Metropolitan Adelaide Road Widening Plan Act 1972

The Act revolves around a small set of interlocking concepts: the Plan, the land to which the Act applies, building work, the Commissioner’s consent, compensation treatment for unauthorised work, and administrative mechanisms for notice and regulation.

• The Plan. The statutory object is the Metropolitan Adelaide Road Widening Plan, which the Commissioner must prepare and may amend (s 5(1)). The Plan must be deposited with the Registrar‑General under the Registration of Deeds Act 1935 (s 5(2)). The Plan as deposited defines the spatial scope of the Act by showing land "possibly required for road widening" (s 4(1)).

• Land to which this Act applies. The Act applies to land shown on the Plan as possibly required for road widening, and to all land within six metres of the boundary of that land (s 4(1)). Application to specific land terminates when a plan is deposited under s 27B of the Highways Act 1926 for that land, or when the Commissioner otherwise acquires the land for road widening (s 4(1a)).

• Building work. "Building work" is defined to include any work that is "for the time being building work" within the meaning of the Building Act 1970 and any other work that may be prescribed, but the Minister may declare by Gazette notice that particular works or classes of work are not building work for the purposes of this Act (s 3(1)-(2)). The Act thereby imports the Building Act definition while leaving scope for prescription and Ministerial carve‑outs.

• Consent regime. Section 6 makes it an offence of statutory non‑compliance (civil, not framed as penal in the Act but legally prohibitive) to suffer or permit building work on land to which the Act applies without the Commissioner’s consent. The Act sets the application formality ("in the prescribed manner" with "prescribed particulars") and a 30‑day decision window after receipt (s 8(1)-(3)). If the Commissioner fails to grant, refuse or impose conditions within 30 days, consent is presumed (s 8(3)). Conditions attached to consent are binding on the original recipient and successors in title or occupancy (s 8(6)). A breach of a condition is treated as work carried out without consent (s 8(4)).

• Compensation and evidential consequences. Section 7 creates an express rule that any building work carried out without consent, and any enhancement in value as a result, shall not be taken into account in fixing compensation if the Commissioner acquires the land for road widening. Section 8(5) places the evidential burden on the claimant in acquisition compensation proceedings to prove that work otherwise excluded by s 7 was carried out with the Commissioner’s consent.

• Administrative interfaces. The Commissioner may enter into arrangements with Councils "for the purposes of facilitating the making of application" and such arrangements take effect "as if they were enacted in this Act" (s 9). The Governor may make regulations to give effect to the powers and objects of the Act (s 10). The Minister may publish Gazette notices to declare works not to be building work for this Act (s 3(2)). The Plan and amendments must be deposited with the Registrar‑General (s 5(2)).

These concepts generate a regime that links mapping/notice (depositing the Plan) to a precondition on development (consent), to a mechanism for limiting compensation when acquisition occurs (s 7), and to administrative instruments (prescriptions, Ministerial notices, regulations, Council arrangements).

The Act names several categories of actors and draws effects on them through its consent and compensation mechanics.

• Landowners and occupiers of affected land. The Act applies to "land shown on the Plan as possibly required for road widening and all land within six metres of the boundary of that land" (s 4(1)). Section 6 states that "A person shall not, without the consent of the Commissioner, suffer or permit any building work to be carried out on land to which this Act applies." The Act therefore directly constrains persons who own, occupy or have control over such land. Section 8(6) makes clear that conditions imposed in a consent are binding upon successors in title or occupancy, which imports future owners and tenants into the regulatory burden.

• Applicants for consent. Any person who proposes building work on affected land must apply "in the prescribed manner" with "prescribed particulars" for the Commissioner’s consent (s 8(1)). Applicants are beneficiaries of the 30‑day decision period (s 8(2)-(3)) and must meet any conditions attached (s 8(6)).

• The Commissioner of Highways. The Commissioner has multiple roles: preparing and amending the Plan (s 5(1)), receiving and processing consent applications (s 8), granting or refusing consent and imposing conditions (s 8(2)), and entering arrangements with Councils to facilitate applications (s 9). The Commissioner is also the acquiring authority for road widening purposes and can acquire land such that s 4(1a) ceases the Act’s application to particular parcels.

• Councils. Councils are defined as municipal or district councils and include bodies corporate vested with council powers (s 3(1)). The Commissioner may enter into arrangements with any Council for the purpose of facilitating applications (s 9). Those arrangements carry statutory effect "as if they were enacted in this Act," which brings local government into the operative machinery for administering the consent pathway.

