Mental Health Tribunal Rules 2023

The instrument organises tribunal process around a small number of repeatable procedural concepts: written applications, receipt timing, hearing reports, register entries, limited adjunct applications (joinder, withdrawal, correction, review), and calculation of treatment order duration.

Written applications and structured information (rules 7-8)

• The Rules make "in writing" mandatory for applications to the Tribunal (rule 7) and then require specified identifying and contact details (rule 8(a)-(f)). When the applicant is not the subject of the application, the Rules expressly require the subject’s name and contact details (rule 8(c)). The Rules further require, where the subject receives treatment, the name of the treating designated mental health service or mental health and wellbeing service and the specific treating service (rule 8(d)-(e)). The Rules therefore formalise the intake data that the Tribunal will use for case management and registration.

Modes of lodging and receipt (rules 9 and 13)

• For certain high-stakes applications (authorisation to perform a course of electroconvulsive treatment under Parts 3.5 and related sections), the Rules require electronic lodgement (facsimile or other electronic communication) (rule 9(1)(a)). Other applications may be lodged by post, facsimile or other electronic communication (rule 9(1)(b)). Receipt is defined by reference to Tribunal registry opening hours: if the registry is open, the document is received at the time it is received; if not, it is treated as received the next business day the registry is open (rule 13(a)-(b)). Rule 9(2) confirms an application is lodged when received by the Tribunal.

Hearing reports (rules 14-16)

• A “hearing report” is a central procedural concept (defined in rule 5). For a defined list of “specified hearings” the treating psychiatrist or an authorised psychiatrist must give the Tribunal a hearing report at least two business days before the hearing (rule 14(1)-(2)). Specified hearings cover multiple Parts of the Act, including ECT, neurosurgery for mental illness, treatment order hearings, reviews of patient placement and transfer, security patient review hearings and interstate transfer hearings (rule 14(2)(a)-(k)), and any additional hearings the Rules Committee specifies by practice note (rule 14(2)(l)). The Rules set out the minimum content of hearing reports (rule 15) and require that reports be in the form specified in any relevant practice note (rule 16).

Registry and recordkeeping (rule 10)

• The register of proceedings established under section 356 of the Act must contain detailed items including the kind of proceeding, the person’s name and identifier, the treating service name, hearing date/place/mode, Tribunal members, copy of the initiating application, statutory basis for the hearing, the order made and any statement of reasons (rule 10(a)-(j)).

Adjunct applications and correction processes (rules 11, 12, 17-19)

• Joinder applications must be in writing with reasons (rule 11). A senior Tribunal member may order joinder (rule 12). Review of a principal registrar’s decision to reject an application (s 369 of the Act) must be in writing (rule 17). Leave to withdraw proceedings requires a written application (rule 18). Applications to correct an order or statement of reasons must be in writing, usually within 20 business days, and specify the alleged mistake and proposed correction if practicable (rule 19(a)-(d)).

Flexibility and discretion (rule 6 and rule 20)

• The Tribunal has an express dispensing power to depart from any Rule requirement either before or after the occasion for compliance arises (rule 6). The Tribunal also has discretion in calculating the period of a treatment order under section 193 of the Act, with the Rules expressly permitting calculation “in any manner it sees fit” (rule 20).

Delegation to practice notes

• Several features are explicitly left to practice notes issued by the Rules Committee: additional specified hearings for hearing reports, further required information in hearing reports, and the prescribed form of hearing reports (rules 14(2)(l), 15(1)(g), 16). This creates a two-tiered procedure: primary obligations are in the Rules, operational detail in practice notes.

Statutory anchoring and cross-references

• The Rules operate by reference to the Act and other legislation. They are made under s 391 of the Act (rule 2). The register provisions link to s 356 of the Act (rule 10 preamble). The Rules reference other statutory provisions and external Acts in their lists of specified hearings and definitions (for example the Sentencing Act 1991 reference in rule 14(2)(h) and the Health Records Act 2001 in the register note).

Collectively these concepts structure how the Tribunal receives, evaluates and records material required for making orders under the Act, and they set the minimum procedural obligations for clinicians, registrars and parties.

Primary actors affected by these Rules are identifiable from the Rules’ phrasing and the matters they require.

Persons who may initiate or be the subject of Tribunal proceedings

• People who apply to the Tribunal and persons who are the subject of applications are directly affected. The Rules require applications to include contact details and, where applicable, the treating service details (rule 8). The act of being the subject of a specified hearing triggers obligations to have a hearing report compiled and supplied (rule 14-15).

