#### 164 Delegation 164 Delegation > > (1) A Minister administering this Act may, by instrument in writing, delegate the exercise of any function of the Minister under this Act (other than this power of delegation)— > > > > > (a) to any person employed in a Department responsible to the Minister, or > > > > > (b) to any person, or any class of persons, authorised for the purposes of this section by the regulations. > > > (2) The Secretary of the Department of Communities and Justice may delegate the exercise of any function of the Secretary under this Act (other than this power of delegation)— > > > > > (a) to any person employed in the Department of Communities and Justice, or > > > > > (b) to any person, or any class of persons, authorised for the purposes of this section by the regulations. > > > (3) Nothing in this section limits the operation of section 21 of the [Health Administration Act 1982](/view/html/inforce/current/act-1982-135).