• The Minister and the Governor. The Minister can declare by Gazette notice that particular work or classes of works are not "building work" for the purposes of this Act, and may amend or revoke those declarations by further Gazette notice (s 3(2)). The Governor has power to make regulations to give effect to the powers and objects of the Act (s 10). These executive authorities can therefore shape the scope of the consent requirement and the detailed regulatory implementation.

• Parties to acquisition compensation claims. Section 7 and s 8(5) affect claimants and the Commissioner in acquisition proceedings. If building work was carried out without consent, the value of that work and any enhancement in value shall not be taken into account in fixing compensation (s 7); in compensation proceedings the claimant must prove that the work was carried out with the Commissioner’s consent (s 8(5)). Thus owners or successors seeking compensation after acquisition bear the evidential burden.

Absent other statutory modification recorded in this Act, the Act interacts with the Building Act 1970 (via the definition of building work) and the Highways Act 1926 (see references in s 4(1a) and s 5(2)) in ways that can alter who is affected depending on deposits under those instruments.

This Act creates specific statutory duties, a consent right for applicants and rights affecting compensation calculation. Key duties and rights are as follows, with section references.

Duties

• Duty not to suffer or permit building work without consent. Section 6 imposes a duty on any person to obtain the Commissioner’s consent before allowing building work on land to which the Act applies. The duty is phrased in negative terms ("shall not, without the consent ... suffer or permit") and applies while the Act covers the land (s 4).

• Duty to apply in the prescribed manner. Applicants must make applications for consent in the "prescribed manner" and include "prescribed particulars" (s 8(1)). The Act delegates detail to regulations or subsidiary instruments by reference.

• Duty to comply with conditions. If consent is granted subject to conditions, those conditions are binding on the person and on successors in title or occupancy (s 8(6)). Failure to comply with a condition is treated as work carried out without consent (s 8(4)).

• Duty of proof in compensation proceedings. Where compensation is claimed for land acquired by the Commissioner, the claimant bears the burden of proving that any building work excluded by s 7 was carried out with the Commissioner’s consent (s 8(5)).

Rights

• Right to apply for consent. Any person may apply for the Commissioner’s consent to carry out building work on land to which the Act applies; the Act sets the procedural pathway for such applications (s 8(1)).

• Presumed consent after 30 days. If the Commissioner does not grant, refuse, or grant consent subject to conditions within 30 days after receipt of an application, consent is presumed (s 8(2)-(3)). That provides applicants with a de facto default right to proceed unless the Commissioner acts within the statutory window.

• Right to have the Plan deposited and amended. The Commissioner must deposit the Plan and may amend it; these deposited instruments are publicly filed with the Registrar‑General under the Registration of Deeds Act 1935 (s 5(1)-(2)). This creates a public record which parties may consult to determine whether the Act applies to particular land.

• Right to arrangements with Councils. The Commissioner may enter arrangements with Councils to facilitate applications, and such arrangements have statutory effect (s 9). For an applicant, local council arrangements may create operational avenues for lodging or processing applications.

Compensation rights and limitations

• Limitation on compensation for unauthorised work. Section 7 explicitly removes from the compensation calculus any value of building work carried out without consent and any enhancement in value arising from that work. This modifies the usual compensation entitlement by statutory direction "Notwithstanding any other Act or law," making it a binding rule for acquisition cases.

Delegated administrative powers

• Ministerial discretion to narrow "building work." The Minister may declare by Gazette that particular work is not "building work" for the purpose of the Act, and may amend or revoke such declarations (s 3(2)). This gives the executive capacity to narrow the scope of the duty not to permit building work without consent.

• Regulation‑making power. The Governor may make regulations necessary or expedient to give effect to the powers and objects of the Act (s 10). This supplies the formal legal route for defining prescribed particulars, application form, fees (if any), procedures and other administrative machinery.

These duties and rights create a regime where the primary immediate duty is pre‑clearance of building work in a mapped area, backed by a statutory reduction in compensation for unauthorised work, and with administrative detail deferred to regulations and Ministerial/Governor instruments.

The Act frames non‑compliance by means of civil consequence and by altering rights to compensation; it does not itself set out criminal penalties in the text provided. Enforcement occurs through administrative decision‑making, evidential rules in compensation proceedings and statutory deeming.