Treating clinicians and designated service authorised psychiatrists

• The Rules place operational burdens on psychiatrists and authorised psychiatrists. For specified hearings, the treating psychiatrist or , where treatment is in a designated mental health service , an authorised psychiatrist must provide a hearing report at least two business days before the hearing (rule 14(1)-(2)). The hearing report must cover clinical background, reasons for satisfaction when statutory satisfaction is required, current and proposed treatment, the person’s views and preferences and, where ECT is involved, proposed number and timing of ECT sessions and consent documentation where capacity is lacking (rules 15(1) and 15(2)).

Principal registrars and registry staff

• Registry processes are central. The Rules define when documents are treated as received depending on whether the registry is open (rule 13). The principal registrar has decision-making duties covered indirectly by these Rules (for example, rule 17 creates a written-review route of a principal registrar’s rejection of an application under s 368 of the Act). Registry staff must maintain the register content specified (rule 10).

Tribunal members and senior Tribunal members

• Senior Tribunal members can order joinder (rule 12). The register must record the name and class of each Tribunal member who constitutes the Tribunal for each proceeding (rule 10(f)). Members thereby must ensure recordkeeping corresponds to the Rules and that procedural steps such as joinder are made in compliance with written applications and reasons (rule 11-12).

Nominated support persons, guardians, carers, parents and decision-makers

• Hearing reports must include the person’s views and preferences and where required the views and preferences of persons with legal status in decision-making (guardian, carer, parent for persons under 16, DFFH Secretary where parental responsibility exists under a child protection order) (rule 15(1)(e)-(f)). For ECT applications involving persons without capacity, the Rules require inclusion of an instructional directive or the informed consent in writing of the person’s medical treatment decision maker and that decision-maker’s views (rule 15(2)(c)-(d)).

Designated mental health services and other mental health and wellbeing services

• The Rules require identification of whether the person is receiving treatment from a designated mental health service and, where relevant, the specific treating service (rules 8(d), 8(e), 10(c), 10(d)). This affects internal administrative processes at those services because the Tribunal expects and records specific service-level information.

Rules Committee and practice note authors

• The content and form of hearing reports and the list of additional hearings for which reports are required are delegated to practice notes issued by the Rules Committee (rules 14(2)(l), 15(1)(g), 16). The Rules Committee therefore has significant operational influence on day-to-day practice via practice notes.

Other agencies and laws

• Where the subject is a security patient or a person under sentencing law, the Rules explicitly bring in parts of other statutes (rule 14(2)(g)-(h)), so courts, corrections or forensic services and the DFFH (for child protection) are affected indirectly through their roles and information provision obligations when the Tribunal proceeds with these categories of case.

Secondary effects

• Lawyers, legal aid providers and advocates will adjust intake and preparation to satisfy the written-application and pre-hearing report requirements (rules 7-9, 14-16). Organisations that provide forms, IT systems and administrative support for applications and registry communication will need to align to the prescribed methods and practice notes.

Who does not appear to be a primary target

• The Rules do not create criminal sanctions or civil penalties in themselves, nor do they create substantive clinical standards beyond requiring documentation and reporting. Their principal effect is procedural; enforcement and substantive determinations remain governed by the Act and other primary legislation referenced in the Rules.

Overall, the Rules distribute procedural burdens primarily onto treating psychiatrists/authorised psychiatrists and registry functions, with applicants and service providers also obliged to supply specific identifying information and conform to lodging and timing rules.

The Rules impose a set of duties and enable certain Tribunal discretions. These are procedural duties required for the Tribunal to accept, list and determine matters under the Act. Rights in the Rules are mainly rights of procedural access (for example, review of rejected applications, right to apply to withdraw, right to seek correction).

Duties imposed on applicants and parties

• Written application requirement: An application to the Tribunal must be in writing (rule 7). This is a mandatory formality for all applications referred to section 367(a) of the Act.
• Minimum application content: Applications must contain the applicant’s name and postal or email address; where the person making the application is not the subject, the subject’s name and contact details; details of the treating service if the subject is receiving treatment; and details sufficient to identify the nature of the application (rule 8(a)-(f)).
• Methods of lodging: Certain high-stakes applications (authority to perform a course of electroconvulsive treatment under the Act’s listed sections) must be lodged by facsimile or other electronic communication (rule 9(1)(a)). Other applications may be lodged by post, facsimile or other electronic communication (rule 9(1)(b)). An application is lodged when received by the Tribunal (rule 9(2)).

Duties imposed on treating psychiatrists and authorised psychiatrists

• Pre-hearing report provision: For a defined set of hearings, the psychiatrist treating the person, or if the person is receiving care in a designated mental health service an authorised psychiatrist for that service, must give the Tribunal a hearing report at least two business days before the hearing (rule 14(1)-(2)).
• Content of hearing reports: A hearing report must include specified clinical and personal background, reasons where the psychiatrist is required by the Act to be satisfied of certain matters, details of current and proposed treatment, the person’s views and preferences (including alternative treatments and recovery outcomes), and where required the views of guardians, carers, parents (for those under 16) and the DFFH Secretary where parental responsibility exists (rule 15(1)(a)-(f)). For applications concerning ECT, additional required content is listed (rule 15(2)(a)-(d)).
• Form adherence: Hearing reports must be in the form specified in any practice note issued by the Rules Committee (rule 16).

