Members of Parliament (Standards) Act 1978

The Act organises its regulatory architecture around a small set of concepts that structure Member behaviour, disclosure and enforcement.

1. Values and Code of Conduct. The Statement of Values (s 4) lists public service, democracy, integrity, accountability, respect for diversity, diligence and leadership. The Code (Part 3, ss 5-16) operationalises those values into obligations and prohibitions. The Code includes positive duties such as exercising reasonable care and diligence and submitting to lawful scrutiny (s 6), and negative prohibitions such as not accepting gifts that create actual or perceived conflicts (s 10), not using position for profit (s 8) and not using confidential information for private advantage (s 14).

2. Conflicts and perceived conflicts. The Act frames conflicts broadly. Section 7 requires avoidance of actual or perceived conflicts with private interests. A conflict exists where a Member participates or makes a decision that furthers their private interests or those of a specified person, but ordinary effects on a broad class of the public are excluded (s 7(2)-(3)). The reach is to both substantive conflicts and perceptions that could undermine public trust.

3. Register and returns. The Register of Interests (ss 17-29) is a statutory, centralised log of Members’ relevant private interests. Primary returns must be lodged on commencement or upon taking office (s 17). Ordinary returns are due twice yearly (s 18). Detailed categories for disclosure are listed in ss 19-20, and include income, beneficial interests, land, office holding, debts, trusts, memberships and gifts and sponsored travel. The Act prescribes thresholds and CPI adjustment mechanics (ss 22-25) so small items are excluded from reporting.

4. Thresholds and materiality. The Act recognises administrative cost and privacy by creating threshold amounts for income, beneficial interests, debts, gifts and travel contributions (ss 22-24). The thresholds are anchored in dollar amounts for the 2018-19 year, then adjusted annually by CPI for subsequent years, with rounding rules (s 24(2)-(4)) and a requirement that changes be notified by the Clerk (s 25). The Act also treats repeated small transactions cumulatively for reporting (s 22(3)).

5. Confidentiality and controlled publication. The Clerk maintains the Register and is bound to keep material confidential except as permitted by the Act (s 26(3)). Publication by others of material from the Register is restricted to fair and accurate summaries and requires comments to be fair, published in the public interest and without malice (s 28). The Clerk must also table returns before the House within 14 days of receipt or of the next sitting (s 29).

6. Institutional roles and referral pathways. The Clerk of the Parliaments administers returns and the Register, reports to the Presiding Officer for noncompliance or suspected inaccuracy (s 27(1)), may refer material contraventions to the Parliamentary Workplace Standards and Integrity Commission (s 27(2)), and the Presiding Officer determines referral to Privileges Committees and must refer suspected criminality to law enforcement (s 30). The Parliamentary Workplace Standards and Integrity Act 2024 supplies the Commission and Adviser definitions and referral mechanics (s 2 and ss inserted in 2024).

7. Enforcement is parliamentary contempt. Willful contraventions of Part 3 or Part 4 are declared contempts, giving either House discretion to impose a menu of penalties including apology, rectification, fine up to 100 penalty units, suspension or vacating a seat, with suspension or vacancy requiring a three quarter special majority (s 31).

8. Extraterritorial reach. Section 3A extends the Act’s operation to conduct by a Member outside Victoria, including outside Australia. This expands the behavioural reach to off‑shore activities of Members.

9. Non‑civil character of the Code. The Parliament clearly states it does not aim for the Code to create civil causes of action or to affect statutory interpretation of other laws (s 5A). That frames enforcement primarily as within parliamentary discipline and administrative referral pathways.

10. Interaction with other statutory regimes. The Act references and defers to other statutory definitions and rules for scope and substance, for example the Electoral Act 2002 for political donations, the Corporations Act for listed corporation, and the Parliamentary Salaries, Allowances and Superannuation Act 1968 for public resources and allowances (s 2 definitions, s 12(a)).

Each of these concepts is established in the operative text of the Act, and together they form a compliance and enforcement ecosystem aimed at transparency, avoidance of conflicts and internal parliamentary accountability.

Primary persons affected are Members of the Parliament of Victoria. The statutory definition of Member is straightforward, but the Act’s reach extends beyond the individual Member in several concrete ways.

• Members and former Members. The Code applies to sitting Members while carrying out public duties, and s 15 imposes post‑retirement restrictions on former Members, prohibiting misuse of official information or status for advantage. Section 3A extends coverage to conduct engaged in outside Victoria by a Member, which includes actions taken prior to leaving office if the conduct occurred while a Member.

