434 When can a complaint be made?
(1) A person is not entitled to make a complaint to the Mental Health and Wellbeing Commission—
(a) more than 12 months after the matter occurred which is the subject of the complaint; or
(b) if the mental health and wellbeing service was not provided, more than 12 months after the mental health and wellbeing service was sought.
(2) Despite subsection (1), the Mental Health and Wellbeing Commission may deal with a complaint lodged after the end of the 12-month period if the Commission is satisfied that the circumstances of the complaint so require.
