380 Requesting a statement of reasons

(1) After the Mental Health Tribunal has made a determination, a party to a proceeding before the Tribunal may request a statement of reasons for that determination.

(2) The request must—

(b) subject to subsection (3), be received by the Mental Health Tribunal within 20 business days after the Tribunal has made the relevant determination.

(3) The Mental Health Tribunal, in its discretion, may accept a request under subsection (1) that is received more than 20 business days after the determination is made for which the statement of reasons is requested.

(4) Within 20 business days after receiving a request under subsection (1), the Mental Health Tribunal must give a statement of reasons to all parties to the proceeding for which the request was made.

(5) The Mental Health Tribunal's statement of reasons must—

(a) be signed by the presiding member for the relevant proceeding or, if the presiding member is unavailable, the President or the Deputy President; and

(b) be sealed with the official seal of the Tribunal.
