Mental Health and Wellbeing Regulations 2023

The Regulations implement several core legal concepts that the Act left to subordinate legislation. Each concept converts a general term in the Act into operational classes, duties or entities.

Designated mental health service: The Act’s definition is given content by Schedule 1, which lists specific hospitals and services (reg 16; Schedule 1). The Regulations include a mechanism for construing prior orders that refer to former service names to current names (reg 16A), thereby maintaining continuity for orders made under Chapter 4 of the Act.

Authorised mental health practitioner: The Act’s catch-all definition for authorised practitioners is narrowed for one class to persons who are employed or engaged as mental health clinicians in a designated mental health service and who have completed a named degree, Bachelor of Health Science (Mental Health) at Charles Sturt University (reg 15). This creates an education-based prescribed class for authorisation purposes.

Mental health and wellbeing professional: The Regulations specify who qualifies as prescribed classes of social workers and counsellors for the Act’s purposes. Social workers must be social workers in Victoria with a qualification that makes them eligible to join the Australian Association of Social Workers. Counsellors must hold a Bachelor or Master of Counselling and be members of one of two professional associations (reg 17).

Mental health and wellbeing service and service provider: The Regulations adopt negative definitions by excluding certain services from the Act’s definitions. For example, mental health and wellbeing advocacy services are explicitly not mental health and wellbeing services; emergency department services provided to persons who are not patients were excluded for a defined transitional period (reg 18). Many education-sector entities and workplace wellbeing providers are excluded from the definition of service provider to the extent the service is provided to enrolled children/students or staff (reg 19(1)(a)-(e), (g)).

Prescribed premises: The class of PARC services is prescribed as the relevant class for the “prescribed premises” element in the Act (reg 20). That classification triggers any premises-specific obligations in the Act.

Committee governance: The Mental Health Workforce Safety and Wellbeing Committee is established as a ministerially controlled advisory body with member terms, removal grounds, powers to adopt terms of reference, a minimum meeting frequency and detailed meeting procedure including proxy arrangements and quorum rules (regs 5-14). The Committee may invite expert non-members who do not vote (reg 10).

Information flows and electronic health system: The Regulations nominate particular bodies for the electronic health information system and data sharing: The Bouverie Centre at La Trobe University is a prescribed mental health and wellbeing service provider for s 727(4)(b) and (c) purposes (reg 27); Ambulance Service,Victoria is prescribed for s 728(2)(b) purposes (reg 27A). The Mental Health and Wellbeing Commission is authorised to use and disclose information in records in the custody of the Mental Health Complaints Commissioner for exercising Act-related powers (reg 26).

Tribunal remuneration and allowances: Schedule 2 sets remuneration as percentages of corresponding VCAT rates for different Tribunal member classes and specifies pro rata reduction for part-time appointments. Allowances are left to Health Secretary determination under departmental policy (reg 22; Schedule 2).

Notification duty: An authorised psychiatrist must notify the primary non-legal mental health advocacy service provider of specified variations to temporary treatment orders and treatment orders “as soon as practicable” (reg 21).

Statutory fees: The Regulations tie payment for examinations under the Act to the applicable Medicare item fee table under the Health Insurance Act 1973, thereby anchoring the rate to Commonwealth-determined medical service item fees (reg 28).

Taken together, these concepts translate the Act’s structural, definitional and procedural scaffolding into named entities, qualifications and administrative processes. Several clauses impose obligations in terms that are intentionally capacious, for example “as soon as practicable” (reg 21) and delegation of allowance determinations to the Health Secretary (reg 22), yielding implementation discretion.

The Regulations affect multiple institutional actors and categories of individuals by prescribing who counts as an authorised practitioner, which hospitals are designated, and which providers and premises attract statutory obligations.