• Prohibition and administrative control. Section 6 provides the operative prohibition: "A person shall not, without the consent of the Commissioner, suffer or permit any building work to be carried out on land to which this Act applies." The Act does not in its text specify a distinct criminal penalty such as a fine or imprisonment; rather, enforcement manifests primarily through the statutory consequences attached to unauthorised work (see s 7).

• Compensation consequences. The principal sanction for carrying out building work without consent is economic: s 7 states that the value of such work and any enhancement in value "shall not be taken into account in fixing the compensation payable in respect of land acquired by the Commissioner for road widening purposes," and that this applies "Notwithstanding any other Act or law." The effect is to decrease the quantum of compensation payable when the Commissioner acquires land. This is an express statutory exclusion rather than a discretionary mitigation, and it applies irrespective of other statutory compensation rules.

• Evidential allocation and burden. Section 8(5) places the evidential onus on a claimant in compensation proceedings to prove that any building work referred to in s 7 was carried out with the Commissioner’s consent. This shifts the risk of non‑recovery to the claimant when acquisition occurs.

• Deeming of breaches. Section 8(4) deems any building work carried in contravention of the Act, or in breach of a consent condition, to have been carried out without the Commissioner’s consent. That deeming provision streamlines enforcement in compensation proceedings by simplifying factual determinations: a breach or contravention is treated as the statutorily relevant state of affairs.

• Administrative timelines and deemed consent. Section 8(2)-(3) obliges the Commissioner to determine an application within 30 days by granting, refusing or imposing conditions; if the Commissioner does not do so, consent is presumed. This timeline is an enforcement/administrative governance mechanism that encourages decision making within a finite period, but it also creates a procedural route by which applicants may proceed absent Commissioner action.

• Regulatory and executive instruments. The Governor’s regulation‑making power (s 10) and the Minister’s capacity to declare non‑building work by Gazette notice (s 3(2)) create further enforcement apparatuses that can be used to implement penalties, fees or processes, but the Act itself does not detail those instruments. Any regulatory enforcement mechanisms would therefore derive from regulations made under s 10 or from other Acts interacting with this one.

• Council arrangements. Section 9 allows the Commissioner to enter into arrangements with Councils for facilitating applications, and those arrangements have statutory effect. That provides an enforcement and administrative channel at the local government level, and may be the operational locus for receiving, processing or monitoring compliance with consents.

In sum, the Act enforces compliance primarily by altering compensation entitlements and by deeming unauthorised work to be excluded from compensation; it does not itself articulate criminal penalties in the provided text. Enforcement relies on administrative decision making, evidential burdens in acquisition proceedings and subsidiary regulations or arrangements that may be created under the Act’s delegated powers.

The Act expressly imports, modifies and interacts with several other statutory instruments named in the text. The interplay is both definitional and operational.

• Building Act 1970. The Act defines "building work" to include any work that is, for the time being, "building work" within the meaning of the Building Act 1970 (s 3(1)(a)). That means the substantive meaning of building work is derived from the Building Act as it stands at the relevant time. The Act complements the Building Act by imposing an additional layer of regulatory precondition (Commissioner’s consent) on top of whatever approvals are required under the Building Act.

• Registration of Deeds Act 1935. The Plan and any amendments or variations must be deposited with the Registrar‑General in the General Registry Office at Adelaide "pursuant to the provisions of the Registration of Deeds Act 1935" (s 5(2)). That creates a public filing requirement and frames the Plan as a recorded instrument in the land records system. The deposited Plan therefore interacts with land title and registry systems by being recorded in the General Registry Office.

• Highways Act 1926. The Commissioner referred to in the Act is the Commissioner of Highways appointed by or pursuant to the Highways Act 1926 (s 3(1)). Section 4(1a) explicitly provides that the Metropolitan Adelaide Road Widening Plan's application to land ceases when "a plan is deposited under section 27B of the Highways Act 1926 relating to that land" or when the Commissioner otherwise acquires the land for road widening (s 4(1a)). This creates a transition path: once the statutory acquisition processes under the Highways Act are engaged (notably the deposit under s 27B of that Act) the special regime of this Act no longer applies to that parcel. Section 4(2) also records that nothing in this Act limits the generality of the application of the Highways Act 1926, indicating that the two Acts operate alongside one another.

• Other Acts and "Notwithstanding" clause. Section 7 contains the clause "Notwithstanding any other Act or law, the value of any building work carried out in contravention of section 6 ... shall not be taken into account in fixing the compensation payable in respect of land acquired by the Commissioner for road widening purposes." That is an express statutory override, meaning that where there would otherwise be entitlement under some other Act or law to have such value considered in compensation, this Act displaces that entitlement for acquisition by the Commissioner for road widening purposes.

