#### 5 Constitution of Mental Health Commission 5 Constitution of Mental Health Commission > > (1) There is constituted by this Act a corporation with the corporate name of the Mental Health Commission of New South Wales. > > > (2) The Commission is not and does not represent the Crown. > > > (3) The Commission has the functions conferred or imposed on it by or under this or any other Act. > > > (4) The functions of the Commission are exerciseable by the Commissioner, and any act, matter or thing done in the name of, or on behalf of, the Commission by the Commissioner, or with the authority of the Commissioner, is taken to have been done by the Commission. > > > (5) (Repealed) > > **s 5:** Am 2015 No 15, Sch 3.42 \[2\].