Mental health clinicians and prospective authorised practitioners: Reg 15 prescribes a narrowly framed class of authorised practitioners defined by employment at a designated mental health service and by completion of the Bachelor of Health Science (Mental Health) at Charles Sturt University. Clinicians who meet that description are directly affected because the Act’s powers and duties for “authorised mental health practitioners” apply to them. Clinicians without that degree, or employed outside designated services, will be excluded from that prescribed class and must therefore rely on other parts of the Act or other prescribed classes for authorisation.

Designated mental health services: Public and private hospitals listed in Schedule 1 are directly subject to the Act’s obligations that attach to “designated mental health service”. The list includes metropolitan and regional health services such as Austin Health, Monash Health, Latrobe Regional Health, Mercy Hospitals Victoria Limited and Parkville Youth Mental Health and Wellbeing Service (Schedule 1; reg 16). Amendments (see Endnotes) have added services over time; parties that operate services must monitor Schedule 1 for changes.

Mental health and wellbeing professionals: Persons working as social workers or counsellors will be affected by reg 17 where the Act’s professional definition determines eligibility for certain roles or duties. The prescription requires membership eligibility in the Australian Association of Social Workers for social workers and membership of one of two professional associations for counsellors.

Schools and child services: Proprietors of registered schools, approved providers of approved education and care services, and approved children’s services are explicitly excluded from the Act’s definition of mental health and wellbeing service provider to the extent they are providing services to their enrolled children or staff (reg 19(1)(a)-(e)). That exclusion reduces regulatory compliance for many education-sector entities, but only to the specified extent.

Workplaces and workplace wellbeing providers: Providers offering workplace mental health and wellbeing support services are excluded to the extent the support is provided to members of the entity’s workforce or family members (reg 19(1)(g)). Employers that procure independent workplace wellbeing programs will typically not become regulated service providers under the Act for those specific services.

Primary non-legal mental health advocacy services: These services are recipients of notifications from authorised psychiatrists about variations to treatment orders (reg 21). They must therefore be able to receive and process such notifications and are affected operationally by the timing requirement.

Mental Health Workforce Safety and Wellbeing Committee members and the Department: The Health Secretary appoints members, sets member terms and can remove members under specified grounds (regs 5-9). The Committee will interact with departmental planning and the Victorian WorkCover Authority (reg 12(c)-(d)). The Committee’s ability to monitor workforce wellbeing data and provide advice links it closely to departmental decision-makers.

Mental Health Tribunal members and administration: The Schedule 2 percentage-based remuneration scheme affects recruitment and retention economics for Tribunal members, including psychiatrists, legal members and community members (reg 22; Schedule 2). Allowances are left to Health Secretary determinations.

Mental Health and Wellbeing Commission and other agencies: The Commission receives prescribed functions and may use historic records from the Mental Health Complaints Commissioner (reg 25, reg 26). Safer Care Victoria, The Bouverie Centre, and Ambulance Service,Victoria are named for particular Commission or electronic health system purposes (regs 25, 27, 27A), which affects inter-agency data access and obligations.

Prevention and Recovery Care (PARC) providers: Prescribed as the class of mental health and wellbeing service providers that count as “prescribed premises” (reg 20). Operators of PARC services need to treat obligations applicable to prescribed premises as applicable.

Stakeholders in tribunal and community visitor processes: Community visitors must be prepared for annual elections before 30 June (reg 23), and the Public Advocate administers election processes (reg 24). The Public Advocate’s functions affect election administration, notices, ballots and maintenance of community visitor lists.

Because the Regulations both extend and limit the reach of the Act, affected parties must map their status against the detailed lists and classes in the Regulations rather than rely solely on the Act’s text. The Regulations allocate decision-making authority to the Health Secretary and Public Advocate in multiple respects, and that administrative control will bear on how duties are interpreted and enforced.

The Regulations create obligations and confer powers in several areas. They are primarily administrative and definitional rather than punitive, and many duties bind public officials, health professionals and service providers.