• Specified persons and family. The Act repeatedly brings into play “specified persons” defined to include family members, corporations or entities where the Member has a controlling beneficial interest, creditors or debtors (with limited exceptions) and donors (s 2). The duty to avoid conflicts therefore covers interests of family and related entities (s 7, s 8).

• Employers and donors. Entities that pay income, provide gifts, hospitality, or sponsor travel to a Member are implicated by reporting obligations. Returns require the name and address of income sources and donors, and gifts and travel funded by others (not the State or the Member’s family) must be disclosed in ordinary returns (s 19(1)(a), s 20(1)(b)-(c)).

• The Clerk of the Parliaments and authorised persons. The Clerk is the repository and manager of the Register, and authorised persons employed for administering the Act are bound by confidentiality provisions and limited communication rights (s 26(1)-(4)). The Clerk must notify Members of CPI adjusted thresholds (s 25), lay returns before the House (s 29), and report non‑compliance (s 27).

• Parliamentary officers and committees. Presiding Officers, Privileges Committees and the Parliamentary Workplace Standards and Integrity Commission are decision makers under the Act. The Presiding Officer receives reports and decides referrals to Privileges Committees, and must refer matters to law enforcement if criminality is suspected (s 30). The Clerk may refer matters to the Parliamentary Workplace Standards and Integrity Commission (s 27(2)). The Commission and Parliamentary Integrity Adviser are defined in s 2 as created under the 2024 Act, and the Clerk may communicate Register information to the Commission in connection with a referral (s 26(3A)).

• The public and media. The public is an indirect audience, because returns are to be tabled before the relevant House within 14 days of receipt (s 29). Publication and commentary by others are constrained by s 28, which permits publication only as a fair and accurate summary and allows comment only if fair, in the public interest and without malice.

• Prescribed entities and cross‑referenced statutes. Third party actors such as listed corporations defined under the Corporations Act, ADIs and persons whose ordinary business includes lending money feature in the definitions which affect what debts must be disclosed (s 2 defns, s 19(1)(f)). The Electoral Act 2002 determines the meaning of political donation, excluded from the s 2 definition of gift. The Parliamentary Salaries, Allowances and Superannuation Act 1968 governs what counts as public resources for the purposes of s 12 and exemptions from s 8(1) regarding payment for position.

Who pays. The immediate compliance costs fall on Members, who must collect and lodge returns, maintain records, and manage potential remediation. Where fines are applied under s 31(2)(c), these are to be paid to the Presiding Officer for transfer to the Consolidated Fund. Administrative costs for maintaining the Register and conducting reviews fall on parliamentary administration and are not itemised in this Act.

Who decides. Decision makers explicitly named include the Clerk of the Parliaments, Presiding Officers, the Houses and their Privileges Committees, the Parliamentary Workplace Standards and Integrity Commission and, in some circumstances, law enforcement authorities (s 27, s 30). The Governor in Council has regulation‑making power (s 32).

The Act therefore creates obligations that touch Members’ private financial relationships, family connections and outside activities, places administrative burdens on Members and parliamentary staff, constrains publication by third parties, and channels suspected breaches to parliamentary and external agencies.

The Act sets out both affirmative duties and prohibitions that Members must observe, and also specifies certain rights and limits to enforcement.

Key duties under the Code of Conduct (Part 3, ss 5-16):

• Duty to prioritise public duties and exercise reasoned care. Section 6 requires Members to make their public duties their prime responsibility and to exercise reasonable care and diligence when performing those duties. Members must also submit to lawful scrutiny and treat all persons with respect.

• Duty to prevent workplace misconduct. Section 6A, inserted by the 2024 Act, requires Members to foster a healthy, safe, respectful and inclusive parliamentary workplace free from bullying, sexual harassment, assault and discrimination. Section 6A draws definitions from the Parliamentary Workplace Standards and Integrity Act 2024.

• Duty to respect the new integrity institutions. Section 6B requires Members to demonstrate respect for the Parliamentary Workplace Standards and Integrity Commission and the Parliamentary Integrity Adviser.

• Conflicts avoidance and disclosure. Section 7 imposes an obligation to avoid actual and perceived conflicts between private interests and public duties. Participation or decision making that furthers private interests is an express conflict. The Register and returns regime operationalises disclosure of relevant interests (ss 19-21).

• Prohibition on using position for profit. Section 8(1) prohibits Members from receiving fees, payments, retainers or rewards, or permitting compensation to accrue to their beneficial interest, resulting from use of their position. Section 8(2) carves out public salaries, allowances and other prescribed public resources under the Parliamentary Salaries Act.

• Outside employment. Section 9 permits outside employment, business and community activities, but requires Members to avoid conflicts and ensure external activities do not compromise capacity to fulfil public duties.

