359 Constitution of the Mental Health Tribunal

(1) Subject to section 360, the President must select 3 Tribunal members who will constitute the Mental Health Tribunal for the purposes of a proceeding, having regard to subsections (2) and (3).

(2) For the purposes of a proceeding in the general division of the Mental Health Tribunal, the Tribunal is constituted by—

(a) a legal member; and

(b) a psychiatrist member or a registered medical practitioner member; and

(c) a community member.

(3) For the purposes of a proceeding in the special division of the Mental Health Tribunal, the Tribunal is constituted by—

(a) a legal member; and

(b) a psychiatrist member; and

(c) a community member.

(4) For the purposes of this section, the President and Deputy President are legal members.