Notification duty: Reg 21 imposes a duty on an authorised psychiatrist to ensure that the primary non-legal mental health advocacy service provider is notified of variations to a temporary treatment order or a treatment order under s 223(1) of the Act, and of variations under a chief psychiatrist direction under s 223(2). The duty requires notification “as soon as practicable” after the variation is made. This creates a time-sensitive communications obligation, but the Regulations do not prescribe a form, channel, or sanction for non-compliance.

Committee duties and rights: The Mental Health Workforce Safety and Wellbeing Committee must meet at least quarterly (reg 14(1)); it may adopt terms of reference (reg 11); it has functions to monitor workplace environment changes, workforce wellbeing data and to provide advice to the Health Secretary (reg 12). The Committee may invite experts to assist (non-voting) (reg 10) and may regulate its own procedure subject to its terms of reference (reg 13). The Committee’s rights include setting procedural rules and providing authoritative advice; its duties include regular monitoring and assisting the Department and the Victorian WorkCover Authority (reg 12).

Appointment and removal powers: The Health Secretary holds appointment, reappointment and removal powers for Committee members (regs 5-9). Removal grounds include inability to perform duties, unauthorised absences (two missed meetings in a financial year without joint chairs’ approval), and “improper conduct” (reg 8). The Health Secretary may also appoint replacements for the remainder of a term (reg 9).

Tribunal remuneration and allowances: Reg 22 prescribes that remuneration is a percentage of comparable VCAT member remuneration (Schedule 2), pro rata for part-time appointees; allowances are determined by the Health Secretary in accordance with departmental policy. The right to receive remuneration is therefore conditional on the VCAT benchmark and may change as VCAT rates change; the Health Secretary’s determination governs allowances.

Election and governance functions: Reg 23 imposes an annual election requirement before 30 June with at least one community visitor elected each year for two-year terms, commencing 1 July (reg 23(a)-(c)). Reg 24 gives the Public Advocate the right and duty to set election processes, appoint a returning officer, determine validity questions and maintain a list of community visitors.

Information use and disclosure: Reg 26 authorises the Commission to use and disclose information in the Mental Health Complaints Commissioner’s records to exercise powers under the Act or the repealed Mental Health Act 2014. Regs 27 and 27A prescribe particular service providers and emergency services for the purposes of the Act’s electronic health information system provisions. These grant the Commission and specified agencies rights to access, use and disclose information in certain contexts.

Definitions affecting rights and obligations: Narrow definitions prescribe who counts as an authorised practitioner, social worker or counsellor, and which entities are excluded as providers. These definitional choices allocate statutory rights and duties under the Act to particular persons and exclude others. For instance, school proprietors and approved education and care providers are not mental health and wellbeing service providers for services provided to their own enrolled students or staff (reg 19(1)(a)-(e)), which limits their regulatory obligations under the Act.

Examination payment: Reg 28 prescribes that payments for examinations under the Act are the applicable Medicare item fees under the Commonwealth Health Insurance Act 1973. This ties the right to claim payment to the Commonwealth’s Medicare schedule and aligns remuneration for medical examinations under the Act with Medicare item fees.

Discretionary powers: Several duties leave operational discretion to administrative officers: the joint chairs determine meeting procedures subject to terms of reference and Health Secretary directions (reg 14(2)); the Health Secretary determines allowances (reg 22(b)); the Public Advocate determines election procedures (reg 24(a)). Such discretion is a structural feature and allocates routine implementation choices to public officials.

The Regulations therefore create a mix of mandatory obligations, definitional rights to be treated as certain classes, procedural prescriptions and delegated discretionary powers. Where duties are time-sensitive but unspecified in detail, operational arrangements will determine the practical burden of compliance.

The Regulations themselves do not create express criminal sanctions or penalty schedules apart from the general administrative consequences and obligations they impose. Enforcement and compliance mechanisms in the instrument are therefore primarily administrative, reputational and operational, rather than criminal.

Administrative removal: The Health Secretary has express power to remove Committee members under specified grounds, incapacity to perform duties, absenteeism (two meetings missed without approval in a financial year), and improper conduct (reg 8). Removal is the primary enforcement mechanism for member compliance with attendance and conduct expectations.