• Gifts, hospitality and benefits. Section 10 prohibits acceptance of gifts, hospitality or other benefits that create an actual or perceived conflict of interest or might create a perception of attempted influence. The statutory definition of gift excludes political donations and gifts by a family member (s 2).

• Use of influence and public resources. Section 11 prohibits use of influence to improperly further private interests. Section 12 requires compliance with the Parliamentary Salaries, Allowances and Superannuation Act 1968 and any other law, rule or guidance on use of public resources. Section 12 thus ties public resource rules to another statutory regime.

• Personal conduct and confidentiality. Section 13 requires conduct that does not bring discredit upon Parliament, honest accounting for public resources, and a prohibition on deliberately misleading Parliament or the public. Section 14 prohibits using confidential information obtained in public duties to further private interests and requires respect for confidentiality.

• Post‑retirement restrictions. Section 15 prohibits former Members from taking improper advantage of their earlier office, including using non‑public official information or status to obtain preferential access, unless disclosure is legally required or otherwise lawful.

Disclosure duties and mechanics:

• Primary and ordinary returns. Primary returns on commencement or upon taking office are required within 28 days (s 17). Ordinary returns must be lodged within 28 days after 31 January and 30 June each year (s 18). The prescribed forms specify the required categories of information (ss 19-20).

• Material change reporting. Section 21 requires prompt submission of material change descriptions to the Clerk when a Member becomes aware of a material change in any previously submitted information.

• Thresholds and aggregation. Section 22 sets thresholds below which items need not be reported, but requires aggregation where there are repeated transactions from the same source that cumulatively exceed the threshold.

Rights and limits:

• No civil cause of action. Section 5A expressly records that Parliament does not intend the Code to create legal rights or civil causes of action, and that the Code is not intended to affect interpretation of other Acts. This frames enforcement and redress as internal and political rather than private-law remedies.

• Confidentiality and limited dissemination. Section 26(3) restricts the Clerk and authorised persons from using or communicating information received under the Act except as the Act permits, protecting the privacy of information in the Register. This is modulated by s 26(3A), which permits communication to the Parliamentary Workplace Standards and Integrity Commission in connection with a referral under s 27(2).

• Publication constraints. Section 28 restricts how third parties can publish information derived from the Register, permitting only fair and accurate summaries and requiring comments to be fair, in the public interest and without malice. This imposes a limit on publication rights and shapes public access.

• Procedural protections in penalties. The House may impose penalties for contempt; however suspension or vacating a seat requires a special majority (three quarters) of the whole number of Members of the House (s 31(3)-(4). The Act also provides that penalties such as apology, rectification, and fines are within the House’s discretionary powers and noncompliance with some penalties may lead to seat vacancy (s 31(2)-(5)).

• Referral to law enforcement. Where a Presiding Officer considers a referral may involve criminal conduct, the obligation to refer to law enforcement is mandatory (s 30(3)), creating a path to criminal investigation that sits outside parliamentary discipline procedures.

These duties create compliance obligations backed by parliamentary sanction pathways while the Act explicitly constrains private civil litigation arising directly from the Code. The interplay of disclosure duties, confidentiality limits and criminal referral mechanics structures both transparency and controlled enforcement.

The Act places enforcement primarily within the parliamentary discipline framework but also builds in referral pathways to external institutions.

Parliamentary contempt and parliamentary penalties:

• Willful contravention. Section 31(1) declares any wilful contravention of a requirement under Part 3 (Code) or Part 4 (Register) to be a contempt of Parliament. That legal characterisation places initial enforcement authority with the Houses of Parliament and their customary mechanisms for addressing contempt.

• Menu of penalties. Section 31(2) lists penalties either House may impose in addition to other contempt punishments. The list includes:

  • Apology to the House (s 31(2)(a)).
  • Rectification of the return or Register information (s 31(2)(b)).
  • Payment of a specified fine not exceeding 100 penalty units, to be paid to the Presiding Officer for remittance to the Consolidated Fund (s 31(2)(c)).
  • Suspension from the House for a period determined by the House (s 31(2)(d)).
  • Declaration that the Member’s seat is vacant (s 31(2)(e)).

• Special majority requirement. For penalties that suspend a Member or declare the seat vacant the Act requires a special majority of three quarters of the whole number of Members of the House (s 31(3)-(4)). This raises the decision threshold for the most severe sanctions.

• Consequence of noncompliance. If a Member does not comply with required penalties such as apology, rectification or payment of fines within the time ordered, the Member’s seat becomes vacant (s 31(5)).

