639 Non-compliance with duty of candour

The Minister or the Health Secretary may take into account the failure of the Institute to comply with the duty of candour when assessing the following matters under this Act—

(a) whether the Institute provides safe, patient‑centred and appropriate mental health and wellbeing services;

(b) the quality and safety of mental health and wellbeing services provided by the Institute.