Election supervision and validity determinations: The Public Advocate is empowered to determine election procedures for the Community Visitors Mental Health Board, appoint a returning officer, and determine questions about validity or regularity of votes (reg 24(a)-(c)). These functions give the Public Advocate an enforcement role in ensuring the procedural integrity of elections; remedies for irregularities would be administrative and internal.

Remuneration constraints and pro rata adjustments: The Regulations control Tribunal member remuneration by tying rates to VCAT benchmarks in Schedule 2 and providing for pro rata reduction for part-time appointments (reg 22(a); Schedule 2). These limits function as a financial control on Tribunal appointments; non-compliance with remuneration rules could attract payroll corrections or administrative consequences.

Information use authorisation: Reg 26 authorises the Mental Health and Wellbeing Commission to use and disclose records previously held by the Mental Health Complaints Commissioner. This is a positive grant rather than an enforcement tool, but misuse of data could attract oversight or regulatory action under health privacy or information legislation. The Regulations do not themselves set specific sanctions for misuse; existing privacy and health records frameworks would therefore be the relevant enforcement route.

Notification duty “as soon as practicable”: Reg 21 imposes an obligation on authorised psychiatrists to notify the primary non-legal mental health advocacy service after variations to treatment orders. The regulation does not prescribe a sanction for failure to notify; enforcement would therefore depend on professional regulation, departmental oversight, or civil or administrative review under the Act’s enforcement framework.

Delegated determinations and departmental policy: Allowances are determined by the Health Secretary under departmental policy (reg 22(b)). Non-compliance with departmental policy could produce administrative consequences for officials, but the Regulations do not specify penalties for non-adherence.

Interplay with other enforcement regimes: Where the Regulations refer to other Acts,Workplace Injury Rehabilitation and Compensation Act 2013 (Victorian WorkCover Authority), Health Insurance Act 1973 (Medicare items), Education and Care Services National Law (provider definitions),those other regimes bring their own enforcement and sanction frameworks to bear. For example, reg 28 ties examination payment to Commonwealth Medicare item fees; disputes over claimability will be resolved under Commonwealth Medicare arrangements, not the Regulations directly.

Sunset and amendment mechanisms: The Rules themselves have a 10-year statutory sunset noted in the Endnotes (s 5 of the Subordinate Legislation Act 1994), which provides a temporal limit to their effect absent re-making. Amendments are indicated in the Endnotes Table of Amendments, and the Regulations have been varied by subsequent S.R. instruments. Enforcement risk includes the need to track amendments to remain compliant.

In short, the Regulations structure rights, duties and administrative enforcement through appointment/removal powers, election controls, remuneration settings and information authorisations. They do not create a scheme of criminal penalties within the text; compliance enforcement will generally rely on administrative authority, professional regulation, departmental policy and existing privacy/health record statutes.

The Regulations operate as subordinate law under s 759 of the Mental Health and Wellbeing Act 2022 (reg 2), and they reference and interact with multiple other legislative instruments. The Regulations both import definitions from and make cross-references to other regimes, thereby creating a network of statutory interdependence.

Mental Health and Wellbeing Act 2022: The Regulations fill out many of the Act’s definitional and procedural gaps by prescribing classes and lists for terms used in the Act, for example, authorised mental health practitioner (reg 15), designated mental health services (reg 16; Schedule 1), and mental health and wellbeing professionals (reg 17). Several provisions explicitly operate “for the purposes” of specific sections of the Act, for example regs 15, 16, 17, 20, 22, 27, 27A and 28 reference particular Act sections.

Mental Health Act 2014 (repealed): The Regulations allow the Mental Health and Wellbeing Commission to use and disclose records in the custody of the Mental Health Complaints Commissioner for functions under the Act or the Mental Health Act 2014 “as in force immediately before its repeal” (reg 26). That provision recognises continuity with the previous regime and permits use of historic records under the new Act.