Administrative enforcement and reporting:

• Clerk’s reporting function. The Clerk of the Parliaments must report a Member to the Presiding Officer if: the Member fails to submit a return within required timeframes and an additional reasonable time, or the Clerk reasonably believes a return is inaccurate or incomplete and it remains so after reasonable opportunity to correct (s 27(1)(a)-(b)).

• Referral to Commission. Section 27(2), as inserted in 2024, authorises the Clerk to refer matters believed to materially contravene the Register regime to the Parliamentary Workplace Standards and Integrity Commission under the Parliamentary Workplace Standards and Integrity Act 2024. The Clerk may make this referral in addition to, or instead of, reporting to the Presiding Officer (s 27(3)).

• Presiding Officer’s referral and law enforcement. A Member may refer alleged contraventions to the Presiding Officer (s 30(1)). The Presiding Officer decides whether to refer the matter to the relevant Privileges Committee (s 30(2)). Where the Presiding Officer determines the matter may involve criminal offending, the Presiding Officer must refer it to the appropriate law enforcement agency (s 30(3)). These provisions create parallel tracks: parliamentary discipline and criminal investigation may both be invoked.

Confidentiality and restricted use of Register material:

• Controlled disclosure. Section 26(3) prohibits the Clerk and authorised persons from making a record of, communicating, or using Register information other than in accordance with the Act. Section 26(3A) permits communication to the Parliamentary Workplace Standards and Integrity Commission in connection with a referral under s 27(2). This is an enforcement channel controlled by statute.

Publication restrictions and reputational risk:

• Limitations on publishing Register information. Section 28 makes it an offence for a person to publish information derived from the Register unless it is a fair and accurate summary, and to publish comment on Register information unless the comment is fair and published in the public interest without malice. The Act does not set a specified penalty for contravening s 28 within the text supplied, but the provision places constraints on media and public commentary and interacts with parliamentary privilege and contempt powers.

Regulations and delegated enforcement:

• Regulation power. The Governor in Council may make regulations for matters required or permitted by the Act (s 32). Regulations can be used to set forms, procedural details and possibly enforcement steps short of those listed in the Act. The Act delegates detail to subordinate instruments within that statutory remit.

Remedies outside the Act:

• No civil cause of action intended. Section 5A(1) records that the Parliament does not intend the Code to create legal rights or civil causes of action. Practically, this limits direct private litigation against Members under the Code itself. However, the Presiding Officer’s duty to refer suspected criminal conduct to law enforcement (s 30(3)) and the retention of ordinary criminal law means external legal consequences remain possible if conduct meets criminal thresholds.

Who enforces and who pays:

• The Houses and Presiding Officers bear the primary enforcement authority within Parliament. The Clerk initiates administrative reporting and referrals. Law enforcement agencies may become involved when criminality is suspected. Fines ordered by the House are paid by the Member to the Presiding Officer for remittance to the Consolidated Fund (s 31(2)(c)).

In sum, enforcement is structured as a layered system. The Act makes the primary sanctioning mechanism parliamentary contempt and penalties decided by the relevant House, supplements that with administrative referral powers for the Clerk and Presiding Officer, enables statutory referral to the Parliamentary Workplace Standards and Integrity Commission, and provides a mandatory pathway to criminal investigation where appropriate.

The Act is heavily cross‑referenced to other Commonwealth and Victorian statutes, which the Act uses to define many of its terms and to defer certain governance matters. The Act is structured to operate as a transparency, integrity and discipline overlay to existing statutory regimes rather than supplanting them.

Key cross‑references and interactions:

• Parliamentary Salaries, Allowances and Superannuation Act 1968. Section 12(a) requires Members to comply with that Act and its regulations when using public resources. Section 8(2) explicitly excludes parliamentary salary, work‑related parliamentary allowances, the Electorate Office and Communications Budget and other prescribed allowances or public resources under the Salaries Act from the prohibition on receiving payment for use of position. Thus the Act defers to the Salaries Act both to define permissible use of public resources and to identify permitted remuneration.

• Electoral Act 2002. The statutory definition of gift in s 2 excludes political donations, which are defined in the Electoral Act 2002. This preserves the operation of political finance law and keeps political donations outside the gift reporting lines under this Act.

• Corporations Act and Income Tax Assessment Act 1997. The Act imports the meaning of listed corporation from s 9 of the Corporations Act, and equates “income” to “assessable income” as defined in the Commonwealth Income Tax Assessment Act 1997 (s 2). These cross‑references standardise certain definitions with well‑known Commonwealth regimes and facilitate consistent disclosure of corporate and income matters.