Duties on Tribunal and registry staff

• Register maintenance: The register must contain detailed items for each proceeding (rule 10(a)-(j)). This creates a recordkeeping duty for registry staff and Tribunal members to ensure entries conform.
• Receipt timing rules: Registry staff must apply the receipt rules: documents received when the registry is open are taken as received on that day and time; otherwise they are treated as received on the next open day (rule 13(a)-(b)).
• Consideration of joinder and corrections: The Tribunal must consider written joinder applications that specify reasons (rule 11) and may join persons as parties via a senior Tribunal member (rule 12). Correction applications must be handled per rule 19, including a presumptive 20-business-day limit for bringing correction applications unless special circumstances exist (rule 19(b)).

Rights and procedures for applicants and parties

• Right to seek review of a registrar’s rejection: An application to review a principal registrar’s decision to reject an application under s 368 of the Act must be in writing (rule 17).
• Right to seek leave to withdraw: An application under s 370 to seek leave to withdraw proceedings must be in writing (rule 18).
• Right to apply for correction of orders or statements of reasons: Applications under s 381(2)(b) must be in writing, set out reasons for the claimed mistake or defect and, if practicable, state the proposed correction (rule 19(a), (c), (d)). A time guidance of 20 business days applies unless special circumstances exist (rule 19(b)).

Tribunal discretions and procedural safeguards

• Dispensing power: The Tribunal may dispense with compliance with any requirement of the Rules, before or after the occasion for compliance arises (rule 6). This is a broad procedural safeguard that allows the Tribunal to waive technical non-compliance within its discretion.
• Calculation of treatment order duration: For the purposes of section 193 of the Act, the Tribunal may calculate the period of the treatment order in any manner it sees fit (rule 20). This leaves substantive flexibility to the Tribunal in expressing the duration of treatment orders.

Delegated procedural detail

• Practice notes: The Rules permit the Rules Committee to specify the form and additional required contents of hearing reports and to name other hearings for which reports are required (rules 14(2)(l), 15(1)(g), 16). Parties must therefore comply with practice notes once issued.

What the Rules do not do (important negative duties)

• The Rules do not create substantive clinical thresholds or replace statutory requirements in the Act. They do not, in themselves, create new offences, civil penalties or enforcement sanctions; instead they provide the procedural framework for Tribunal operations. Any enforcement of non-compliance would be via the Tribunal’s procedural powers (for example, dispensing under rule 6) or the Act’s statutory enforcement mechanisms where relevant.

In short, the Rules create mandatory procedural duties for applicants, treating psychiatrists/authorised psychiatrists and registry/Tribunal staff, confer rights to seek review, withdrawal and correction within prescribed formats and timeframes, and embed substantial discretion for the Tribunal to dispense with compliance and to calculate treatment order durations.

The Rules are procedural and administrative in nature; they do not specify criminal offences or express monetary penalties within the text of the Statutory Rule. The document therefore relies on the Act and the Tribunal’s procedural powers to manage compliance and correct procedural defects.

Absence of express penalties in the Rules

• The Rules do not create penalties, fines or criminal offences. There are no penalty provisions attached to contraventions of the Rules themselves in the text provided. Consequently, non-compliance with the Rules does not appear, on the face of the Rules, to produce standalone statutory penalties.

Enforcement mechanisms contained in the Rules

• Dispensing with compliance: The primary enforcement-style mechanism in the Rules is the Tribunal’s express discretion to dispense with compliance with any of the requirements (rule 6). This is both a procedural gatekeeping and remedial power. It allows the Tribunal to regularise or excuse non-compliance (for example, late documents, imperfect forms or variance from prescribed report content). The Rule expressly permits dispensing before or after the occasion for compliance arises.
• Receipt and filing rules: The receipt provisions (rule 13) establish clear, administrable rules for when documents are taken to be received by the Tribunal. These rules have process-enforcement effect: parties who rely on post or electronic transmission can know the operative date of lodgement. Administrative consequences for missing deadlines derive from these timing rules even if no explicit penalty is stated.

