78D Orders under Part 4 of Sentencing Act 1995 The court must not make an order for the person under Part 4 of the Sentencing Act 1995 while the person is released on bail for the purpose of: (a) undergoing an assessment mentioned in section 78(3)(b); or (b) participating in, or completing, a voluntary treatment plan.

(2) The granting of bail to the person on the condition that the person undergo assessment and treatment under this Division does not constitute an inducement for section 7(2)(a).
