of liabilities “by agreement”: The Scheme is to provide for the division of responsibilities “by agreement” among the Minister, licensees, local governments and other persons (s 98(5)). That approach relies on negotiation to allocate maintenance and financing responsibilities. Absent a formal agreement, responsibility may be uncertain. Where a client is a licensee or local government, insist on clear written agreements to record maintenance, cost‑sharing and operational obligations that the Scheme suggests but does not automatically fix.

Plans govern boundaries and rights of inspection: Designation of arterial drains and declaration of drainage courses rely on specified plans and Gazette notices (s 99(4)(b), s 106(2)(a), s 106(3)(c)). Failure to inspect the relevant specified plan is risky. Property advisers must search Government Gazette notices and obtain the relevant specified plans to determine exact boundaries and implications. Reliance on general descriptions may be insufficient in negotiations or litigation.

Limited enforcement and absence of penalty clauses in this text: The Act as reprinted contains few enforcement provisions and no express criminal offences or penalty schedules in the operative sections reproduced. Enforcement of drainage outcomes will typically be channelled through planning conditions or other statutory schemes. Do not assume the Act provides a standalone enforcement machinery to compel compliance beyond declaration and the planning interactions created.

Dependence on other instruments: Many operative definitions and practical effects depend on the Water Services Act 2012 and on regulations under the Water Agencies (Powers) Act 1984 (ss 4(1), 98(2)(g), 107(4)). For example, the identity of who counts as a “licensee” is a Water Services Act question. The Act’s practical application therefore requires review of those other instruments. Neglecting to do so is a common compliance pitfall.

Liability protection for predecessors: Section 19 immunises certain past officeholders from personal civil liability for acts done in good faith under this Act or the 1909 Act. Practitioners must check whether key decisions were taken by persons to whom s 19 applies, because that provision can affect the viability of civil claims against individuals for historical decisions.

Deleted and repealed material: Many sections and entire Parts are shown as deleted or repealed by later amending Acts. The Act now concentrates on scheme, drainage course declarations and planning linkages. Do not rely on historical versions if advising about current powers or remedies; use the reprint date and compilation table to confirm present law and relevant commencement dates for amendments.

Time limits for objections: The procedural window for objections to a proposed drainage course is one month from the date of service of the notice (s 106(2)(a)). Missing this deadline can foreclose administrative objections. Parties must monitor service lines and Gazette notices closely and act within short statutory windows.

Record‑based approach: The Act’s operation is heavily record‑driven: specific plans, written notices, advertisements and Gazette notices are the instruments that create legal effects (ss 99(4)(b), 106(2)(a), 106(3)). Ensure records are obtained, preserved and referenced in any submission or objection. Lack of documentary evidence of service or plan publication will make procedural challenges difficult.

For Ministers and government administrators

• Compile and maintain the Arterial Drainage Scheme as required by s 98(1)-(2). Ensure plans collectively show the items listed in s 98(2)(a)-(f), including drainage catchments, natural features, existing and proposed development, the existing and proposed drainage system differentiated by kinds of drainage, and land that benefits or contributes to drainage needs.
• Consult and collaborate with all relevant licensees and affected local governments and, insofar as practicable, with authorities responsible for health, planning, roads, railways, conservation and waterways (s 98(4)). Document the consultation process. The Act uses mandatory language for consultation and review, so maintain records of invitations, submissions and responses.
• When designating arterial drains, perform the delineation on specified plan(s), indicate nature and size, assign names and notify in writing relevant licensees and local governments with a copy plan (s 99(4)(a)-(d)). Specify a reasonable time for submissions and record and respond to those submissions. Keep plans accessible for inspection in accordance with s 106(3)(c) when declaring drainage courses.
• For drainage course proposals follow the statutory procedure: prepare a specified plan showing boundaries in sufficient detail, serve written notice to licensees and local governments and to owners and occupiers as practicable, publish a local advertisement indicating where particulars can be obtained, allow one month for objections and submissions, and negotiate with objectors and licensees so far as practicable, modifying proposals where appropriate (s 106(2)). Publish a Gazette notice declaring the drainage course and stating where the plan may be inspected (s 106(3)(a)-(c)). Document the basis for any decision to vary or cancel a declaration under s 106(4)-(5).
• Ensure environmental, conservation and financial implications are explicitly assessed and documented during Scheme preparation and review (s 98(5)). Where responsibilities are to be allocated by agreement, secure written agreements with licensees and local governments that set out maintenance, financing and operational obligations, and keep them referenced in the Scheme.