Tribunal decision pathways and corrective procedures

• Review of registrar decision: The Rules require that review of a principal registrar’s decision to reject an application be made in writing (rule 17). That pathway gives an applicant a procedural remedy to challenge registry-level gatekeeping decisions.
• Correction applications: The Rules provide a process for correcting orders or statements of reasons (rule 19), including a presumptive 20-business-day time limit and particular content requirements. This is a procedural remediation route to correct clerical, technical or other defects captured by section 381(1) of the Act.
• Withdrawal of proceedings: An application under section 370 to seek leave to withdraw must be in writing (rule 18), supplying a formal process by which proceedings can be discontinued with Tribunal oversight.

Interaction with the Act’s enforcement and substantive provisions

• The Rules operate as procedural instruments made under the Act (rule 2). Any substantive consequences for failing to comply with statutory obligations in the Act (for example, clinical obligations, consent regimes, capacity determinations) will continue to be governed by the Act. The Rules do not supplant the Act’s enforcement or sanctioning provisions. Where the Act requires particular satisfaction of matters or documentation, the Rules prescribe how the Tribunal expects that material to be presented (rule 15(1)(b)) and the Tribunal retains discretion whether to accept and proceed dependent on compliance and the Tribunal’s own statutory powers.

Practical enforcement implications

• Because there are no express fines or offences in the Rules, enforcement will be primarily administrative and adjudicative: the Tribunal can refuse to accept an application that does not meet statutory or Rule-based requirements (subject to review under rule 17), may decline to admit documents or evidence for failing to comply with practice note forms or timing (subject also to rule 6 dispensing), and will exercise its remedial correctives through orders (including corrections under rule 19).
• The practical sanction for non-compliance is therefore likely to be delay, rejection, exclusion of material, or the Tribunal exercising its discretion in ways that may be adverse to the non-complying party, rather than a monetary penalty or criminal sanction imposed under these Rules.

Recordkeeping as indirect enforcement

• The register requirements (rule 10) operate as an accountability mechanism: the Tribunal must record the statutory basis for a hearing, the order made and the statement of reasons. Accurate entries facilitate oversight and any subsequent reviews or corrections and thus indirectly enforce procedural integrity.

In summary, enforcement under these Rules is administrative and discretionary. The principal instruments for managing and remedying non-compliance are the Tribunal’s dispensing power (rule 6), the written-review pathways (rules 17-19), registry receipt rules (rule 13) and the register’s recordkeeping requirements (rule 10). Where substantive penalties or offences are relevant, those arise under the Act or other primary legislation, not this Statutory Rule.

The Rules are explicitly framed as subsidiary to the Mental Health and Wellbeing Act 2022 (the Act). They also reference and interconnect with other statutes and regulatory frameworks. The instrument both relies on statutory definitions from other laws and imports statutory categories for procedural application.

Primary statutory relationship , the Act

• The Rules are made under section 391 of the Act (rule 2) and implement procedural parts of the Act by reference. Specific Rule provisions are expressly for the purposes of particular sections of the Act. For example:
  • Form of application is required "for the purposes of section 367(a) of the Act" (rule 7).
  • Information required in an application is "for the purposes of section 367(b) of the Act" (rule 8).
  • The register provisions are "for the purposes of section 356 of the Act" (rule 10).
  • The list of specified hearings for which hearing reports are required cross-references multiple Parts and Divisions of the Act (rule 14(2) subparagraphs).
  • Calculation of treatment order duration is "for the purposes of section 193 of the Act" (rule 20).

Cross-references to other Acts and instruments

• Health Records Act 2001: The note to rule 10(b) directs that "identifier" has the same meaning as in the Health Records Act 2001 (see s 3(1) of the Act). That means the register will contain an identifier compliant with the Health Records Act definition and implicates obligations and privacy principles under health records law when handling identifiers in the register.
• Sentencing Act 1991: Rule 14(2)(h) brings in hearings under Part 10.3 of the Act that require determining whether criteria in s 94B(1)(c) of the Sentencing Act 1991 apply to a security patient subject to a court secure treatment order. This situates the Tribunal’s procedural rules adjacent to sentencing law for forensic patients.
• Subordinate Legislation Act 1994: The endnotes state the Rules will sunset on 16 August 2033 pursuant to the Subordinate Legislation Act 1994 (endnote 1). That introduces an outer time limit for these Rules absent re-making or extension.
• Interpretation of Legislation Act 1984 (ILA): The endnotes summarise how the ILA affects interpretation, including that headings, notes, examples and punctuation in Statutory Rules made after 1 January 2001 form part of the rule (endnote 1, ILA commentary). This affects how the Rules’ notes and headings are to be read legally.
• Other parts of primary law referenced within the Act: The list of specified hearings includes references to multiple Parts and Divisions of the Act (e.g., Parts 3.5, 3.6, 4.5, 4.6, 4.8, 10.2-10.6, 13.3). The Rules operate only where the Act provides the substantive power to hold the hearing; the Rules do not create those substantive powers.