Health Insurance Act 1973 (Commonwealth): Reg 28 determines the payment for examinations by reference to Medicare item fees prescribed under s 4 of the Health Insurance Act 1973. That links the Regulations’ financial provision for medical examination payments to Commonwealth-determined Medicare fee structures and billing rules.

Workplace Injury Rehabilitation and Compensation Act 2013: The definition of Victorian WorkCover Authority refers to s 491(1) of that Act (reg 4 definition), and the Committee is required to assist the Department and the Victorian WorkCover Authority in communicating best practice and concerns for workforce wellbeing (reg 12(d)). That creates an operational liaison between mental health workforce wellbeing monitoring and workers compensation frameworks.

Children’s Services Act 1996 and Education and Care Services National Law (Victoria): Reg 19(2) imports statutory meanings from these laws for terms such as approved children’s service, approved provider and registered school, and excludes proprietors of registered schools and approved education providers from being mental health and wellbeing service providers, in specified circumstances. That narrows the application of the Act within the education sector and depends on those other statutes’ definitions.

Public Administration Act 2004: Reg 19(2)(b) includes persons employed under the Public Administration Act 2004 within the broad definition of “member of a workforce”, which expands the types of persons covered by the Regulations’ workplace-related definitions.

Subordinate Legislation and VCAT determinations: Reg 22 ties Tribunal remuneration to VCAT rates; therefore, changes to VCAT remuneration and relevant determinations will affect Tribunal pay under these Regulations. Allowances are tied to Health Secretary determinations and departmental policy, linking remuneration to executive administrative frameworks.

Electronic health information frameworks: Regs 27 and 27A prescribe particular entities as mental health and wellbeing service providers and emergency service providers for the purposes of electronic health information system provisions of the Act (s 727(4)(b) and (c); s 728(2)(b)). This intersects with the Act’s data sharing architecture and statutory powers to disclose and use health information, and will interact with privacy laws, health record statutes and any Commonwealth data sharing principles relevant to personal health information.

Subordinate legislation practice: The Endnotes note a 10-year sunset under the Subordinate Legislation Act 1994, which requires future review or re-making (Endnotes: General information). The Table of Amendments records subsequent S.R. Nos that altered or inserted provisions, evidencing statutory interaction by amendment mechanisms.

Overall, the Regulations are part of a layered regulatory ecosystem. They rely on definitions and operational standards from federal and state laws for payments, schooling and childcare definitions, workforce definitions, and tribunal remuneration baselines. Organisations operating at the intersection of these regimes must map their obligations across multiple statutes to understand the full regulatory effect.

The Regulations as published incorporate multiple amendments made by subsequent statutory rules. The Endnotes provide a Table of Amendments that records these changes and their commencement dates. The original Regulations were made on 22 August 2023 and commenced 1 September 2023 (Endnotes: General information; reg 3). They will sunset 10 years after making on 22 August 2033 (Endnotes).

The published amendment history identifies the following S.R. instruments that alter the Regulations:

• Mental Health and Wellbeing Amendment Regulations 2023, S.R. No. 92/2023, made 29 August 2023, commenced 1 September 2023. This instrument substituted reg 18 (as noted in the marginal note at reg 18) and made other immediate technical changes necessary for commencement.
• Mental Health and Wellbeing Amendment (Parkville Youth Mental Health and Wellbeing Service) Regulations 2025, S.R. No. 47/2025, made 11 June 2025, commenced 1 July 2025. The schedule notes the insertion of Parkville Youth Mental Health and Wellbeing Service in Schedule 1 (Sch. 1 amended by S.R. No. 47/2025 reg. 4).
• Mental Health and Wellbeing Amendment (Bayside Health) Regulations 2025, S.R. No. 141/2025, made 9 December 2025, commenced 1 January 2026 (Sch. 1 amended by S.R. No. 141/2025 reg. 4). This amendment added Bayside Health to Schedule 1.
• Mental Health and Wellbeing Amendment Regulations 2025, S.R. No. 153/2025, made 23 December 2025, commenced 23 December 2025. This instrument inserted reg 16A (reference to designated service name changes) and reg 27A (information from electronic health information system prescribing Ambulance Service,Victoria), and amended other provisions (Reg. 16A inserted by S.R. No. 153/2025 reg. 3; Reg. 27A inserted by S.R. No. 153/2025 reg. 4; Sch. 1 amended by S.R. No. 153/2025 reg. 5).