• Delegated instruments (Ministerial notices and Regulations). Section 3(2) allows the Minister to declare by Gazette notice that particular work is not "building work" for the purposes of this Act, and to amend or revoke such declarations by further notice. Section 10 vests the Governor with regulation‑making power "necessary or expedient for giving effect to the powers and objects of this Act." These delegated instruments interact with primary legislation by narrowing or expanding the Act’s reach and by providing detailed procedural and substantive provisions governing applications and compliance. The content of any such regulations or notices is not reproduced here; but the Act provides the legal channel for their issuance.

• Local government powers. Councils are defined in s 3(1). Under s 9 the Commissioner may enter into arrangements with Councils for the purposes of facilitating applications, and such arrangements "shall have effect as if they were enacted in this Act." That creates a statutory mechanism by which local government administrative processes may be integrated into the consent regime, and gives such arrangements statutory effect.

Overall, the Act operates through incorporation and interaction with other statutes: it imports definitional content from the Building Act 1970, it relies on the Registration of Deeds Act 1935 for public filing of the Plan, and it connects to the Highways Act 1926 for acquisition and the end point of this Act’s application to particular land. It also establishes delegated rulemaking and notice mechanisms through which other statutory instruments will shape operational detail.

The Act’s legislative history is recorded in the materials provided and shows a principal Act in 1972 and a substantive amendment in 1976, plus later editorial revision. The table and notes supplied identify the following milestones and specific provision changes.

• Principal Act. Metropolitan Adelaide Road Widening Plan Act 1972, No. 98, assented 9 November 1972, commencement 1 January 1974 (Gazette 1.11.1973 p2722).

• Amendment Act. Metropolitan Adelaide Road Widening Plan Act Amendment Act 1976, No. 56, assented 11 November 1976, commencement 1 May 1977 (Gazette 24.3.1977 p885). The 1976 Act made several textual amendments and a redesignation to s 3; it substituted the definition of "building work", inserted "land to which this Act applies", deleted "structure" and inserted s 3(2) authorising Ministerial declarations regarding what is not building work for the purposes of this Act, among other changes.

• Specific variations noted in the consolidation record. The legislative history notes state:

  • Section 2 was omitted under the Legislation Revision and Publication Act 2002 (no commencement date specified here).
  • Section 3 was redesignated as s 3(1) by 56/1976 s 3(d), effective 1.5.1977.
  • The definition of "building work" was substituted by 56/1976 s 3(a) (1.5.1977).
  • The insertion of "land to which this Act applies" in s 3 was effected by 56/1976 s 3(b) (1.5.1977).
  • Deletion of "structure" from definitions by 56/1976 s 3(c) (1.5.1977).
  • s 3(2) was inserted by 56/1976 s 3(d) (1.5.1977).
  • Section 4(1) was substituted by 56/1976 s 4 (1.5.1977).
  • Section 4(1a) was inserted by 56/1976 s 4 (1.5.1977).
  • Section 6 was amended by 56/1976 s 5(a) with certain paragraphs repealed by s 5(b) (1.5.1977).
  • Section 7 was amended by 56/1976 s 6 (1.5.1977).
  • Section 8(5) was substituted by 56/1976 s 7 (1.5.1977).

• Notes on consolidation. The legislative history indicates that prior history before 3 February 1976 appears in marginal notes and footnotes in a consolidation volume (The Public General Acts of South Australia 1837-1975, vol 7, p 254). The history provided here summarises principal entries and amendments up to the 1976 Act and notes the later omission of s 2 under the 2002 revision legislation.

The net result of the 1976 amendments was to refine definitions, add the explicit Ministerial power to declare certain works not to be building work for the Act’s purposes, and to clarify application and compensation mechanics. The later editorial omission of s 2 under the Legislation Revision and Publication Act 2002 appears to be an administrative consolidation change; the content of s 2 as omitted is not reproduced here.

This consolidation record is the authoritative legislative history contained in the source text supplied. No other amendment entries are recorded in the text beyond those listed in the "Principal Act and amendments" table and the specific "Provisions amended" listing.

The source text supplied contains no reported cases, no judicial determinations or litigation summaries related to the Metropolitan Adelaide Road Widening Plan Act 1972. The legislative extract’s "Notes" direct readers seeking "further information relating to the Act and subordinate legislation made under the Act" to the Index of South Australian Statutes or the official website (www.legislation.sa.gov.au), but the printed material here does not include any case citations, disputes, appeals, or judicial interpretations.

