370 Withdrawal of applications and striking out of proceeding

(1) Before an application has been determined by the Mental Health Tribunal, the applicant may seek leave from the Tribunal to withdraw the application.

(2) The Mental Health Tribunal may grant leave to an applicant to withdraw an application.

(3) The Mental Health Tribunal may make an order striking out a proceeding if the applicant fails to appear.

(4) The Mental Health Tribunal's power to grant leave under subsection (2) or to strike out a proceeding under subsection (3) is exercisable by—

(a) the Tribunal as constituted for the proceeding; or

(b) the principal registrar.

(5) The principal registrar must notify in writing all parties to a proceeding of—

(a) a decision by the Mental Health Tribunal or the principal registrar to grant leave to an applicant to withdraw an application; or

(b) a decision by the Mental Health Tribunal or the principal registrar to strike out a proceeding.