The Endnotes also record that reg 18 was substituted by S.R. No. 92/2023 (reg 4). The Version number on the front page is 004 as at 1 January 2026, which reflects the incorporated amendments to that date.

The amendment history has practical effects for compliance: Schedule 1 is an active list that has been amended to add services; prescribed classes such as PARC and named universities may be added or modified by further S.R.s; transitional provisions such as reg 16A were introduced to maintain continuity where service names changed. Users of the Regulations must therefore track subsequent S.R.s for changes to designated services, prescribed classes and electronic health information allocations.

The Endnotes also reflect the standard legislative publishing practice that explanatory materials printed after the Endnotes do not form part of the Statutory Rule (Endnotes: Interpretation), and that headings, examples and punctuation form part of the Rule as made (ILA references in Endnotes). Practitioners should consult the up-to-date consolidated version on the official legislation website to ensure they are reading the latest incorporated amendments.

The consolidated Regulations include an Endnotes section headed “3 Explanatory details” with the note “No entries at date of publication.” There are no cases or judicial decisions recorded in the instrument text, and the source material does not name any litigation or judicial consideration of these Regulations. The Regulations themselves are subordinate legislation focused on procedural and definitional prescriptions rather than novel or litigated legal standards.

Because no litigation history is recorded in the source, there are no reported court challenges, judicial interpretations, or appellate decisions to cite concerning the application, invalidity, or interpretation of these Regulations. Practitioners should therefore consider that interpretive issues may still arise in future litigation, particularly on discretionary terms such as “as soon as practicable” (reg 21), the scope of “improper conduct” (reg 8(c)), and the boundary between excluded education-sector services and regulated mental health and wellbeing services (reg 19).

Where judicial guidance is needed, courts will necessarily interpret these Regulations against the statutory text of the Mental Health and Wellbeing Act 2022 and other relevant statutes (for example, privacy and health records law, Public Administration Act duties, or tribunal remuneration jurisprudence under VCAT-related precedents). Until such cases arise, administrative guidance and departmental policy will be the principal sources of authoritative detail for implementation.

Given the absence of litigation history in the text, stakeholders should monitor case law and administrative determinations for future clarifications, and consider seeking declaratory relief or administrative review if key disputes arise over interpretation or application of the Regulations, particularly where removal from office, election validity, or entitlement to remuneration and allowances is contested.

The Regulations contain several technical choices and drafting features that produce practical compliance pitfalls and operational risks. The following are concrete “gotchas” that organisations and practitioners should track.

Narrow educational prescription for authorised practitioners (reg 15): Reg 15 prescribes a particular degree at Charles Sturt University as a qualifying educational pathway for a prescribed class of authorised mental health practitioner. The prescription is narrow; clinicians with other qualifications or the same degree from another provider will not fall within that specific prescribed class. Organisations should audit clinician qualifications against reg 15 rather than assume equivalent qualifications suffice.

Transitional and time-limited exclusions (reg 18): Reg 18(b) excludes services provided in emergency departments of designated mental health services to persons who are not patients for a defined limited period (1 September 2023 to 31 March 2024). After that period ends, the exclusion no longer applies. Reliance on temporary exclusions without tracking expiry dates can produce sudden compliance obligations.

“Member of a workforce” breadth (reg 19(2)): The definition of “member of a workforce” includes unpaid workers and volunteers (reg 19(2)(f)). Entities relying on workplace exclusions should note the wide class and consider volunteers and unpaid workers when mapping who receives workplace wellbeing support and whether exclusion applies.

