247 Authorised person may search a person

(1) This section applies when a person is in the care and control of an authorised person under Part 5.2 or 5.3.

(2) An authorised person (including another authorised person who is assisting the authorised person under section 251) may search a person if the authorised person reasonably suspects that the person is carrying any thing that presents a danger to the health and safety of the person or another person.

(3) Before searching a person under this section, the authorised person must, to the extent that is reasonable in the circumstances, explain to the person the purpose of the search.

(4) Nothing in this section permits the searching of a person after the person has been admitted as an inpatient unless the search is required immediately before the person is transported under Part 5.3.
