727 Electronic health information system

(1) There is an electronic health information system.

(2) The purpose of the electronic health information system is—

(a) to maintain the records of a person who receives mental health and wellbeing services from a mental health and wellbeing service provider; and

S. 727(2)(ab) inserted by No. 44/2025 s. 42(2).

(ab) to store information that is received under section 134ZO(1A) of the Health Services Act 1988; and

(b) to enable access to, and sharing of, information between persons authorised or permitted to access and share information under this Act; and

(c) to assist the Health Secretary and statutory bodies established under this Act in the performance of their functions.

(3) The Health Secretary is responsible for maintaining and has general oversight over the electronic health information system.

(4) For the purposes of subsection (3), the Health Secretary may—

(a) collect and store information required or authorised by this Act or any other Act to be stored in the electronic health information system; and

(b) require a mental health and wellbeing service provider to provide information to be stored in the electronic health information system in accordance with this Act; and

S. 727(4)(c) amended by No. 44/2025 s. 42(3)(a).

(c) require a mental health and wellbeing service provider to access information in the electronic health information system in accordance with this Act; and

(d) require information to be stored in the electronic health information system to be in the prescribed form; and

(e) use and disclose information stored in the electronic health information system for the following purposes—

(i) to implement and oversee the system;

S. 727(4)(e)(ii) amended by No. 44/2025 s. 42(3)(b).

(ii) to enable the sharing of a person's personal or health information as permitted under this Act;

S. 727(4)(e)(iii) amended by No. 44/2025 s. 42(3)(b).

(iii) to perform the Health Secretary's functions and duties or exercise the Health Secretary's powers;

S. 727(4)(e)(iv) amended by No. 44/2025 s. 42(3)(b).

(iv) to enable statutory bodies established under this Act to perform their functions and duties and exercise their powers;