Partial exclusions for education providers (reg 19(1)(e)): The exclusion of school and child-care providers from the definition of mental health and wellbeing service provider is limited “only to the extent” the service is provided to enrolled children or staff. Services provided to the public or non-enrolled persons will not enjoy the exclusion. This creates boundary issues for services that mix in-school provision and community outreach.

Notification timing is undefined: Reg 21 requires notification “as soon as practicable” of variations to temporary treatment orders or treatment orders. There is no prescribed timeframe, format, or recipient contact procedure in the Regulations. Health services must establish internal protocols to meet this standard; otherwise the subjective test may expose clinicians to professional or administrative review.

Quorum and joint chairs requirement (reg 14(5)): A quorum requires at least one joint chair and half of the members. If neither joint chair is present, and membership is small, the Committee may be unable to form a quorum and therefore cannot make decisions. Proxy voting requires chair approval (reg 14(8)(b)), which can obstruct representation if chairs are unavailable or decline proxies.

Removal for “improper conduct” (reg 8(c)): The term “improper conduct” is not defined in the Regulations, giving the Health Secretary discretion to remove members on that ground. Members also face removal for missing two meetings without approval. These provisions require clear procedural protections and fair process to mitigate legal risk.

Remuneration tied to VCAT rates and pro rata adjustments (reg 22; Schedule 2): Tribunal member pay is specified as percentages of VCAT remuneration. Changes to VCAT remuneration, and the need to compute pro rata amounts for part-time appointments, can complicate payroll. Allowances are left to Health Secretary determination under departmental policy, which may lead to variable treatment and potential disputes.

Data sharing and privacy interface (regs 26, 27, 27A): The Commission may use and disclose records from the Mental Health Complaints Commissioner’s custody (reg 26); specific entities are prescribed for electronic health information purposes (regs 27, 27A). These provisions intersect with privacy and health records regulatory frameworks. Organisations must ensure data sharing agreements and privacy impact assessments align with these authorisations and with state and Commonwealth privacy law.

Dependence on departmental policy and Health Secretary directions (regs 11, 13-14, 22, 24): Several operational matters are delegated to departmental policies and Health Secretary directions, for example terms of reference, meeting procedures, and allowances. Entities should obtain and review relevant departmental policies and directions to understand binding expectations and to manage operational compliance.

Sunset and amendment risk: The Regulations sunset after ten years (Endnotes). Schedule 1 and other parts have been amended multiple times by S.R. instruments. A failure to monitor amendments may result in operating under outdated designations or obligations.

No express penalty for notification failures or data misuse in text: The Regulations do not set out explicit penalties for failure to meet certain duties such as the notification duty in reg 21 or misuse of records under reg 26. Enforcement will therefore rely on other statutory regimes, professional regulation, or administrative action, creating uncertainty for entities planning risk management responses.

These features are concrete operational risks that require institutions to establish procedures, training, document retention and mapping of staff qualifications, election processes, payroll rules, and data sharing arrangements to avoid unintended non-compliance.

Compliance requires mapping obligations in the Regulations to operational processes across clinical practice, human resources, data governance, governance and elections, and payroll. Below are concrete, source-grounded steps for different stakeholders.

For designated services and clinical employers (regs 15-16; Schedule 1):

• Audit clinical staff qualifications against reg 15. Create a register of clinicians who hold the Bachelor of Health Science (Mental Health) from Charles Sturt University and record employment status at a designated mental health service to confirm they meet the prescribed class.
• Monitor Schedule 1 for amendments (Endnotes Table of Amendments) and update service directories and administrative systems when the list of designated mental health services changes.
• Implement an internal protocol to satisfy reg 21: create a standard operating procedure that specifies how and when an authorised psychiatrist must notify the primary non-legal mental health advocacy service of variations to treatment orders, who is responsible for the notification, how it is logged, and what constitutes “as soon as practicable”.