Consequently, from the materials provided there is no litigation history to summarise: no cases are named in the Act text, no decisions interpreting s 7, s 6, s 8(3) deemed consent or the scope of "building work" as imported from the Building Act 1970 are included. Users requiring case law or judicial interpretation should consult the indices and databases referenced in the Act’s notes or the public record at the Registrar‑General and the consolidated statute volumes named, but that material is outside the provided source extract.

The Act contains a number of drafting and practical features that create risk points for landowners, applicants and administrators. These are concrete mechanics to watch for; each statement below is tied to the relevant provision in the Act.

• Broad and potentially indeterminate spatial scope. The Act applies to land "shown on the Plan as possibly required for road widening and all land within six metres of the boundary of that land" (s 4(1)). The phrase "possibly required" imports a degree of contingency into what land is captured; a deposited Plan showing land labelled as possibly required will bring the entire mapped area and the six‑metre buffer within the consent regime. Practically, owners may find their land subject to the Act without a confirmed acquisition plan.

• Compulsory limitation on compensation for unauthorised work. Section 7 provides that the value of any building work done without consent, and any enhancement in value from that work, shall not be taken into account in fixing compensation if the Commissioner acquires the land. This is an overriding rule ("Notwithstanding any other Act or law") that can reduce the monetary recovery for owners after acquisition. Owners who undertake work without consent thereby risk losing the uplift in compensable value.

• Deeming consequences of condition breach. Section 8(4) deems building work carried in contravention of the Act or in breach of any condition of a consent to have been carried out without the Commissioner’s consent. A failure to comply with a condition therefore directly triggers the s 7 exclusion in acquisition cases, even where a formal consent had earlier been granted.

• Evidential onus on claimant. Section 8(5) places the burden on claimants in compensation proceedings to prove that building work referred to in s 7 was carried out with the Commissioner’s consent. That removes the normal procedural posture where the acquiring authority might bear responsibility to justify reductions in compensation; claimants face evidential hurdles.

• Ministerial carve‑outs can alter scope retroactively. Section 3(2) permits the Minister, by Gazette notice, to declare any work or class of work not to be "building work" for purposes of this Act, and to amend or revoke such declarations. The Ministerial power can therefore narrow the Act’s coverage by administrative notice; affected parties must monitor Gazette notices to determine ongoing coverage.

• Deemed consent if Commissioner fails to act. Section 8(3) provides that if the Commissioner does not act within 30 days the application is presumed granted. Applicants may rely on the deemed consent, but because s 8(4) deems breaches of conditions to be without consent and s 8(6) binds successors, an applicant reliant on deemed consent who later fails to meet conditions (if a condition is subsequently asserted) could face adverse compensation consequences. The Act does not in the provided text specify how subsequent identification or imposition of conditions interacts with the deemed consent; that operational tension is a practical risk.

• Local arrangements gain statutory effect. Section 9 allows Commissioner‑Council arrangements to "have effect as if they were enacted in this Act." Operationally, this means local administrative practices and agreements can take on statutory force. Applicants and owners must therefore check local arrangements as well as the Act and regulations to understand obligations and enforcement processes.

• Reliance on external definitions and instruments. The Act imports the Building Act 1970 definition of "building work" (s 3(1)(a)) and depends on deposit under s 27B of the Highways Act 1926 to terminate application to a parcel (s 4(1a)(a)). This interdependence means that shifts in the Building Act’s definitions, regulations under this Act, or practice under the Highways Act can change the Act’s practical effect on a given parcel.

• Lack of express criminal penalties in the text. The Act sets prohibitions and civil/economic consequences but does not in the supplied text specify fines or criminal penalties for breach of s 6. Enforcement therefore relies on the compensation exclusion, deeming provisions, and delegated regulations which may, or may not, create additional sanctions.

• Public notice reliance on registry deposit. The Act’s deposit requirement (s 5(2)) creates the public notice mechanism, but completeness of public knowledge depends on the Plan’s accuracy and on parties checking registry filings. The six‑metre buffer extends the zone beyond clearly mapped parcels; inadvertent non‑compliance is possible where a landowner does not review the deposited Plan.

Those features create a regime where failure to check the Plan, to obtain consent, to comply with conditions, or to monitor Gazette notices and local arrangements can produce significant financial and procedural consequences, particularly in acquisition and compensation contexts.