• Superannuation law. The Act defines private superannuation fund for the purposes of beneficial interest disclosure by reference to the Superannuation Industry (Supervision) Act 1993 (s 2). The definition affects what must be disclosed as a beneficial interest.

• Relationships Act 2008. The Act borrows the term registered domestic relationship and the factors for determining domestic partners from the Relationships Act 2008 when defining “domestic partner” in s 2(2). This affects who counts as family and is therefore a specified person for the purpose of conflict and disclosure rules.

• Parliamentary Workplace Standards and Integrity Act 2024. The 2024 Act created the Parliamentary Workplace Standards and Integrity Commission and the Parliamentary Integrity Adviser, both of which are integrated into this Act by definition and referral paths. Section 2 inserts those new entities and s 26(3A) permits Clerk communications to the Commission connected with referrals under s 27(2). Sections 6A and 6B import definitions and duties in relation to workplace behaviour and respect for the new Commission and Adviser.

• Constitution Act 1975. Section 16 expressly states that nothing in Part 3 is intended to affect or vary Division 8 of Part II of the Constitution Act 1975. This preserves constitutional provisions relevant to parliamentary privilege, powers and immunities.

• Criminal law and law enforcement. Section 30(3) obliges the Presiding Officer to refer suspected conduct that may be criminal to appropriate law enforcement agencies, bridging the Act’s internal disciplinary framework with ordinary criminal enforcement.

• Interpretation of Legislation Act 1984. The Endnotes record that the Act includes style changes and that various interpretative consequences apply under the ILA. This affects headings, notes and other textual elements that form part of the Act.

Operational effects of these interactions:

• The Act intentionally avoids creating overlapping definitions where established regimes exist, instead importing definitions and limiting its reach where other laws cover the same territory. For example, political donations are handled under the Electoral Act 2002, and the Salaries Act governs public resource use.

• Enforcement overlaps are explicit. The Act places misconduct within parliamentary contempt mechanisms, but requires referral to ordinary criminal processes when criminality is suspected. The insertion of the Parliamentary Workplace Standards and Integrity Commission creates a new administrative actor with power to receive referrals from the Clerk.

• Confidentiality and publication rules intersect with other defamation, contempt and privacy laws. Section 28’s restrictions on publication must be read alongside general law in Victoria concerning defamation and freedom of expression. The Act does not in itself repeal or displace those laws; rather s 5A emphasises the Code is not intended to create private rights or alter interpretation of other laws.

• Regulatory detail and forms are left to the Governor in Council through regulations (s 32). These regulations can further interact with other statutes by prescribing forms and operational rules, but must remain within the statutory powers conferred.

In short, the Act is designed as an integrity and disclosure overlay that references and defers to existing statutory regimes for definitional, procedural and substantive matters. Enforcement sits primarily within parliamentary mechanisms but links to external institutions where criminal elements or specialised workplace integrity functions apply.

The version text incorporates two major amendment waves recorded in the endnotes and in the marginal annotations: the 2019 reforms effected by the Victorian Independent Remuneration Tribunal and Improving Parliamentary Standards Act 2019 (No. 5/2019), and the 2024 reforms effected by the Parliamentary Workplace Standards and Integrity Act 2024 (No. 27/2024).

Victorian Independent Remuneration Tribunal and Improving Parliamentary Standards Act 2019 (No. 5/2019)

• Assent: 19 March 2019. Commencement: sections 72-79 on 20 March 2019; s 80 on 16 September 2019, per the Table of Amendments in the Endnotes.
• Effect on this Act: The 2019 Act retitled the Members of Parliament (Register of Interests) Act 1978 to the Members of Parliament (Standards) Act 1978 (s 72(1) of the amending Act). It inserted the Statement of Values (s 4), created the statutory Code of Conduct as Part 3 (ss 5-16), reworked the Register of Interests into Part 4 (ss 17-29), and established the regime for returns, thresholds, CPI adjustment mechanics, and the penalties and referral architecture (s 72-79 of the amending Act give rise to s 17 onwards in this Act). The 2019 amendments substantially modernised the Act, moving it from a pure register model to a broader standards and conduct model. Many sections are explicitly noted as inserted by No. 5/2019 in the text.

Parliamentary Workplace Standards and Integrity Act 2024 (No. 27/2024)

• Assent: 20 August 2024. Commencement: sections 126-130 had effect on 31 December 2024, per the Table of Amendments.
• Effect on this Act: The 2024 Act inserted definitions for the Parliamentary Integrity Adviser and the Parliamentary Workplace Standards and Integrity Commission into s 2. It inserted s 3A to extend extraterritorial operation, added workplace‑behaviour duties in s 6A, inserted s 6B requiring respect for the new Commission and Adviser, added s 26(3A) to permit Clerk communication with the Commission in connection with referrals, and amended s 27 to allow Clerk referrals to the Commission (s 27(2)-(3)). The 2024 amendments thus integrate this Act with the new institutional architecture that the 2024 Act created.