Delegation to practice notes and the Rules Committee

• The Rules explicitly allow the Rules Committee to issue practice notes that set the form of hearing reports and may identify additional hearings for which reports are required (rules 14(2)(l), 15(1)(g), 16). The Rules Committee was established by section 389 of the Act (endnote 1). This creates an operational link between the statutory Rules and practice-level guidance that can be updated more frequently, but that practice guidance will be subordinate to the Act and to the Statutory Rules.

Privacy and recordkeeping intersection

• Because the register must contain identifiers and treatment-service details (rule 10), the handling of that information engages privacy and health-records legislation. The Rules themselves do not set privacy safeguards; the requirement to include identifiers signals that registry operations must comply with the Health Records Act 2001 and other privacy obligations relevant to health information.

Interface with Tribunal’s statutory powers and court practice

• The Rules interact with the Tribunal’s powers under the Act to admit or reject applications and maintain procedural fairness. For example, the requirement that correction applications specify the error and proposed correction (rule 19) must be read together with section 381 of the Act. The Rules provide forms and timing for work that otherwise would be governed by the Act’s general hearing and review provisions.

Operational implications for other agencies

• The DFFH Secretary is identified in rule 15(1)(f)(iv) as a person whose views and preferences must be included in hearing reports when that Secretary has parental responsibility under a relevant child protection order. That cross-references child protection processes and information flows between health services, the Tribunal and the Department of Families, Fairness and Housing (or relevant successor).

In sum, the Rules are procedural instruments that operate as an overlay to the Act and interact with other primary statutes by importing definitions, referencing statutory criteria and relying on practice notes to implement detail. Compliance therefore requires attention not only to the Rules’ text but to the Act’s substantive requirements, the Health Records Act privacy obligations, the Sentencing Act where forensic patients are involved, and the Rules Committee’s practice notes.

The Rules provide a short, explicit amendment and provenance record in the endnotes and the body text.

Origin and making

• The Rules were made by the Rules Committee established by section 389 of the Mental Health and Wellbeing Act 2022 (endnote 1). They were made on 16 August 2023 (endnote 1) and came into operation on 1 September 2023 (rule 3 and endnote 1). The Rules are Version No. 001 as at 1 September 2023 (title page).

Revocation of prior rules

• The Mental Health Tribunal Rules 2014 are expressly revoked by rule 4. The endnotes confirm that Rule 4 references S.R. No. 89/2014 (explanatory details, 3.1).

Amendments since making

• There are no amendments to the Mental Health Tribunal Rules 2023 recorded in the table of amendments attached to the instrument: endnote 2 states, “There are no amendments made to the Mental Health Tribunal Rules 2023 by statutory rules, subordinate instruments and Acts.” That means the Rules as published represent the initial and only version to date (Version No. 001).

Sunset provision

• The endnotes advise that the Rules will sunset 10 years after the day of making on 16 August 2033, referencing section 5 of the Subordinate Legislation Act 1994 (endnote 1). Unless re-made, remade with amendments, or otherwise extended, the Rules will expire on that date.

Interpretive law changes and style

• The endnotes include a note on the Interpretation of Legislation Act 1984 (ILA) and state that style changes authorised by section 54A of the ILA apply (endnote 1). The explanatory details mention that as from 1 January 2001, amendments to s 36 of the ILA have specified effects for headings, examples, punctuation and provision numbering; this is an interpretive note rather than an amendment history but forms part of the statutory interpretive backdrop.

Practice notes and delegated changes

• The Rules delegate substantive form and content adjustments to practice notes issued by the Rules Committee (rules 14(2)(l), 15(1)(g), 16). Practice notes are not Statutory Rules. They do not appear in the Rules’ amendment history, but they are a mechanism by which procedural detail may be changed administratively without amending the Statutory Rule.

Version control and public access

• The title page lists Version No. 001 and a Version as at 1 September 2023, indicating that subsequent versions would be published with a new version number and “as at” date. The endnotes direct readers to www.legislation.vic.gov.au for current versions of legislation and up-to-date legislative information (endnote 1).

Practical implications of amendment history

• The immediate revocation of the 2014 Rules and replacement by the 2023 Rules means that courts, practitioners and services must migrate to the new procedural requirements and practice note regime as at 1 September 2023. The absence of any subsequent statutory amendments recorded in the table of amendments indicates that practitioners should check for practice notes and registry directions, rather than expecting statutory amendments, when seeking recent procedural updates.

In short, the amendment history is concise: the 2014 Rules were revoked and replaced by the 2023 Rules created by the Rules Committee on 16 August 2023, in force 1 September 2023, with no further statutory amendments recorded and a statutory sunset in August 2033.

