#### 107 Delegation 107 Delegation > > (1) The Secretary may delegate the exercise of any function of the Secretary under this Act or the [Mental Health and Cognitive Impairment Forensic Provisions Act 2020](/view/html/inforce/current/act-2020-012) (other than this power of delegation) to— > > > > > (a) any person employed in the Ministry of Health, or > > > > > (b) any member of staff of the NSW Health Service, or > > > > > (c) any person, or any class of persons, authorised for the purposes of this section by the regulations. > > > (2) A delegate may sub-delegate to a person referred to in subsection (1) (a) or (b) if the delegate is authorised in writing to do so by the Secretary. > > **s 107:** Am 2008 No 79, Sch 2 \[28\]; 2015 No 58, Sch 3.60 \[1\]; 2020 No 12, Sch 3.17\[9\].