To operate within the Act’s mechanics and minimise enforcement or compensation risk, affected persons should follow the concrete steps and checks implied by the statute. Each step below is anchored to the relevant provision.

1. Determine whether the Act applies to the parcel. Consult the Metropolitan Adelaide Road Widening Plan deposited by the Commissioner with the Registrar‑General (s 5(2)) to see if the land is shown as "possibly required for road widening." Also check whether the parcel is within six metres of the boundary of any land shown on the Plan (s 4(1)). The Plan and any amendments are public filings at the General Registry Office pursuant to the Registration of Deeds Act 1935 (s 5(2)). Also verify whether the Act’s application has ceased for the parcel under s 4(1a) because a plan under s 27B of the Highways Act 1926 has been deposited for that land, or because the Commissioner has otherwise acquired the land for road widening.

2. Check the definition of "building work" and Ministerial notices. Determine whether the proposed works fall within "building work" as that term is defined in the Building Act 1970, and whether any class of work has been declared by the Minister under s 3(2) not to be building work for the purposes of this Act. Consult Gazette notices for any Ministerial declarations and consult the Building Act and any relevant regulations for the definition of building work.

3. Prepare and lodge the application in the prescribed manner. If the Act applies and the proposed works are building work, an application for the Commissioner’s consent must be made "in the prescribed manner" and contain "the prescribed particulars" (s 8(1)). Those procedural requirements will be set out in regulations or subsidiary instruments; check regulations made under s 10 for the prescribed form, required documents, fees (if any), service addresses and other procedural detail.

4. Observe the 30‑day decision window and deemed consent rule. The Commissioner must within 30 days of receipt of an application either grant consent, refuse it, or grant consent subject to such conditions as are contained therein (s 8(2)). If the Commissioner fails to take one of those steps within 30 days, consent is presumed (s 8(3)). Applicants should document the date of receipt by the Commissioner and maintain proof of delivery in order to rely on the deemed consent where relevant.

5. If consent is granted, comply strictly with any conditions. Any condition imposed under a consent is binding on the person granted the consent and on successors in title or occupancy (s 8(6)). A breach of any condition is deemed to be building work carried out without the Commissioner’s consent (s 8(4)), which triggers the s 7 compensation exclusion in acquisition cases. Ensure conditions are recorded, communicated to successors, and complied with over time.

6. Keep records to prove consent in potential acquisition proceedings. Section 8(5) places the onus upon a claimant in compensation proceedings to prove that building work referred to in s 7 was carried out with the Commissioner’s consent. Retain application materials, copies of the consent instrument, conditions and evidence of compliance, and any correspondence with the Commissioner, because those records will be critical evidence if the land is later acquired.

7. Monitor local Council arrangements and statutory instruments. The Commissioner may enter arrangements with Councils to facilitate applications and such arrangements "shall have effect as if they were enacted in this Act" (s 9). Check local council offices for any operational arrangements, application lodgement points or additional procedural requirements. Also monitor regulations made by the Governor under s 10 and any Gazette notices under s 3(2) that affect the scope of "building work."

8. Before undertaking any building work, consider the compensation risk. If there is any possibility that the Commissioner may later acquire the land for road widening, weigh the risk that unauthorised building work will be excluded from compensation under s 7. Where possible, obtain the Commissioner’s consent before undertaking work to preserve the claimant’s ability to have the value considered in any future compensation calculation.

9. Where in doubt, seek confirmation in writing. Given the Act’s evidential mechanics and the risk of a reduction in compensation, applicants and owners should obtain written consents and keep certified copies. Similarly, where the Commissioner has not acted within 30 days but conditions are later asserted, having written records will be essential to establishing the timeline and the nature of any deemed consent relied upon.

10. Coordinate with conveyancing and land registry processes. Because the Plan is deposited in the General Registry Office (s 5(2)) and because conditions are binding on successors in title (s 8(6)), ensure that conveyancing searches include the Plan deposit and that property contracts and title searches disclose any planning restrictions or consents so that purchasers are aware of obligations and potential compensation limitations.

Conformance with these procedures will minimise the risk that building work is treated as unauthorised under the Act and thereby excluded from compensation if the Commissioner later acquires the land for road widening purposes. The Act delegates procedural detail to regulations and to Ministerial/Governor and local arrangements; accordingly, compliance requires checking those subsidiary instruments in addition to the primary Act.