The Rules do not contain any citations of judgments, nor do they refer to any litigation that has interpreted their provisions. The instrument and its endnotes make no mention of case law. The "Litigation history" section therefore is necessarily short and descriptive based on the source.

No reported cases referenced in the Rules

• The text of the Mental Health Tribunal Rules 2023 contains no references to decisions, authorities or judicial interpretations. There are no named cases in the Rules, nor are there notes indicating that particular provisions have been the subject of litigation.

No litigation recorded in endnotes

• The Endnotes (parts 2 and 3) list no amendments and provide explanatory details; they do not record any litigation or judicial consideration of these Rules as of Version No. 001. Endnote 2 explicitly records that there are no amendments made to the Rules by statutory rules, subordinate instruments and Acts , not a litigation note, but an indicator that the instrument is new and unamended.

Practical consequences for practitioners

• Because there is no litigation history referenced in the instrument, practitioners cannot rely on precedent to interpret ambiguous Rule provisions. Interpretive guidance will have to be drawn from:
  • The Rules’ text itself (for example precise wording of rules 6, 14-16, 19 and 20).
  • The Act: sections referenced in the Rules (for example s 356 register, s 367 application requirements, s 193 on treatment order duration) remain the primary statutory context.
  • The Rules Committee’s practice notes: the Rules explicitly allow practice notes to define forms and additional content. Practice notes may provide administrative guidance but will not be authoritative law in the way that judicial interpretation is.
  • Future tribunal decisions and any judicial review decisions that interpret the Act and the Rules where disputes arise about procedural fairness, dispensing with compliance, or adequacy of hearing reports.

Potential for future litigation

• The Rules create several areas where parties might seek judicial review of Tribunal decisions on procedural grounds: for example, refusal to accept an application for want of compliance with rule 8, rejection of a late hearing report where rule 14 timing was not met, or a decision to dispense with compliance under rule 6 in circumstances that materially prejudice a party. The Rules’ lack of explicit penalty provisions and their grant of wide discretion to the Tribunal (rule 6 and rule 20) may be the subject of future litigation where questions of procedural fairness, jurisdictional error or unreasonable exercise of discretion arise. These are theoretical possibilities; no cases are cited in the source.

Summary

• As at Version No. 001, there is no litigation history recorded in the source materials. Practitioners must therefore rely on the Rules, the Act, practice notes and general administrative law principles pending any developing case law.

The Rules are tightly worded and create a number of practical traps for parties, clinicians and registries. These are not speculative policy critiques; they follow from the Rules’ text and the way the Rules allocate procedural obligations and discretions.

Timing and two-business-day hearing report requirement (rule 14(1))

• For a range of specified hearings the treating psychiatrist or authorised psychiatrist must give a hearing report at least two business days before the hearing (rule 14(1)-(2)). The "business days" metric interacts with registry opening hours and public holidays. Late reports risk procedural prejudice or listing delays. Because the Rule specifies the author (treating psychiatrist or authorised psychiatrist for a designated service), substitution or delegation could raise compliance issues where staffing or on-call arrangements are strained.

Narrow lodgement method for ECT applications (rule 9(1)(a))

• Applications under sections 99, 104, 109 or 114 of the Act for authority to perform a course of electroconvulsive treatment must be lodged by facsimile or other electronic communication (rule 9(1)(a)). Unlike other applications (which may be lodged by post, facsimile or other electronic communication under rule 9(1)(b)), postal lodgement is excluded for ECT applications. Practitioners who rely on postal filing without checking may inadvertently fail to lodge an ECT application properly. The Tribunal’s dispensing power (rule 6) can cure some defects, but reliance on that power is at the Tribunal’s discretion.

Form and practice-note dependence (rules 15(1)(g), 16)

• Hearing reports must contain specified content (rule 15) and must be in the form specified in any practice note issued by the Rules Committee (rule 16). Because the practice note sets form and additional content, compliance requires checking the current practice note. Failure to use the required form could be treated as non-compliance even if the substantive information is provided.

Receipt timing tied to registry opening hours (rule 13)

• A document received when the registry is closed is taken to be received on the next day the registry is open for business (rule 13(b)). For deadline-sensitive filings, reliance on electronic delivery after hours without an explicit receipt acknowledgement could mean missed deadlines. Rule 9(2) confirms an application is lodged when received by the Tribunal, not when sent.

Correction time limit and "special circumstances" proviso (rule 19(b))

• Correction applications must, unless special circumstances exist, be made within 20 business days of the order or reasons being given to the person (rule 19(b)). The undefined "special circumstances" exception will require Tribunal discretion to accept late correction applications. Practitioners should therefore act promptly on received orders/statements of reasons.