Other textual amendments and style changes:

• The Endnotes record that Pt 1 heading and s 1(1) changes were made by No. 5/2019 and that s 2 was substituted by No. 5/2019 s 74, reflecting a wholesale recast of the interpretative and definitional framework. Numerous marginal notes in the Act text show each inserted or amended subsection and the instrument responsible.

Review requirement:

• Section 34, inserted by No. 5/2019, requires the Minister to cause a review of the first ten years of operation following commencement of all 2019 amendments, and to lay a report before each House within 12 months after completion of the review. That mechanism establishes a statutory review timeline tied to the 2019 reforms, and it remains an ongoing statutory obligation.

Timing and commencement:

• The Act originally dated from 1978, and the endnotes confirm initial assent was 19 December 1978. The major modernisation in 2019 and institutional additions in 2024 reflect the Act’s evolution from a register to an integrated standards regime. The Table of Amendments in the Endnotes documents these two amending Acts and their commencement dates relevant to this Act.

No other amending Acts are recorded in the provided endnotes. The Act contains standard saving and construction clauses, and section 33 directs references to the old Members of Parliament (Register of Interests) Act 1978 in post‑2019 instruments to be read as references to this Act, so as to preserve continuity.

The text of the Act provided contains no cases, judicial decisions, or references to litigation. The Endnotes section titled “3 Explanatory details” explicitly states “No entries at date of publication.” Therefore, within the source material supplied, there is no recorded litigation history or judicial interpretation noted.

Practical implications of the absence of recorded litigation in the text:

• No judge‑made clarifications. Because the supplied version does not cite any cases, the statutory provisions described in this Act are presently unelaborated by judicial construction within the document. Users should therefore be aware that statutory terms such as “wilful contravention”, “material change”, “actual or perceived conflict”, “improper advantage” and the publication standards under s 28 may be subject to future judicial definition. The Act’s own text does not provide those definitions beyond the ordinary words and the internal definitions in s 2.

• Parliamentary character of enforcement. The Act places enforcement primarily within parliamentary mechanisms, describing contempts and House penalties, referral procedures to Privileges Committees and law enforcement, and administrative referral to the Parliamentary Workplace Standards and Integrity Commission. Because these are internal and political processes, many disputes arising under the Act may be resolved through parliamentary processes rather than courts, at least initially. Where criminality is suspected, the Act requires a Presiding Officer to refer to law enforcement (s 30(3)), which could bring matters into the criminal courts.

• Civil rights and remedies. Section 5A(1) explicitly states the Parliament does not intend the Code of Conduct to create legal rights or civil causes of action. That language suggests the Act was drafted to avoid opening a direct private law pathway for litigants to sue Members simply for breach of the Code. However, the absence of civil remedies in the Act does not prevent third parties from bringing claims under separate private‑law causes of action where elements are otherwise satisfied, nor does it prevent defamation or privacy litigation arising from publication of material relating to Members.

• Future litigation possibilities. Potential areas for future judicial involvement include disputes over: whether a Member’s conduct amounts to a wilful contravention for contempt; the meaning of “perceived conflict”; limits on publication under s 28 in light of freedom of expression and defamation law; privilege and confidentiality questions relating to the Clerk’s handling of Register information; and the extraterritorial reach of s 3A. The Act as presented does not preclude such litigation, but no cases are cited in the text.

Where users require precedential guidance, they will need to consult extrinsic sources and any subsequent cases or parliamentary rulings post‑dating the document. The Act itself documents no litigation history or judicial gloss within the supplied text.

The Act contains several specific drafting features and operational mechanics that can create compliance traps or unexpected consequences if not read closely. The following are concrete operational “gotchas” grounded in the Act’s text.

1. The Code is not a private cause of action, but penalties are parliamentary and may be severe. Section 5A(1) states the Parliament does not intend the Code to create legal rights or give rise to civil causes of action. That does not mean there are no consequences. Willful contraventions are contempt (s 31(1)) and may lead to apology, rectification, fine up to 100 penalty units, suspension or seat vacated (s 31(2)). Suspension or vacancy requires a three quarter special majority (s 31(3)-(4)). Practitioners should not mistake the absence of private causes as absence of parliamentary sanctions.

