137 Inspection of mental health facilities
(cf 1990 Act, s 237)
> > (1) The Secretary may inquire into the administration, management and services of a mental health facility and for that purpose may cause any mental health facility to be visited and inspected from time to time by officers authorised by the Secretary.
>
> > (2) A visit or inspection may be carried out by an authorised officer appointed under section 124 of the [Health Services Act 1997](/view/html/inforce/current/act-1997-154), if the officer’s certificate of authority is expressed to extend to such visits or inspections.
>
> > (3) On an inspection, an authorised officer—
> >
> > > (a) may, at any time, make any inspections, investigations and inquiries with respect to the care, treatment or control of patients or persons detained in a facility or with respect to the management of a facility the authorised officer considers necessary, and
> >
> > > (b) must make any such inspections, investigations and inquiries that are directed by the Secretary.

> > (4) An inspection may be made with or without previous notice and at any time of the day or night, and be of such length, as the authorised officer thinks appropriate.