Wide dispensing power (rule 6)

• The Tribunal may dispense with compliance with any Rule requirement before or after the occasion for compliance arises. While this provides flexibility and a safety valve, it also creates uncertainty: parties cannot assume a late document will be accepted. Reliance on the dispensing power as an operational plan is risky because it may not be exercised in a party’s favour.

Joinder confined to senior Tribunal member (rules 11-12)

• Applications to be joined as a party must be in writing and specify reasons (rule 11). A senior Tribunal member may join a person as a party (rule 12). If the application is urgent and the person who can grant joinder is unavailable, delay may ensue. The Rules do not elaborate on procedural timelines for deciding joinder applications.

Scope of the “specified hearing” list (rule 14(2))

• The list of specified hearings is detailed and wide-ranging, covering ECT, neurosurgery, treatment order hearings, variations, revocations, transfer reviews, security patient criteria, leave of absence reviews, take-to-another-service directions, interstate transfers and other hearings as specified by practice note (rule 14(2)(a)-(l)). Missing a hearing-report requirement because a hearing is not obviously within these categories, or because a practice note later adds a hearing to the list, is a practical risk.

Evidence and consent documentation for ECT (rule 15(2)(c)-(d))

• For ECT applications where the person lacks capacity, the hearing report must attach the instructional directive or the informed consent in writing from the person’s medical treatment decision maker and include that person’s views (rule 15(2)(c)-(d)). Failure to include these documents may expose the application to rejection or delay.

Register entries and privacy (rule 10 and note)

• The register must include an identifier as defined under the Health Records Act 2001 (rule 10(b) note). Registry staff must ensure appropriate privacy safeguards under health records law when recording and storing identifiers. Practitioners and services must ensure consent and information governance processes for sharing identifiers with the Tribunal.

Formality of procedural adjuncts (rules 17-19)

• Reviews of principal registrar’s rejections, leave to withdraw and correction applications must be in writing (rules 17-18 and 19(a)). Oral requests or informal email exchanges may not be treated as compliant applications; practitioners must ensure formal written filings.

Treatment-order duration drafting flexibility (rule 20)

• The Tribunal may calculate the period of a treatment order "in any manner it sees fit" (rule 20). That gives the Tribunal drafting flexibility but also creates uncertainty for parties wanting precise, standardised order templates. Practitioners should be ready to propose precise drafting to avoid unintended consequences around review dates or statutory triggers.

Practice notes as a moving target

• Because several substantive operational details are delegated to practice notes (rules 14(2)(l), 15(1)(g), 16), the Rules’ practical effect may change as practice notes are updated. Lawyers and clinicians must monitor the Rules Committee’s practice notes for current requirements.

Taken together, these "gotchas" underline the necessity of checking the Rules, current practice notes, registering receipt acknowledgements from the Tribunal and preparing hearing reports and applications in the specified forms, with close attention to timing and the identity of the person who must provide the material.

This section provides a practical compliance checklist and process map, grounded in specific rules. Follow the steps below and cross-check practice notes issued by the Rules Committee (rules 14(2)(l), 15(1)(g), 16).

1. Intake: Prepare a written application that meets rule 7 and rule 8

• Ensure the application is in writing (rule 7).
• Include the applicant’s name and postal or email address (rule 8(a)-(b)).
• If the applicant is not the subject, include the subject’s name and postal or email address (rule 8(c)(i)-(ii)).
• If the subject is receiving treatment, record the treating service name and the specific treating service, whether a designated mental health service or another mental health and wellbeing service (rule 8(d)-(e)).
• Provide details sufficient to identify the nature of the application (rule 8(f)). Attach supporting documents as required by the Act (for example, consent documentation for ECT matters per Act requirements and rule 15(2)).

2. Lodgement: Use the correct mode and obtain evidence of receipt (rule 9 and rule 13)

• For ECT authority applications (sections 99, 104, 109, 114 of the Act), lodge by facsimile or other electronic communication as required (rule 9(1)(a)). Do not rely on postal lodgement for these applications.
• For other applications, lodge by post, facsimile or other electronic communication (rule 9(1)(b)).
• Understand when an application is lodged: it is lodged when received by the Tribunal (rule 9(2)). Use delivery methods that produce a reliable received-by timestamp or a Tribunal acknowledgement.
• If filing near a deadline, remember the registry receipt rule: if the filing is received when the registry is closed, it is taken to be received on the next day the registry is open (rule 13(b)). Plan for after-hours submissions accordingly.

