sec.148 Certificate of forensic disability service availability

This section applies for the purpose of the Mental Health Court deciding under section 147 whether the forensic disability service will be responsible for the person. The court may ask the director of forensic disability to give the court a certificate prepared by the chief executive (forensic disability) stating whether or not the forensic disability service has the required capacity within the meaning of section 147 . If asked by the director of forensic disability to prepare a certificate mentioned in subsection (2) , the chief executive (forensic disability) must prepare, and give the director, the certificate. If the court makes a request under subsection (2) , the director of forensic disability must give the court the certificate within— 7 days after receiving the request; or any longer period allowed by the court.