2. Blind trust disclosure is limited but not absolute. A Member holding a beneficial interest in a blind trust is not required to disclose trust details in some paragraphs of the primary and ordinary return requirements (s 19(2), s 20(2)). However, the primary or ordinary return must still disclose a description of the blind trust and the name and address of the person who manages it (s 19(2), s 20(2)). Blind trusts therefore reduce but do not eliminate disclosure.

3. Thresholds are cumulative and CPI adjusted. Small payments or interests below thresholds need not be reported, but s 22(3) requires reporting if the Member “holds or receives on 2 or more occasions” items from a particular source and the aggregate exceeds the threshold. Threshold amounts are set for 2019 then CPI adjusted annually with precise rounding rules (s 23-24). Failure to account for aggregation or annual threshold changes may produce inadvertent noncompliance.

4. Publication restrictions are narrow and condition‑laden. Section 28 forbids publishing information derived from the Register unless it is a fair and accurate summary, and forbids comment unless fair, in the public interest and without malice. These statutory constraints create legal and reputational exposure for journalists, commentators and others. The Act does not define “fair and accurate summary” or “without malice”, so those terms will be contextually applied and may interact with defamation law, parliamentary privilege and freedom of expression considerations.

5. Confidentiality vs referral to Commission. Section 26(3) prohibits the Clerk or authorised persons from using or communicating Register information other than under the Act. Section 26(3A), inserted in 2024, allows communication to the Parliamentary Workplace Standards and Integrity Commission in connection with a referral under s 27(2). This creates a narrow exception to confidentiality, but only in specific referral contexts. General administrative use outside the Act remains prohibited.

6. Exported extraterritorial reach. Section 3A extends the Act to conduct of a Member outside Victoria, including outside Australia. Members should note that off‑shore employment, travel, gifts or communications may still fall within the Act’s ambit.

7. Definitions narrow certain exposures. The definition of “gift” excludes political donations and gifts from family members (s 2). The definition of “debt” excludes personal debts owed to family, ADIs and ordinary lenders or for household/office goods and services. These definitional exclusions materially shape what must be declared and what is left out.

8. Public resource rules are tethered to another statute. Section 12(a) requires compliance with the Parliamentary Salaries, Allowances and Superannuation Act 1968 and any regulations under that Act. Practically, this means Members must be familiar with, and follow, the Salaries Act guidance when accounting for public resources. Failure to do so could produce dual exposure under both Acts.

9. Timing strictness and tabling. Primary returns are due within 28 days of commencement or of taking office (s 17). Ordinary returns are due within 28 days after 31 January and 30 June each year (s 18). The Clerk must table returns before the House within 14 days if the House is sitting, or within 14 days of the next sitting (s 29). Late lodgement triggers reporting by the Clerk to the Presiding Officer and may lead to further action (s 27(1)(a)).

10. “Wilful” standard. Section 31(1) renders any wilful contravention a contempt. The willfulness threshold carries legal significance. The Act does not define “wilful” within its text; whether conduct meets that standard may be contested in parliamentary processes or, if referred, in courts. Practitioners should treat “wilful” as a higher culpability element rather than a mere technical breach.

11. Seat vacancy consequences. Noncompliance with some penalties imposed under s 31(2)(a)-(c) may lead to vacancy of the Member’s seat (s 31(5)). This makes timely rectification and compliance with ordered remedies essential.

12. Interaction with criminal law. Presiding Officers must refer potential criminal conduct to law enforcement (s 30(3)). The Act therefore opens a pathway from administrative or parliamentary complaint to criminal investigation, which can have significantly different procedural consequences.

These are concrete, text‑based pitfalls. Addressing them requires operational controls around gifts and travel records, clear processes for determining aggregation for thresholds, careful handling of blind trusts, prompt lodgement and correction of returns, and awareness of the narrow confidentiality exceptions that permit referral to the Commission.

This section outlines practical, Act‑grounded steps for Members and parliamentary staff to meet the statutory obligations and to limit exposure to parliamentary penalties or referrals. The steps follow directly from the text of the Act.

1. Know the lodgement deadlines and forms.

• Primary returns. Lodge a primary return within 28 days after the relevant commencement date if already a Member at the 2019 commencement, or within 28 days after taking and subscribing the oath or affirmation for new Members (s 17).
• Ordinary returns. Lodge ordinary returns within 28 days after 31 January and 30 June each year (s 18).
• Prescribed form. Ensure returns are in the prescribed form and cover the categories set out in ss 19-20. Confirm any regulatory prescriptions for form content under s 32.