3. Prepare hearing reports where required (rules 14-16)

• Check whether the hearing is a “specified hearing” in rule 14(2). These include ECT, neurosurgery for mental illness, treatment orders for temporary treatment patients or treatment patients, inpatient treatment order variations, revocations, transfer reviews, security patient criteria reviews, leave of absence reviews, directions to take a security patient to another designated service, interstate transfer applications, and any hearing added by practice note (rule 14(2)(a)-(l)).
• Ensure the hearing report is provided at least two business days before the hearing and by the permitted author:
  • The psychiatrist treating the person (rule 14(1)(a)); or
  • If the person is receiving treatment from a designated mental health service, an authorised psychiatrist for that designated service (rule 14(1)(b)).
• Include mandatory content per rule 15(1): clinical and personal background; where the Act requires the psychiatrist to be satisfied of certain matters, record reasons for satisfaction; current and proposed treatment; the person’s views and preferences including beneficial alternatives and recovery outcomes; views or preferences expressed by the nominated support person (if any); and, where required by the Act, the views of guardians, carers, parents (if under 16) and the DFFH Secretary when parental responsibility exists under a child protection order (rule 15(1)(a)-(f)).
• For ECT hearings provide the additional content required by rule 15(2): proposed number of ECT treatments, proposed completion date, and where the adult or young person lacks capacity, the instructional directive or medical treatment decision maker’s written informed consent and views (rule 15(2)(a)-(d)).
• Use the form prescribed by the relevant practice note (rule 16). Before filing, obtain and use the latest practice note form.

4. Manage registry and recordkeeping obligations (rule 10)

• Ensure the registry entry will include the kind of proceeding, the person’s name and identifier (as defined in the Health Records Act 2001, rule 10 note), the treating service name, hearing particulars (date, place, mode), names and classes of Tribunal members for the proceeding, a copy of the initiating application, statutory basis for the hearing, the order made and any statement of reasons (rule 10(a)-(j)).
• For any transmission of identifiers, follow applicable privacy and health-records obligations; consult the Health Records Act 2001 for handling and security requirements because "identifier" is defined by reference thereto (rule 10 note).

5. Deal with joinder, withdrawal and correction formally (rules 11, 12, 17-19)

• Joinder: Prepare a written application specifying reasons why joinder is desirable (rule 11). File the application and be ready to show why a senior Tribunal member should exercise joinder power (rule 12).
• Review of principal registrar rejection: If the principal registrar rejects an application under s 368 of the Act, file a written application under rule 17 for review under s 369.
• Withdrawal: If seeking leave to withdraw proceedings under s 370, make the application in writing (rule 18).
• Correction: If an order or statement of reasons contains a mistake, error or defect, file a written correction application under rule 19 that sets out the reasons and, if practicable, the details of the proposed correction. Observe the presumptive 20-business-day time limit from service of the order or statement of reasons, unless "special circumstances" exist that justify a later application (rule 19(a)-(d)).

6. Use the Tribunal’s dispensing power cautiously (rule 6)

• If an application or report cannot comply with a Rule requirement, an application to the Tribunal to dispense with compliance may be made. Remember the power is discretionary and may be exercised before or after the occasion for compliance arises (rule 6). If relying on this power, explain why dispensation is sought and provide any mitigating or remedial material.

7. Draft orders and proposed durations carefully (rule 20)

• Because the Tribunal may calculate the period of treatment orders "in any manner it sees fit" for the purposes of section 193, propose clear, unambiguous drafting when seeking orders to ensure that review dates, conditions and statutory triggers operate as intended (rule 20).

8. Monitor practice notes and registry directions

• The Rules delegate the form and additional required content for hearing reports and the identification of additional hearings to practice notes the Rules Committee issues (rules 14(2)(l), 15(1)(g), 16). Regularly check for updated practice notes and ensure the forms used are current.

9. Maintain audit trails and time-stamped records

• Given the receipt rule (rule 13) and the two-business-day hearing report rule (rule 14), maintain time-stamped proof of when documents were sent and when the Tribunal acknowledged receipt. This assists in disputes about compliance and supports review or correction applications under rule 19.

10. Cross-check obligations under the Act and other laws

• The Rules often operate "for the purposes of" a named section of the Act (for example, rules 7, 8, 10 and 20). Ensure that the content required by the Act (for example, capacity assessments and statutory satisfactions) is addressed in the hearing report where rule 15(1)(b) requires the psychiatrist to give reasons where the Act requires satisfaction of certain matters.
• For identifiers and privacy obligations, consult the Health Records Act 2001, which defines "identifier" (rule 10 note).
• For forensic patients, coordinate with the Sentencing Act 1991 where rule 14(2)(h) raises s 94B(1)(c) criteria.

Checklist summary (practical)

Following these steps and cross-referencing the text of rules 6, 7-9, 10, 11-12, 13-16, 17-20 will align practice to the procedural obligations set by the Mental Health Tribunal Rules 2023. Monitor the Rules Committee’s practice notes and ensure registry acknowledgements are retained to reduce procedural risk.