For licensees, local governments and other affected bodies

• Monitor Ministerial notices, specified plans and Government Gazette publications. The Act’s operative effects are plan‑ and Gazette‑based (s 99(4)(b), s 106(3)). Establish procedures for checking Gazette notices and for responding within the statutory or specified timeframes.
• Participate actively in consultation. The Scheme contemplates negotiation and agreement on division of responsibilities (s 98(5)). Use submissions at the designation stage (s 99(4)(e)) and objections to drainage course proposals within the one month window (s 106(2)(a)) to secure clear allocation of maintenance and financing responsibilities.
• Obtain and inspect the specified plans linked to any designated arterial drain or drainage course before entering into contracts or consenting to developments. Plans define commencement, route, termination and boundary descriptions (s 99(4)(b), s 106(3)(b)-(c)). Do not rely on general descriptions of a drain’s course.
• For local governments, ensure planning processes incorporate drainage course information supplied by the Minister (s 107(2)), and when deciding on development or subdivision applications “have regard” to those courses (s 107(3)). Develop internal criteria for the weight to be given to a drainage course in conditions of approval and maintain a record of how that “regard” was exercised.
• For licensees, confirm whether operational control or maintenance obligations are recorded by agreement or by other statutory instruments. The Act does not itself vest control of arterial drains in the Minister (s 99(3)), so identify the entity responsible for day‑to‑day management.

For landowners, occupiers and developers

• Check whether your land is within an arterial drain or a declared drainage course by searching the Government Gazette and the specified plans where the drain or course is delineated (s 99(4)(b), s 106(3)(c)). Failure to do so risks missing short statutory windows for objection and negotiation.
• If served with notice of a proposed drainage course, act promptly: you have one month from service to make objections or submissions (s 106(2)(a)). Keep copies of notices and any particulars requested under the advertisement process (s 106(2)(b)).
• Factor in the Act’s denial of compensation for declarations (s 106(6)(b)) when negotiating purchase contracts, development agreements and insurance. Seek contractual protections where possible, for example representations as to absence of declared drainage courses or indemnities for costs arising from subsequent declarations.
• In planning applications, advise planning authorities of any drainage course that affects the site and be prepared for conditions that reflect the Minister’s plans and any allocation of maintenance responsibilities recorded in the Scheme or in agreements with licensees or local government (s 107(2)-(3)).
• Before development or subdivision, obtain up‑to‑date drainage information and any agreements allocating operational responsibility or financing. Where the Scheme indicates proposed drainage infrastructure and responsible bodies (s 98(2)(e)), ensure those proposals are reflected in development approval conditions and in infrastructure agreements.

For legal, survey and conveyancing advisers

• Review the Government Gazette, specified plans and any records of designation and declaration when advising on title, easements, covenants, mortgages and development obligations (s 99(4)(b), s 106(3)(b)-(c)). Confirm whether the declaration of a drainage course has been varied or cancelled (s 106(4)-(5)).
• Use the Water Services Act 2012 to determine whether a party is a “licensee” and to understand the statutory meaning of “development” and “subdivision” where those terms matter (s 4(1), s 107(4)). Regulations under the Water Agencies (Powers) Act 1984 may also prescribe Scheme content (s 98(2)(g)), so check subordinate legislation.
• For transactions, include warranties and disclosure schedules regarding arterial drains and drainage courses, and obtain seller representations on whether the property is subject to any plans, notices or agreements under the Scheme. Consider indemnities where a future declaration could impose unforeseen obligations.
• Where a client wishes to challenge the adequacy of the Minister’s consultation or the procedural fairness of a designation or declaration, consider the timing and standard of review, record any procedural defects (for example failure to serve notice “so far as is practicable” or inadequate plan description) and identify the appropriate review forum, including the State Administrative Tribunal where jurisdiction has been conferred.

Cross‑checking and documentation

• Maintain an issues register for each arterial drain or declared drainage course that records the specified plan references, dates of notices, list of served parties, date of Gazette publication, outcomes of negotiations and any agreements allocating responsibilities. The Act emphasises plans and notices as the instruments that create legal effects (s 99(4)(b), s 106(2)-(3)).
• Where the Scheme provides for allocation of costs and maintenance by agreement (s 98(5)), reduce arrangements to written, stampable agreements that clearly allocate responsibilities, durations, review mechanisms and dispute resolution clauses.
• Keep updated on amendments to the Water Services Act 2012, the Water Agencies (Powers) Act 1984 and any relevant regulations, since the practical implementation and enforcement of many Scheme elements depends on those instruments (s 4(1), s 98(2)(g), s 107(4)).

In all cases, document interactions with the Minister and with other public bodies and preserve records of notices, submissions, plan inspections and negotiation outcomes. The Act’s procedural and record‑based mechanics mean that proof of consultation, notice and agreed allocations will be critical to defending or enforcing rights.