2. Maintain contemporaneous records for disclosures.

• Income. Keep records of payers, amounts and descriptions of services to support disclosure under s 19(1)(a), remembering that “income” aligns with assessable income under the Income Tax Assessment Act 1997 but excludes parliamentary salary and certain public funds (s 2).
• Beneficial interests and shares. Record holdings, names of corporations or bodies, addresses and compute the value bandings required by s 19(1)(b). If share value calculation is impracticable, record the number of shares as permitted.
• Land, offices, debts and trusts. Maintain legal descriptions, addresses, creditor names and trust documentation to meet s 19(1)(c)-(i).
• Gifts and travel. Log gifts, donors and travel contributions including dates, destinations and purposes as required by s 20(1)(b)-(c).

3. Implement a threshold aggregation control.

• Track repeated small items from the same source so that if two or more occasions aggregate beyond the relevant threshold, disclosure is made as required by s 22(3).
• Monitor annual CPI adjustments to thresholds notified by the Clerk (s 24-25).

4. Handle blind trusts properly.

• If a beneficial interest is held through a blind trust, prepare and lodge the required description of the blind trust and the manager’s name and address as specified in s 19(2) and s 20(2).
• Maintain documentation showing the trust structure and the limits on the Member’s knowledge to support any reliance on blind trust exemptions.

5. Avoid conflicts and document decision processes.

• Use a written conflicts register or internal guidance to identify potential conflicts per s 7, including perceived conflicts that could reasonably be seen to arise. Record recusal decisions, advice sought and remedial steps taken to show compliance with the obligation to avoid conflicts.
• For outside employment and activities (s 9), document time commitments and any steps taken to prevent conflicts with public duties.

6. Gifts and hospitality policies.

• Adopt an in‑office policy that maps the statutory definition of “gift” in s 2 and the prohibition in s 10. Decline gifts that create actual or perceived conflicts, or if acceptance might create a perception of attempted influence.
• If hospitality is provided while acting in an official capacity, note that “hospitality” is excluded from the statutory definition in that context, but still be mindful of disclosure obligations.

7. Use of public resources.

• Follow the Parliamentary Salaries, Allowances and Superannuation Act 1968, and any departmental guidance, when using or claiming public resources. Keep receipts, logs and approvals consistent with s 12(a) and s 13(2)(a) obligations to account for public resource use.

8. Confidential information and post‑retirement conduct.

• Treat confidential information obtained in the course of public duties as prohibited from being used for private advantage under s 14 and s 15. Establish internal information handling protocols to avoid inadvertent disclosure or misuse.

9. Cooperate with the Clerk and respond promptly to correction requests.

• If the Clerk reasonably believes a return is inaccurate or incomplete, the Clerk will provide a reasonable opportunity to correct the return (s 27(1)(b)). Respond promptly to avoid referral to the Presiding Officer and potential sanctions.
• If a Member becomes aware of a material change, submit the prescribed description of change as soon as practicable under s 21.

10. Understand publication constraints and media handling.

• Be prepared to issue fair and accurate summaries for public release where appropriate, but note s 28’s constraints on what others may publish and comment on. Seek advice from parliamentary counsel or communications officers before releasing or permitting publication of Register‑related material.

11. Prepare for workplace standards obligations.

• Ensure workplace conduct policies and staff training address the duty in s 6A to foster a safe workplace free from bullying, sexual harassment, assault and discrimination. Coordinate with the Parliamentary Workplace Standards and Integrity Commission’s guidance.

12. Legal and advisory checks.

• Because the Code is not intended to create civil action (s 5A), Members should nevertheless seek legal advice if conduct might engage criminal thresholds, or where publication or confidentiality obligations collide with other legal rights.
• Where in doubt about whether conduct is captured, seek advice from parliamentary administrative officers, the Clerk, or legal counsel. Be aware that the Clerk may refer matters to the Parliamentary Workplace Standards and Integrity Commission (s 27(2)), and that the Presiding Officer must refer matters to law enforcement if criminality may be involved (s 30(3)).

13. Record retention and audit trail.

• Retain supporting documentation for at least the period necessary to respond to inquiries or audits. While the Act does not prescribe specific document retention periods, the records will be relevant for any review, referral or parliamentary inquiry.

14. Plan for CPI threshold notices.

• The Clerk must notify Members of CPI adjusted thresholds before 30 June each year (s 25). Implement a compliance calendar to review reporting thresholds and adjust reporting practices annually.

These steps derive directly from the obligations and practical mechanics in ss 17-29, ss 5-16, s 21, s 22 and ss 24-26. They create an operational compliance system: timely returns, contemporaneous record keeping, controls for aggregation and thresholds, documented conflict avoidance and recusal procedures, careful handling of confidentiality and post‑retirement issues and proactive liaison with parliamentary administration.
