145 Community or inpatient assessment order

(1) A registered medical practitioner or an authorised mental health practitioner who makes an assessment order must determine whether the order is—

(a) a community assessment order; or

(b) subject to subsection (2), an inpatient assessment order.

(2) A registered medical practitioner or an authorised mental health practitioner must not make an inpatient assessment order in respect of a person unless the practitioner is satisfied that the person cannot be assessed in the community.
