159 Examination of assessment patient by authorised psychiatrist

(1) An authorised psychiatrist for the responsible designated mental health service must examine an assessment patient to determine whether the compulsory treatment criteria apply to the patient as soon as practicable—

(a) in the case of a community assessment order, after the order is made; or

(b) in the case of an inpatient assessment order, after the person has been received at the responsible designated mental health service.

(2) Before an authorised psychiatrist examines an assessment patient under subsection (1), the authorised psychiatrist must—

(a) identify themselves to the assessment patient; and

(b) inform the assessment patient that the patient will be examined under an assessment order; and

(c) take all reasonable steps to explain the purpose of the examination to the assessment patient; and

(d) if the assessment patient requests a copy of the assessment order, ensure that the patient is given a copy of the order.
