739 Statement following health information refusal

If a mental health and wellbeing service provider refuses to amend or correct the health information of a person following a request made to the provider by the person under section 39 of the Freedom of Information Act 1982 or in accordance with HPP 6, the provider must by written notice—

(a) inform the person of the provider's decision to refuse to amend or correct the health information of the person and the reasons for that refusal; and

(b) inform the person that they may make a health information statement.