For Clinical governance and risk/data teams (regs 26, 27, 27A, reg 28):

• Review privacy and data sharing arrangements in light of reg 26’s authorisation for the Commission to use Mental Health Complaints Commissioner records. Prepare or update data sharing agreements and privacy impact assessments consistent with state privacy law and the Act’s information-sharing provisions.
• If your entity is The Bouverie Centre or Ambulance Service,Victoria, or a designated service interfacing with the electronic health information system, ensure technical and policy arrangements exist to receive and transmit required information under s 727 and s 728, and that staff training addresses access protocols (regs 27, 27A).
• For examinations, align billing and claims with the Medicare item fees referenced by reg 28. Ensure clinicians know which Medicare items to bill where examinations under the Act are involved and reconcile claims against Commonwealth rules.

For employers, schools and workplace wellbeing providers (reg 19):

• Map services to the exclusions in reg 19 to confirm whether your service is exempt from registration or provider obligations under the Act. Remember the exclusion applies only to services provided to enrolled students or employed staff; services to the public or external clients may not be excluded.
• Ensure employment contracts and volunteer agreements reflect that “member of a workforce” includes volunteers and unpaid workers where relevant (reg 19(2)(f)).

For the Mental Health Workforce Safety and Wellbeing Committee and Health Secretary (regs 5-14):

• The Health Secretary should document appointment letters with two-year terms and reappointment provisions (reg 6).
• Adopt practical quorum planning to ensure at least one joint chair and half the membership are present for meetings (reg 14(5)). Put proxy nomination forms and chair approval processes in place (reg 14(8)).
• Publish the Committee’s terms of reference and meeting schedule to comply with the requirement to meet at least quarterly (reg 14(1); reg 11).

For Tribunal administrators and finance teams (reg 22; Schedule 2):

• Calculate tribunal member remuneration as the specified percentages of comparable VCAT remuneration (Schedule 2) and apply pro rata reductions for part-time appointments (reg 22(a)). Maintain a process to update payments when VCAT remuneration changes.
• Coordinate with the Health Secretary’s office to understand the allowances policy and implement it consistently, documenting reasons for discretionary allowance decisions (reg 22(b)).

For the Public Advocate and Community Visitors (regs 23-24):

• Schedule annual elections to occur before 30 June, with elected community visitors commencing on 1 July for two-year terms (reg 23). Maintain nomination, ballot and counting procedures and ensure public notice requirements are satisfied under the Public Advocate’s determined process (reg 24(a)).
• Appoint a returning officer, establish a register of community visitors, and document procedures for resolving questions about vote validity (reg 24(b)-(d)).

Operational record-keeping and monitoring:

• Maintain auditable logs of notifications under reg 21, Committee minutes that record quorum and proxy uses under reg 14, appointment and removal records under regs 5-9, and data sharing agreements under regs 26-27A.
• Establish an amendment-watch process for S.R.s and consolidated legislation updates; the Endnotes list specific S.R. Nos that have already amended the Regulations (Endnotes Table of Amendments).

Training and policies:

• Provide targeted training to authorised psychiatrists and clinical staff about notification obligations and the “as soon as practicable” standard, including escalation paths if there is ambiguity.
• Prepare governance briefs for the Health Secretary and departmental officers explaining the discretionary levers (terms of reference, allowances, procedural directions) and recommended transparency and record-keeping practices to reduce legal and reputational risk.

Checklist summary:

• Audit clinician qualifications against reg 15 and update registers.
• Confirm whether your service is in Schedule 1 or is excluded under reg 18 or reg 19.
• Implement notification SOPs and logging for reg 21 duties.
• Set up Committee governance (terms of reference, quarterly meetings, quorum and proxy rules).
• Update payroll to reflect Schedule 2 percentages and Health Secretary allowance determinations.
• Execute data sharing agreements compliant with reg 26 and privacy law.
• Schedule and administer Community Visitors Board elections per regs 23-24.
• Monitor for and implement changes resulting from S.R. amendments.

Following these concrete steps will align operational practice with the Regulations’ prescriptions and reduce legal uncertainty.
